		<description><![CDATA[Hi forum i need help as i am confused and cannot even go to bed, the time of posting this msg explains the stressful situation i am in. I came to UK on spouse visa in june 2006 in august 2007 my marriage broke down,we've got two young boys age 2 and 1, in May 2008 she signed my SET(M) even though we were living apart and was still trying to sort the marriage out, but before then she had told the police that i moved out and her passport was with me and the police contacted home office.till today i am still waiting for my ILR, 7weeks ago she stopped me seeing my children becos i have got a new girlfriend and so i started contact proceedings at the court, and also sent a letter and application variation on FLR(O)to home office informing them that my marriage has broken down whilst waiting for my ILR want extension on article 6 and 8 echr laws. Two days to our first hearing she rang home office as well to inform them. the gud news was she told the court she doesnt want me to see my children ever again, since she is scared i will do a runner with them to Mali(Africa) since she has informed home office that she does not supp my application any longer and also i used deception to enter uk in 2000 before going back to my country getting married in my real name and coming back to uk.<br /><br />Pls help what are my chances as the court gave me supervised contact for 6hrs every saturday and also i am allowed to go anywhere within uk with my children once the supervisor(her mum)agreed to come with me.]]></description>

The idea is to review UK immigration lawyers by giving first hand experiences (good and bad) so that members and guests of this forum can be better informed when picking a UK immigration lawyer.<br /><br />I said this before, the lawyer I used when I applied for my visa was DJ Webb and Co. they are very professional but maybe a bit more expensive than others.  The owner of the firm, David Webb is founder of the ILPA Immigration Law Practitioners Association and very well respected within the UK immigration Community.  The only drawback is the location of the offices, nearest station, Aldgate East and then you have to walk for 10 minutes to the offices on 61 Old St.<br /><br />Do you have an experiences with UK immigration lawyers? 		<description><![CDATA[I am a US citizen who has overstayed in the UK for about a year. Long story short, I <i>had</i> a rock solid case for ILR (prior to the overstay) having grown up in the UK, NI number, family here etc. Now I have overstayed however, I don't want to risk losing the application fee/processing time if I could re-apply in a year without the stigma of overstaying.<br /><br />What is the process for voluntarily leaving? <br /><br />If I do voluntarily leave, will I get stopped at the airport if I have not previously contacted the Home Office?<br /><br />Would I be better off applying anyway from the UK and waiting to return to the US?<br /><br />Any help much appreciated.]]></description>

		<description><![CDATA[hello, I hope some one here can help me undrestand. Me, my daughter(British Citizens) and my wife, An Iranian national entered Britain on the 16th June 2009. My wife's visa, a class C multi was to expire on the 20th june 2009. I was under the impresion that she could stay for a 180 days as the duration of stay on her visa stated. the officer at the airport seemed to taken an exeption to us and having started to shake in a most alarming maner, returned after having discussed the matter with the office behind the entry point stamped her passport with leave to stay untill the 20th june when her visa would run out. he further gave us a warning (w). and seemed to think we should be greatful he is not returning her stright away.We went to the homeoffice the next day and they said there is nothing they can do to extend her visa because of the warning. our planned return tickets to Iran was for 20th August 2009 and we did show them to the officer at the time. <br />My wife  did returned back to Iran on the 19th. the Embassy there cannot be contacted as all the phones seem to be cut off because of the troubles going on there. I now have a 10 year old sitting around crying after her mom, a ruined holiday and about 1000 Pounds unexpected costs if she does manage to get her visa renewed which looks very unlikely. was he " just doing his job", or did he have an argument with his wife that morning and taking it out on us?!]]></description>

		<title>Home Office has lost my passport</title>

		<description><![CDATA[Hi all!<br /> <br /><br /><br /><br /><br /><br /> <br /><br />  Basically: Home office have lost my documents, anddon’t want to admit this and they are saying that it is still being search (since march 2008!) what can I do to get it back or at least compensation for it?<br /><br /><br />   <br /><br />  Here’s what happened:<br /> A year ago I had applied for a Registration Certificate with Home Office and I had to send them my passport along with the application. Few months later  I got letter saying that I’m not eligible for it…<br /><br />   <br /><br />  But that’s not important, the thing is Home office should send me back all my documents (along with passport) and they tried to, however I was on holiday then and the letter (with documents) was send back to the sender – Home Office) – bad luck…. <img src="http://www.ukresident.com/forums/style_emoticons/default/sad.gif" style="vertical-align:middle" emoid=":(" border="0" alt="sad.gif" /> <br /><br />  I’ve contacted Royal Mail and they confirmed that, so I contacted Home office (where my passport should be) but they stated that they don’t know where it is.<br /><br />  On my request  they have raised a P58 enquire about missing documents with Royal Mail on 17 July and told me that should take up to 28 working days, and then I’d hear from them. <br /><br />  It is now over 3 months, still no update about this. I’ve tried to contact Home Office several times (I’ve spend hours on phoneL got cut off several times after 30min on pone,etc) to get some more info, but the only answer I got, was:<br /><br />  <i>“You need to wait longer”</i><br /> Yesterday I’ve talked with supervisor, but didn’t get any other information. She even couldn’t give me any timescale when I can expect answer from them. <br /><br />   <br /><br />  I don’t think I’ll ever hear from them, and here’s my question for you guys: what I can do next about this?<br /><br />  At least I would like to get some kind of compensation from Home Office (it’s been a year since I’m without passport and cannot travel abroad) and I’ll have to spend around 200£ to get new one.<br /><br />   <br /><br />  What are the steps I should take?  Make a complaint? 		<description><![CDATA[Hi everyone, <br />  <br />  I have an enquiry that relates to the Schengen visa regulations and I hope someone would be able to shed some light on the matter. My relatives who are citizens and residents of a Schengen state are sponsoring someone from North Africa for a visit visa to that Schengen state via an invitation letter. The invitation letter was not official but typed by them, signed and accompanied by photocopies of their passports. However, a statement from their lawyer, who is also a close friend of theirs, was also submitted in support of the invitation letter. I am almost confident that this visitor will not be returning to North Africa. I believe his plan is to go visit my relatives in their home country then enter another Schengen states (prob Spain or France) and stay there illegally. My question is would my relatives who sent him the invitation letter get into trouble if he does not exist the Schengen area?? Their invitation letter only states that they guarantee he will leave their home country and not the Schengen area. 		<description><![CDATA[I am suddenly worried I have applied for the incorrect visa-<br /><br />My husband (he is British, I am a US citizen) were married in London in June 2008. I have been in the US finishing my Master's degree while he has been living in London for this entire time, but graduated May 2009. When I phoned worldbridge, they walked me through applying for the visa online, and directed me to select settlement- wife in the drop down menus.<br /><br />I sincerely hope I am merely being paranoid, but researching further it appears the settlement visa is only if you have been married for four years? And that you are supposed to get an LTE, wait two years, then apply for an ILR settlement visa? If this is the case, how does one apply for an LTE? I have researched it to no avail... Or is a settlement visa merely broken into two stages- LTE and ILR?<br /><br />Please advice- my addled brain is panicking that I have done the wrong thing and spent $1000 in the process...]]></description>

I don't have enought point to switcht to tier-1 general due to recent rules being changed by Homeoffice,which requires master degree and high salary. Even I was keep on trying to find job,who can sponsers me under tier-2 (work-permit),but looks like,it's highly unlikely to get appropriate job with required salary and sponsership certificates from any potential employers in this difficult period. I am working in one supermarket for my pocket money. (bear with me this will be fairly long)<br /><br />i am 19 and was born in germany, my mother is german and my biological father was a british soldier, residence location unknown ( he done a runner) my stepdad now was also in the british army and has taken care of me from the age of 1 and a half till present, we have lived in germany from 1990-98, then catterick from 98-2003 and then back to germany from 2003-06.<br /><br />My mum and dad split up in 2002 or 03, and now i live with my dad in catterick and wish to join the army, the problem.......... i have a german passport and my biological father is not on the birth certificate, so how would i go about getting naturalised or apply for citezenship?<br /><br />I have been told that i must be a resident in the UK for 5 years, i have been from 98-03 but then my dad got posted back to germany, but army or government grounds are counted as british soil just as an embassy is, so why did i get refused?? surely i must be eligible! <br /><br />ive never been to a german school, ive always gone to school run by the army, i dont speak the german language, and i havent been to germany for a while now and i dont class myself as german, I only wish to become a british citezen and to join the army which has always been my dream from a young age.<br /><br />sorry for the long post just tryed to get all the details, any replys much appreciated <br /><br />]]></description>

After year into my work permit I started working for a different company, Company B, without changing over my work permit. We were always planning on changing it over but never got around to it (yes, I know, very bad, and I've been regretting it ever since). Company B was and still is well aware of my visa status. I have been working with them for the past 4 years. I don't know if Company A ever "cancelled" my work permit as I've never had any issues going through immigration whenever we've been on holiday or anything at the airport.<br /><br />I recently got married to a British Citizen here in the UK. We went through the right channels, got COA, got married, everything fine. I am now looking into moving over to a spousal visa, but obviously very nervous about applying. My "invalid" work permit expires in 4 months, and would like to have something sorted out ASAP. <br />What are my safest/quickest/best option here? I don't want to get myself, or my current employer into any problems.<br /><br />Any guidance would be much appreciated.<br /><br />Thanks]]></description>

The police then relaised that I had overstayed my 2years visiting visa. I have now been asked to be signing in every week and im really scared, because the HO says that I am liable to detention at anytime.My wife has recently become a british citizen.Me and my wife have been together for over 2years and have also been living together within this time.  I did my fingerprint testing last month and Home Office said they would be intouch with me within 6weeks to inform me on the outcome of the whole application.However last week I got a mail from the HO saying i needed to say before the end of july where my mothers home addres is and where my biological father is. My mother doesnt have her correct papers and my dad is in nigeria. I made a post a while back explaining a situation where my Canadian (pregnant) partner of 7/8 months who was in the country and still is on her marriage visa. Last year, that marriage collapsed and long story short (and after several conversations with various lawyers) the only way she can now apply is 'above and over' the rules.<br /><br />We have today provided all documents to the lawyers who are putting her case forward (showing earnings, the fact we can support ourselves and also have full financial support of parents) and everything else required. We've been told that this is likely to be refused, however, there is a good chance of the appeal being accpeted, particularly due to the pregnancy and by October, she will also be medically unable to fly. <br /><br />Now, here is the enormous problem that we've got and also been given conflicting advice by two different firms. <br /><br />We have a flight booked to Canada for 2 weeks, which departs this Wed 24th (2 days time!) We are due back on 11 July and her visa expires on 24 July. Now, the first lawyer has advised that this will be fine to do as the visa will still be in date upon arrival back in England.<br /><br />The other lot have said that there is a chance she'll be refused entry back into England as doesn't have the valid grounds to come back into the country (IE, the marriage is no longer subsisting) and it could be seen as deception. How does this work if the visa is still in date and the application is still being made, just under a different way?<br /><br />We've got less than 24hrs to decide whether to cancel the flights or not and are both absolutely gutted. She was really looking forward to a two week break away from all the stress in this place and not having to worry about stuff for a while, then we get this bombshell today.<br /><br />Any assistance you can offer guys will be absolutely fantastic.<br />Unfortunately, the border agency / home office lines aren't available or open till 9 in the morning, so am really up in arms at the moment.]]></description>

		<description><![CDATA[Hi there<br /><br />A very quick response would be urgently appreciated here as my girlfriend is supposed to be flying tomorrow.<br /><br />We had a flight booked with Air Comet from Lima to Madrid and a connecting Air Europa flight from Madrid to London. The 2 airlines had an agreement (codeshare?) whereby the flights could be treated as 1, i.e. pricing structures, not having to re-check in the bags etc.<br /><br />Well, the agreement collapsed last week (we were told 2 days ago) so the ticket was no longer valid. Expedia had to reissue the ticket as 2 separate tickets which means she would have to check in her bags again etc. Fine. Previously the flight did not require a Schengen visa as the customer didnt have to re-check in (and the flights were arriving and subsequently departing from the same terminal). My girlfriend was just told this morning by Air Comet that because there is no longer the agreement and we have to re-check in again, a transit visa is now required!! She is travelling tomorrow! Everything is the same; the same flight/seat/terminals (arriving and departing from the same terminal). Does anyone know what the situation here is? Is it because when you pick up the baggage and you re-check in you are effectively leaving the terminal and therefore require a visa? This has all happened without a moment's notice so we are so stressed about this. A refund is not an option as we are getting married next week! And the next flight at immediate notice is £3000! If she just goes regardless, would she be turned back to Lima from Madrid? Or is this a non-issue because the arrival and departure is from the same terminal. We are getting completely conflicting advice from Air Comet, Air Europa, Expedia etc etc so we just dont know if this is an issue or not. 		<description><![CDATA[Hello, My parents are applying back home for a tourist visa to visit uk. But the thing is I am on appeal stage now and my visa expired in January. I wonder if this will affect their visa. <br />There is a section that ask "do you have any friends or family in the UK?" and "are u going to visit them?".<br />what should they answer? No we don't any family member or yes we have but we are not going to visit them?<br />I'm scared that if they say know, may be ambassy can check on the file and see that they have as I always provide my parent names on all my apllication.<br />Please help. <br />regard]]></description>

		<description><![CDATA[Just curiuos if anyone has experience applying with Permanent Residence Certificate (EU route) that is not inserted in passport.<br /><br />This Certificate of Permanent Residence is issued as a separate document (24 cm x 12 cm blue piece of paper folded in three. When folded it is the same size as passport (i.e., 8 cm x 12 cm). The certificate has my picture and printed on special paper, with a hologram and some other antiforgery features.<br /><br />It's not explicitly listed as one of accepted documents on AN application form. I don't suppose this should cause any problems, should it?<br /><br />]]></description>

I belive the settlement visa clearly assumes you intend to settle in the UK, which is not a problem.  However, is it necessary to apply for the EEA National family permit visa as well or instead of?  Will I be eligible for both or only one?<br /><br />Please help.  If I need to re-apply we will need to do so soon.  I want to join him ASAP. Rejecting her visa application on the grounds of deception and giving her a 10 year ban from the UK. This letter I personally think was not really necessary anyway because she was being sponsored by a member of my family who could more than support her, as well as her own father who is a successful business man out there. 		<description><![CDATA[i got a letter from HO today thats gives me all the details of my immigration file.<br /><br />it shows when the file was opened. i didnt have a valid passport at the time of the application so the lawyer sent in my mother and brothers passport and told us that when the HO were ready they would request my passport.<br /><br />on the paper i received it said 'no passport was submitted for dependant shamkute (thats me). it is not clear when she arrived in the UK. this aplication cannot be considered in Managed Migration but will need to be considered by IS.<br /><br />my lawyer cannot explain anything to us - <br /><br />it then says that the app was then forwarded to LSCU 6 and asks them to consider this charged case in due course.<br /><br />10 january 2008<br />it shows that the passports where forwarded to in liverpool.<br /><br />15 jan 2008<br />it shows where it is linked to the application and then forwarded to LCCW HOLD 166<br /><br />then 21 may 2009<br />it then states that 'not a VM case. 		<description><![CDATA[Hi,<br /><br />I wonder if you anyone can help me.<br />My girlfriend was refused entry due to the fact she tried to come to UK when she had already been in the UK for a total of 6 months in that year. She was also faulted on not having enough money (I stupidly provided no evidence of me being a sponsor) and also they stated they believed she would not return to Israel, having no commitments there.<br /><br />She is now going to apply for a visa beforehand just so she does not get turned away at the border again. It will be 1 year since she last got permission to stay for 6months, and I will provide evidence of me and my family as sponsors. However, I am still wondering how she would go about proving she will return to Israel. She will return, and she intends to study here sometime next year (that application comes later). But first she wants to visit me here. How can she prove she will return? Is there any more info people could give me in regards to this application?<br /><br />Any help would be appreciated. 		<description><![CDATA[Hi all<br /><br />Before I being my post I would like to stress that what I am about to write is by no means of me intending to offend anyone of to in anyway racially motivated, I have been reading these forums and have had some interesting reads and I fully sympathise with most people on here and wish them all the best luck in the world but you must read it from the other side where a minority of people are spoiling it for innocent people.<br /><br />My story is (I have posted my story fully earlier), so if you want the full story I suggest you read that first to see where im coming from, however this topic I mainly wanted to concentrate on overstayers.<br /><br />My wife ran away with an overstayer and they are both successfully decepting the Home Office with various lies and ect.  The overstayer entered the UK 6 years ago on a sham marriage by paying a girl £15,000.  He was soon discovered by the HO and this failed and was given his marching orders from this country.  Yet the Border Agency have been unable to find him since I told them where he was 2 months ago.  I have given them everything, even down to the photos of him living at that address with my ex.  Yet the Border Agency are still looking into it, whilst they both are living of state benefits and waiting for my divorce to go through and they both apply for a COA.  She was also from abroad and left me for him straight after she got he ILR.  She was apparantley having an affair with this overstayer for the past 2 years (which I have found out now)<br /><br />Now call me a jealous husband, I have reported them both to immigration but im not counting on them to do much, but people like these do give us A) Our country a bad name, <img src="http://www.ukresident.com/forums/style_emoticons/default/cool.gif" style="vertical-align:middle" emoid="B)" border="0" alt="cool.gif" /> Foriegn settlers like me a bad name and C) Genuine people who have come here for a better life here a bad name and makes it harder for those people.<br /><br />Again no offence intended.<br /><br />Thanks<br /><br />Mehfs<br /><br /><br />]]></description>

		<description><![CDATA[<a href="http://news.bbc.co.uk/1/hi/england/london/8081354.stm" target="_blank" rel="nofollow">http://news.bbc.co.uk/1/hi/england/london/8081354.stm</a><br /><br />An illegal immigrant from India who ran an immigration consultancy business in London has been convicted of running one of the UK's biggest visa scams.<br />Rakhi Shahi, 31, was found guilty of conspiracy to defraud, handling criminal property and immigration offences at Isleworth Crown Court.<br />Jatinder Kumar Sharma, 44, her husband, earlier admitted his part in the scam.<br />Neelam Sharma, 38, also thought to be Sharma's wife, was found guilty of handling some of the cash in the scam.<br />But she was cleared of conspiracy to defraud and immigration offences.<br />Both women had denied the charges. All three lived in Clarence Street in Southall, from where they ran their consultancy Univisas.<br />'Damning indictment'<br />The group created thousands of bogus documents including college degree certificates, tax and wage forms, references and academic records, to secure UK visas including student visas.<br />The scam exploited the Highly Skilled Migrant Programme, the International Graduate Scheme and other leave-to-remain visa applications.<br />Police suspect the company secured visas for at least 1,000 people, mostly from the Indian sub-continent, using a network of bogus colleges in London, Manchester, Bradford and Essex.<br />Eight Pakistani terror suspects who were arrested earlier this year during raids in Manchester and Liverpool are also thought to have used a similar scam to gain UK visas.<br /><br />The fraudsters offered money-back guarantees to clients<br />The UK Border Agency, the Home Office and the Office of the Immigration Services Commissioner (OISC) were criticised for a "shambolic" system which the fraudsters exploited.<br />Prosecutor Francis Sheridan told the court the evidence against the trio presented a "damning indictment" of failures of the UK's border controls.<br />The court heard Home office employees failed to spot discrepancies in employment certificates and wage slips and that some students appeared to have attended two full-time courses simultaneously.<br />Several applicants gave the same address and in one case one person's sex changed in the middle of the immigration process.<br />'Major international conspiracy'<br />Last February the Metropolitan Police and the UK Border Agency raided Univisas' office and found 90,000 documents, including false university certificates and pay slips.<br />Officers also found passports, 150 ink stamps and £22,500 in cash and seized 980 individual files.<br />The court heard the fraudsters charged hundreds and thousands of pounds as fees and were confident enough to offer a money-back guarantee to clients.<br />The scam garnered more than £1.5m in two years, of which police have so far been able to seize £420,000.<br />Jatinder Sharma was caught when he offered to get an undercover newspaper reporter a post-graduate diploma in business administration and other papers for about £4,000.<br />Following the verdict Tony Smith, the regional director of the UK Border Agency, said: "This was one of the largest joint investigations ever undertaken by the UK Border Agency and police.<br />"We believe we have cracked a major international conspiracy to facilitate the entry of illegal immigrants into the UK.<br />"Those behind it showed total disregard for the law, and their motives were purely financial."<br /><br />]]></description>

My partner has only recently told me that he is an overstayer and should have returned to Nigeria in 2006 - he had a 2 year multiple entry business visa.  Prior to this he has been to the UK in 2002, 2003 and 2004 on work permits and always returned to Nigeria within the stipulated dates.<br /><br />Our relationship status is that we do not live together although we see each other every day. What are his chances of applying on an access to child visa?  <br /><br /><ul><li>His name is on our daughter's birth certificate</li><li>I am a UK resident</li><li>He spends time with our daughter everyday (he stays at my house every other night)</li><li>He has every intention to play an active role in our daughter's upbringing which is why he wants to legalise his status in UK</li><li>He rents accomodation and can provide the tenancy agreement as evidence of his own accomodation</li><li> We have set-up a company together which brings in a modest income (approx £1200/month).  The bank account for our company is in my name since he cannot open a UK bank account.  Can he use this as evidence of being able to support himself?  He has not paid any tax or NI contributions.</li></ul>Can he apply for the access to child visa here or should he go back to Nigeria to do this? Obviously my concern is that if he leaves the country there is a chance that his application be refused.  Also I know that normally access to child visa's are common when the relationship between parents has broken down which is not our case. 		<description><![CDATA[A cousine of mine is having major immigration issues... i will tell you his situation. <br /><br />He is a 23 years old Nigerian and he has been in Uk since 2002. my Aunt, his mum brought him to Uk when he was 16 on a 2yr visit visa. <br /><br />He tells me that his mum lost his passport many months after that. so it was not possible for him to travel even if he wanted to.<br /><br />Now he has gone through hi-school and university as an illegal immigrate and is currently doing his Masters degree. Unfortunately for him his girlfriend got pregnant and he now has a son. His son is British because his gf is British even though she is originally from Ghana.<br /><br />So his dilemma is that recently he left his security job because they were asking too many revealing questions about his status. and since he wants to take care of his son, he now more than ever needs to get legal so that he can work and take care of him.<br /><br />Any advice for Him? thanks]]></description>

		<description><![CDATA[Indeed an interesting forum. Let me add my problem, probably shared by many. My wife and I first met 13 years ago in South Africa and had an on/off relationship for 10 years. She is of South African birth but has a British passport, and liked spending summers here and winters in South Africa, where her parents also live. South Africa for the weather, and here for European adventure and worthwhile employment. I had children to raise by a previous marriage and could not always travel with her.<br /><br />This was an unsettling situation, and finally, three years ago we felt free enough to get married, hoping to settle somewhere mutually agreeable. Immediately after our wedding a crisis occurred in my family, and my wife found a good job in the South of France, where she headed. I followed soon after on a Schengen visa in my South African passport. In France things didn't look too good. Short holiday, yes. Live and work, no. I headed back to SA, got a UK Entry Clearance (spouse visa) which took 5 days by courier from Cape Town. Landed at Heathrow on the first day of the visa, 1st Nov 2006.<br /><br />Found lodgings and work. My wife came to visit when she could, but her job kept her quite busy in France. Time passed and here I am, six months away from end of the visa period, happily married but only seeing my wife every 3 months or so for a week or two. I love it here but miss her dreadfully. We have a sort of 'virtual life' with telephone, Skype and Google chat. What's there to do? If I got ILR I could eventually go to France and live there, which seems quite appealing. She will not give up what she has in France. I don't mind going back to South Africa, if all else fails, but it is rather a sad outlook.<br /><br />Any ideas?]]></description>

		<description><![CDATA[Hiya,<br /><br />I recently applied for EEA PR having held a 5-year EEA residency permit. After 7 months the HO have finally returned all my documents with a covering letter turning down my application on the grounds that my Decree Absolute was on the 20th of April 2006 and the said regulation was applicable from 30th April 2006! It goes on to say there is no right of appeal.<br /><br />A little back ground information - I was with my ex for 13 years, of which we were married for over 3 years, lived in the UK as a couple for over 10 years and also lived and worked in the Republic of Ireland. The ex held dual nationality (Irish/British) as she was from NI. In total, I've spent 18 years between the UK and the Republic.<br /><br />Now, before I consult an immigration solicitor, I want to know what re-course do I have and how best to approach this. Surprisingly I am calm given they've had 7 months before getting around to telling me all this and furthermore, it's only 10 days difference between the revised act and my Decree Absolute. BTW, I am in full time employment, have my own house and a new partner who is Austrian. We have been together for nearly 2 years now but I do not want to go down the un-married partner route before I have all the available options. <br /><br />If anyone has encountered a similar situation himself or herself, I would like to hear from you and how things panned out.<br /><br />Many Thanks.]]></description>

However,I dont have any convictions against me and I willingly signed a form to voluntarily leave the uk. My girlfriend is british and she's planing to exercise her EU TREATY RIGHTS in The Republic of Ireland by studying this August 2009. I would like to know if I can be granted a visiting visa to visit her once she's already started exercsing her rights there and what form is it i need to fill out for the visitors visa? . Also, I would like to know how long the whole visa process takes roughly. We intend getting married in Nigeria in in early august and go to Ireland together on our honemoon after she's started exercising her treaty rights.<br />Thanking you all in anticipation of a helpful and informative answer.  <br /><br />p.s: I know all about the rights accorded spouses of eu citizens execising their Eu treaty rights and the six month wait period generally required to wait for a decision from the Irish justice department when trying to go there on the strenght of your Eu spouse's Rights. We have met a person who was a ex councellor and his daughter was a solicitor, he told us that he wil extend pur 1 month temporary visa and he has taken our passport and 2500 Pound but after taking money and passports he never met with us and he has sent us a home office letter that your passport are in HOME OFFICE. Now after few weeks that man have thrown our passport in our house and woitnout any visa.<br /><br />Now problem is our visa have been expired in March 2008 but in januray 09 my wife got very sick and doctor confirmed that she is suffring TB MANINGITIS IN BRAIN and still doctors are not allowing to go back our country because my wife is under serious medication.<br /><br />Please advsie these :<br /><br />1- How can we go to our country ?<br />2- I want to go my country and I WANT BUY MY WIFE, MY BABY and MY TICKETS MYSELF . And if i will do this then after one or two year can I enter again ?<br />3- My baby was born in England and now he is 14 months. My husband was deported from the UK on 'not conducive to the public good' grounds after serving 9 month prison sentence. He was also an overstayer.  We were not married at this time, but I since went to his country and married him, now I am back in UK. I have relatives in Ireland and have been offered a job there.  I want to go but lately I have been wondering, if there is any chance of my husband coming there with me.  I am going to see him in March, and am thinking we could travel to Ireland together from his country.  He does not need a visa. I have been reading online and on this site about EU & exercising treaty rights & it looks as if, he has the right to enter Ireland with me as my spouse. Also I have seen there has been a new ruling about non-EU spouses & Ireland but have not had a chance to read that properly yet. But I am very worried as he has been previously deported from the UK - I know Ireland is not the UK but am so scared they will turn him away at the airport.  I think its form EEA1 we would apply on? I looked at form and it asked if ever deported from 'the state' does 'the state' mean Ireland, or whole of the EU? Also says can apply to a department in Ireland to have the deportation order lifted. We have discussed it and we plan to declare all immigration history anyway and just see what happens. I also worry that they will think it is a marriage of convenience as we have not been married long, but we have been together for 2 1/2 years now and I have some proof.  If they refused him entry I also wonder if this means he would enter Ireland and appeal against it from there, or if they would just say no, he cannot enter Ireland at all?  Sorry I know this is complicated but I do hope I can get a little advice, thank you.]]></description>

I found a solicitor from gumtree. He said i can use my previous master degree to apply for tier1. which the fee he ask for was 2000 pounds i paid by cheque and cash in jan 2009. After i paid all money he was not pick up my phone and he move his office. I can not find him. He came back again on April 2009 asking more money for 1000 pounds to switch to student visa and he said my visa had been refused. He return all documents to me and said he will give me refund  and again he disappear and left me become illegal here.  I did called to home office in march 2009 there was no record of my application. I dont have anything to say my application been refused from home office, it seems he just took my money and keep my application until it expired. My husband and I have been on seperate work permits since Aug 04 and I have been here since Mar 06. Our son was born in UK in July 08. Since Dec 08 he and I were in India and we applied to employ our maid in UK. I came back to UK in May 09 but he is still in india and the maid is taking care of him at my parents house. This maid has been working in my father's house since 4 years . However our application got rejected on the ground that the ECO did not see a connection between us and the maid. <br /><br />We are now planning to appeal against the decision and wanted advice on<br /><br />1. Which is a better place to apply the Mumbai Embassy or AIT in UK?<br /><br />2. 		<description><![CDATA[Hello everyone, I'm praying & hoping someone can help me with a solution to my situation. I have been living in the UK for about 10 years now, i came on a visitors visa from zimbabwe and haven't left since the troubles back home meant there was nothing much to go back to. Family were supposed to help me sort things out, but now i fear it might be too late to do anything - I was a bit naive to think things would sort themselves out. I have been working illegally, using a made up NI number, but have never shown any employers my passport or ever used false documents. I live with my boyfriend, we have been together for just over 5 years & have lived together for over a year, he is unaware of my situation & I'm not sure how to tell him. I just want to be become legal, be able to work & move freely. Most of my family is here, some a brits & others various visas, but my family are not the helping kind. There is nothing for me to go back to in Zimbabwe, but fear that with no other options available i will have to return to country i have not been to for so long. 		<description><![CDATA[I am a British Citizen married to an Indian who is currently on her 2nd 2 year leave to remain visa (due to her being unable to pass the Life in the UK test despite speaking perfect English <img src="http://www.ukresident.com/forums/style_emoticons/default/rolleyes.gif" style="vertical-align:middle" emoid=":rolleyes:" border="0" alt="rolleyes.gif" /> ).<br /><br />My wife gave birth to twin girls last November and we quickly realised that she was going to need more help than my work would allow. To that end we invited my wife's sister who has now been here for 5 months.<br /><br />My wife has been lead to believe by another foreigner at her local baby club that there is a way for a family member to extend a visa to a number of years; possibly requiring a letter from our GP indicating that the extra help is needed.<br /><br />I would be supporting my wife's sister financially as I have been for the past 5 months so presumably this wouldn't be a problem.<br /><br />Is this something anyone has heard of; and if so what is the process?<br /><br />Many thanks for any help<br /><br />Simon]]></description>

I have convinced him to get back with me and i am in the process of convincing him to come over with me for 12 months i am trying to get the british passports for the children and it says on application that you need there australian passports to send in with application does anyone no if u actually do need to send them in as i can not get any information on this from anywhere i can not send them in because the father has them and will not give back i can not report them missing cos he will not come over with me any ideas please you also can give a good reason why they ae not available to send in any ideas would be good thankyou</description>

		<description><![CDATA[I am married to a British Citizen 5 years now.  We lived in the uk when we were first married and I had a 2 year work permit.  Since then we've moved back to Canada and the visa expired and my Canadian passport has been renewed so I no longer have a copy of the old marriage visa.  <br />Now we are moving back to the uk and I'm wondering if I need to apply for a marriage visa again before entering or if I should show up and apply for permanent residency or Indefinite Leave to Remain?  Since we've been married 5 years does it make a difference?<br />Also what is the test stuff that you need to take? 		<description><![CDATA[I hope I will be able to explain this situation clearly<br />My brother is ex-forces and has ILR...we are from Zimbabwe and he has my niece and little sister legally adopted as my parents could not cope as the situation in Zimbabwe got worse. They have been here since 2003 August.<br />Over the years...my brother has not been able to gain fultime employment (a bit disappointing considering he has to look after these children) My niece is now 18 and my younger sister is going to be 17 shortly...<br />They have overstayed and he got forms to apply for them as his dependence I am awaiting my legacy case to be resolved so am not financially able to help with the £750 needed for each of them...I do not know what to do because they are sooo depressed as there have been immigration officers at their college....<br />What can I do or what can we do...do we need a solicitor as one is over 18...will my legacy case help in any way Please help I am besides my self....]]></description>
