		<title>Youth Mobility Scheme To Spouse Visa</title>

		<description><![CDATA[Ok, this is duplicating some of the other posts, but I just want to clarify.<br />
<br />
I am a british citizen and have been working abroad.  I am going back to England to study and we are planning on getting married within two years.  We had planned for him to get his first two years on the Youth Mobility Scheme, and then when this expires he could get a spouse visa.  Is this possible?  I know that he would have to apply for a Certificate of Approval for us to get married in England, which seems simple enough.<br />
<br />
Here are my questions:<br />
<br />
As the spouse visa is not a visiter or points based visa can he switch to this from the Youth Mobility Scheme?<br />
Can we get married at any time during his Youth Mobility Scheme visa?<br />
Will he have to leave the country to apply for the spousal visa, and if so how long woul this take?<br />
Is there anyway to clarify this with the hoem office before applying for the Youth Mobility Scheme?  <br />

I have a question around YMS.  I am looking to apply for an Italian Working Holiday visa and work in Italy for 6 months prior to starting to work in the UK on a YMS visa.  Will there be any problem having the two working visas for the same period?<br />
<br />
For example: <br />
Get Italian working visa and use it for 6 months<br />
Get UK YMS after Italian visa has been granted but lose 6 months off visa as am in Italy and then commence UK YMS visa for 18 months. <br />
<br />
I guess what I'm getting at is would I not be granted a UK YMS visa because I already had an Italian visa for the same period?<br />

My fiance and I are currently in the process of applying for our Cerficate of Approval for our registration of marriage in London.  Our application was received and acknowledged, and everything's been quiet about it.  Its been 7 weeks and counting, but I'm being patient about that.  My question is about the eventual switch that will come.  I've asked quite a few people and my responses have been mixed.<br />

Will I have to go back home to Malaysia and apply to switch from my WHM to EU Spousal?<br />
<br />
Apparently most Chinese/Asian and Malaysian people I've met keep telling me that circumstances are different if you're from Malaysia, and you're required to go back home and apply Entry Clearance again.  But that is one of the Border Agency's "tricks" to get you out of the country, and then they will make it as hard as possible for you to come back in.  I find this appalling and I'm really quite worried. My fiance and I met and fell in love and are now trying to start a family.  I'm applying for a permanent job now, and if the immigration requires me to go back home to Malaysia this will put me in a very tough position.<br />
<br />
My fiance keeps saying that I'm worrying over nothing, and that the Border Agency can't possibly be that difficult.  Have any of you heard of a similar situation?<br />

I'm a BN(O) (I was cut out of the Borders, Citizenship and Immigration Act 2009 which discriminates racially) and I want to apply for YMS. I studied in the UK between 2000-2006 for secondary education and 2006-2009 for higher education. Between Oct 2009 - present I have been in the UK on a visitor visa.<br />
<br />
- Do these previous student visas/visitor visa change my eligibility for YMS? <br />
<br />
- Also, can i apply from HK but put an address in Thailand as my residence on the application form? (Not essential, but would be more convenient for personal reasons.)<br />

		<title>Yms Refusal.. Other Solutions?</title>

I hope someone can advise me or offer a solution that I haven't though of. I'm an Australian citizen and I've been living and studying in Vienna, Austria since September 2009. I want to spend 6 months working in the UK, particularly as my partner is there completing an internship. I have applied twice now from the British Embassy in Vienna (which is sent to Warsaw, Poland for processing) and have been denied twice. The first time it was because my 'Maintenance' proof was a faxed letter from my bank in Australia stated everything required and a printed online bank statement, which they said was not acceptable. So I opened an Austrian bank account and had a letter from the bank with all required information and stamped by the bank, in English, and submitted this.. and was once again denied.<br />
<br />
It was returned based on a clause which I had never seen in Immigration documents and was never mentioned to me in my many emails, phone calls and website searches of WorldBridge or the UK Border Agency. I am really upset that this was never brought to my attention, was not to be found anywhere on publicly available visa information websites and now my application has been refused because of it. As the Tier 5 Youth Mobility Scheme is only available for application outside the UK, I don't think it's possible anymore as my Austrian student visa is about to run out (17th February).<br />
<br />
This is what the refusal notice said:<br />
You have not provided the specified documents to support your claim of 10 points under Appendix C of the Immigration Rules. You have provided a letter from Bank Austria confirming that you hold the sum of 1950.50 euros. However, the rules state that these funds should have been held in your account for at least 3 months prior to you making your application. As the letter from Bank Austria does not confirm that the funds have not been held for a minimum of 3 months the letter is therefore not acceptable for consideration under the UK PBS T5 Youth Mobility Immigration Rules. You have not, therefore, scored 10 points under Appendix C and I refuse your application under paragraph 245ZK(d) of the immigration rules.' <br />
<br />
Once more, after spending hours today searching in the Immigration rules for the clause referred to - and yet I still find nothing about it. This is what I found, and I was unable to find any more information relating to my reason for refusal.  I just don't understand why it is not easily found on the UK Border Agency website, particularly if it is reason for refusal. <br />

This has caused me so much stress and upset.. particularly as I am from Australia and it's not like a flight to come back to the UK is cheap!!! I don't see why there is such a big problem with me getting this visa.. I never hear of anyone else having problems with it. Please, if someone can offer advice or help... Otherwise offer any other solutions for what I can do. I am still going to the UK on a tourist visa and would like to stay with my partner and other friends for a while, travel etc but having a job would be essential or else I would have to go home as I couldn't afford it. I'm a student and in Australia they generally don't give out many loans to students as we don't have the required income.<br />

Please reply as soon as possible, as I mentioned I have limited time to organise what I will do next before my Austrian student visa expires. I would greatly appreciate your recommendations or assistance with this.. I have been distraught over how to complete my application correctly to ensure I would receive the visa the second time. Otherwise maybe you can offer some advice to me as to what step to take next - as I am aware it is not possible to apply for this visa category within the UK. I would be very grateful for your help...<br />

i am thinking of applying for a youth monility scheme visa and just want to know something.. i have recent deposits on my bank statement that come from a personal loan that i got.. im just wondering if this would be ok to send off and explain that these deposits are from a loan or not.. the loan was only acquired  with the intention of having a bit of extra money to have for traveeling before hand with knowing i will have heaps left when i arrive in the uk that could last me a while..as i read somewhere thats the maintenance funds can be loan available and then somewhere else i read you cant have any loans at all.. any help would be appreciated<br />

I am eligile for <strong class='bbc'>HSM/tier 1</strong>. I am going to apply this HSMP at 01 March.2010. But I know, I cant applyy this from UK.(basically, I m from pakistan.)<br />

I have to leave this country. This year, I also got work permit from Denmark embassy.<br />
<br />
So, I am going to apply my <strong class='bbc'>HSM/tier 1</strong> from Denmark.<br />
<br />
But I have one confusion about maintance of funds (three months).<br />

1) My partner and I are intending to move to the UK next year<br />
2) We are Australian and eligible for the YMS scheme<br />
3) My partner is in the process of applying (and is eligible for) an EU citizenship <br />
4) The Italian embassy have suggested that this could take up to 12 months<br />
5) I do not want to wait that long<br />
<br />
My question is, if we both take up YMS visas and during this time my partner receives his EU citizenship can he transfer on to this visa?  Does he have to wait until the YMS visa finishes?  As his unmarried partner of more than two years am I eligble to be an unmarried partner even if he has not been an EU citizen for the whole two year period?<br />

I am currently married but will be filing for divorce in the UK. <br />

I have met someone who i am now going to the UK to be with. <br />

Tier 5 visa was chosen by me so we could build 2 years of relationship together to satisfy the requirements for either Fiance or Spousal or even Unmarried Partner visa. <br />
<br />
We have been chatting and phoning every night for 4 hours to each other for the last 7 months. <br />
<br />
I have recently been to the UK on holiday to see her and everything went fantastic so i am now going to do a 2 year working visa so that we can see how we go. <br />
<br />
My questions are. <br />

What visa would you change to while your on the tier 5. <br />
<br />
How would you go about it. <br />
<br />
And also could someone explain to me what a (COA) is?<br />
<br />
Apparently it is possible for me to change from a YMS visa to a Fiance or Spousal from inside the country, i have not been able to find out any information regarding this procedure though.<br />
<br />
Any help would be greatly appreciated because we are a genuine couple and really would have a lot on the line. <br />

I am hoping to get some general thoughts on my situation..<br />

I am a 23 year old Australian male that has been in a strong relationship with a 21 year old British female citizen. I previously lived in the UK as a dependant to my father (who was there on a 5 year ministry visa with ilr). I deeply regret not applying for dual citizenship - Especially seeing that I am looking to move to the UK to be with her and marry within a year (move may 2010, marry by may 2011)<br />
<br />
Our situation is this:<br />
 - we have been in a relationship for a little over 2 years<br />
 - we are not yet engaged<br />
 <br />
I was originally considering going over on the youth mobility scheme and changing to fiancee visa once the proposal took place, however i have come to learn that this scenario is heavy scrutinized and usually rejected (because of the change from temporary to permanent stay)<br />
<br />
So I am think my other option is to apply for a fiancee visa, but we have the following complications:<br />
<br />
 - we would prefer not to marry within 6 months - although this is not a dealbreaker.<br />
<br />
I do plan to seek professional advice on this as well, and would appreciate any recommendations on who i could discuss this with.<br />

I have studied in London from Sep-2005 to May-2007 in University of Greenwich and then I got SEGS visa from May-2007 to May-2008. I came back from UK in 2008. Now I am thinking to apply for any work visa for UK and my first choice is YMS Visa. So can someone advise me can I get YMS Visa easily? or should I think for another visa. And please let me know can I apply for Tier 1 (PSW) visa now?<br />

I've just realised that I have used up my 52 weeks of working on the working holiday visa (valid April 08 - April 10 - I got here at the end of April). I've been with my current employer for 49 weeks and I was with one other employer for 3 weeks. 'm still due to work for another 3 weeks at my current job as they need to hire someone new and I'll give them a handover.<br />
<br />
My problem is, I'm due to go to Turkey for 2 weeks at the start of September, I'll be finished working by then - even though it will mean I've 3 weeks overworked. <br />
<br />
Will this be a problem when I try and re-enter the country? Do they call anyone or do any checks? I don't want to work anymore after this and I'm just planning on hanging around for a couple of months until my British boyfriend finishes his contract and comes with me back to Australia.<br />
<br />
If I booked my flight back to Australia would this help, even though the flight wouldn't be until November?<br />
<br />
I was also thinking of printing out bank statements to show I have lots of savings - even though I was then thinking that maybe I'll show too much savings they'll be suspicious.<br />
<br />
The other thing I was thinking of doing was just not invoicing the company for the last 3 weeks - I know you're not supposed to work for free either but at least this way according to my NI it looks OK. But if they ask me what my finish date was, but work might say something different if they called?<br />
<br />
My boyfriend thinks I've over stressing - but he doesn't have anything to worry about coz he's British. Funny enough the last time I went on a holiday and came back into the UK, in April 09, they didn't even say one word to me and I was also stressing then.]]></description>

I have logged an appeal over the WHM refusal and its going to be a PAPER HEARING. Anyways, I have been waiting from almost 1 year and just wants to know the Final Result. In the last letter by AIT , they had clearly written that it 'send documents within 56 days', the letter was drafted on 18th March 2009. Now can someone plz tell me how long I have to wait? its almost 140 days. <br />

I do call & wite them to get the updates but the only answer they have for me is '<strong class='bbc'>DUE TO THE HEAVY CASE LOAD UR CASE IS IN THE QUE</strong>', honestly I am not ready to hear these world again. Whatever the answer is I just want to hear.<br />

Came back, changed their name, got their new passport with their new name and successfully applied for a Youth Mobility Visa and went over with their new passport, bank account and NI number and did it all again.<br />

I have sponsored a relative of mine to come to the UK on the WHM visa, he applied in September last year before the scheme was changed. His hearing is scheduled for the 22nd of this month and I was just wondering what I can expect? <br />

Is there anything I am required to take with me? What sort of questions can I be expected to ask?<br />

The main reasons he was given for his refusal were that they did not believe he was a geniune visitor and that he would not return at the end of his two year stay.<br />

		<description><![CDATA[Hello there, I hope someone might be able to help me here since the UK Border agency have been useless frankly.<br />

My situation is that my girlfriend (Japanese national) is planning to move to the UK next year permanently. I am wondering then whether we can legally get married while she is on the YMS visa - the issue is the fact that everywhere I've looked it clearly states that someone on the YMS visa cannot transfer to another visa (which I guess includes Spouse visas). If this is the case then are we simply not allowed to get married in the UK at all until her YMS visa expires after 2 years? What happens if we want to get married after a year? Are we simply not allowed to?<br />

I hope someone might be able to help me with this as after several emails and phone calls the UK Border Agency still havent given me a clear answer.<br />

I'm finishing up schooling this winter here in Canada, so decided to take<br />
advantage of the YMS visa and explore England and see what it has to offer.<br />
I plan on moving to the London area next spring, sometime early June.<br />
I'd prefer to avoid living in the heart of the city but will let work<br />
dictate that.<br />

My education is IT based, primarily working with databases, networking and<br />
some programming. I was curious as to how difficult it would be to find a<br />
job in the field of IT.<br />
<br />
Secondly, I was wondering if there were any sites I could browse to see<br />
what type of jobs are available, I've been told that the majority of these<br />
jobs are handled through agencies.<br />
<br />
In regards to more day-to-day type things:<br />
<br />
Would I qualify for a driver's license? If so would there be any restrictions?<br />
I've held a valid license in my province for the past 5 or so years, with no<br />
infractions.<br />
<br />
What can I expect for average monthly costs for a flat? roomshare?<br />
<br />
<br />
I know I'm missing things that I wanted to ask, but they elude me at the moment,<br />
will have to add them when they come to mind.<br />

My partner and I are in the early planning stages of our next year and we're just being smart and looking at timings early.<br />
<br />
As far as I can tell, the YMS takes about 25 working days max to process (judging on posts here and other sites). We're booked to depart Auckland on 17 March. Therefore we'll hopefully be putting our applications in to arrive with the High Commission on 8 February which gives them 27 working days.<br />
<br />
My question really concerns how long we have to enter the UK. At the moment we're looking at arriving in London about 26 June (just timing things with a trip through China and South East Asia). Basically, if our visa gets processed/approved on say 1 March, how long do we have from this date to enter the UK? I've basically read various opinions being (a) you have two years from date of issue until your visa expires, enter any time, get out 24 months from 1 March (<img src='http://www.ukresident.com/forums/public/style_emoticons/default/cool.gif' class='bbc_emoticon' alt='B)' /> they will date your visa as being valid from three months following intended date of arrival - so in this example 1 June - then you have two years to enter/live/work/etc and get out 24 months from 1 June &copy; they give you three months to enter and then you get two years, but you MUST enter within those three months or you will run into trouble.<br />
<br />
Can someone please clarify this for me? I've just spent hours trawling through various government on unofficial websites and I'm more confused then when I began researching!<br />

I'm guessing the WHM is becoming an increasingly rare topic now that the much better YMS has been introduced (sucks for me - missed out on the YMS by about 2 months). I plan on finishing up my full time position at the end of July, having started just past the start of July the previous year. I know that the WHM terms state that you are not allowed to work for longer than a maximum of 12 months, however, how is this period measured?<br />
<br />
 * Are holidays (paid) included?<br />
 * Weekends included?<br />
<br />
Does anyone have any Home Office official type links to this information? <br />
<br />
My feeling is that at first take the HO would include weekends in the 12 months, but you could probably get a lawyer to argue your case on the technicality of the 'definition' of 12 months (like the ruling in Australia about work being 'incidental' to your holiday... the HO rulings got overturned).<br />
<br />
Secondly, I may wish to return to London under a Tier 1 (or even a Tier 2) in the future. What is the chance of my 'overworking' (which itself is arguable) affecting future applications? I have heard mentions of bans of up to 10 years?!<br />

I am heading to the UK in December from Australia to work as a teacher - and will apply for the YMS visa. Is it ok to get a one way ticket rather than a return? Because you can only book 12 months ahead for a flight but I plan on staying for 2 years so I would have to forfeit the return ticket. I keep hearing differing views on this so could someone please advise if this is alright to do !?  <br />

I'm hoping someone can shed some light on my question/situation.<br />
I have recently immigrated to Canada from South Africa and am now a Permanent Resident of Canada.<br />
<br />
I want to come to UK via the Youth Mobility Scheme, as Canada is one of the few participating countries, but as far as I can tell, only Canadian Citizens/Nationals can apply for this(seeing as they have a Canadian passport).<br />
<br />
My question is: As a Permanent Resident of Canada, am I eligable for this program through SWAP (Youth Mobility Scheme)? She is over on Working Holiday visa arrived Oct 08(Valid till Sept 2010).  Met while he was in India during Dec 07.  He went to visit again in late Spring. They want to get married, but Im unsure if they can both stay on after COA approval, as Im trying to tell him that it cant be as easy as he/they seem to think..ie fill in a few forms<br />

As I read it it, they need to of lived together for 2 years, to show bills etc from over that period of time (as far as I know she only started working/reg with doctor in Feb/March).<br />

What forms should I suggest they look at, sites i looked at UK Border agency (FLR(M)???)<br />

She's currently back in Africa to finish her studies and will be back here in about 2 months time, by which her visa will be left with 4 months. She has a boyfriend who has british citizenship and i think they are planning on staying together for a long time. Can anyone offer any advice on how she can stay here legally  if she plans to marry him? And are there any other options she has if she decides not to marry him? My Girlfriend is from South Africa and is currently here on a 2 Year WHM visa due to expire in November. I'm a UK resident from birth. We live to together and obviously don't want to lose each other. I've looked into the pertnership visa but we won't have lived together for the 2 years and she's not qualified enough for a highly skilled migrant kinda visa... <br />

It increasingly looks as though our only option is to get married? If we do get married would we need to do it in this country or would it be ok to get married abroad (Probably SA!!!) But with the introduction of the YMS could she go back to SA and apply for that there and come back?<br />
<br />
I really appreciate any help or response. It seems immigration is a bit of a black art unless you work at Heathrow or for UK immigration. <br />

But because new system has no sponsored reseacher option, and because I am definitely <strong class='bbc'>not</strong> fill a gap or take a job offer here, so I should not apply for T2.  HR give me advice to apply for T5, but I got a reply from home office that T5 can not apply inside uk. <br />
As I checked on web, now sponsored reseacher should under T5.  So it's just I extension my T5 visa, not switch to T5, am I right?]]></description>

i am currently on the 12 month working /2 year total working holiday visa.<br />
<br />
I was recently harrassed by someone at Passport control for working as a Business Analyst in the UK when my past job was a Business Analyst in Australia. He told me that I was not allowed to work in the same profession/career and that I should be a waitress/bartender and that I should be working for a couple of months at a time, then holidaying then working as a waitress/bartender again. <br />
<br />
He then went on to accuse me of wanting to apply for sponsorship through my current employment when my contract is up after 12 months and said I shouldn't have come over on the working holiday visa and should have applied for a work permit. <br />
<br />
This was not even the case as my contract is only for 9 months and I am planning on going home in October to apply for tier 1 (total of 17 months in the UK, working 9 months) and instead of asking me what my plans were, just decided to put his own words into my mouth.<br />
<br />
I told him that i understood I COULD work in in my profession,being allowed to work a maximum of 12 months and being here for maximum of 24 months. He said since I had been working the last 8 out of the last 10 months my work is not "incidental to my holiday"<br />
<br />
He eventually stamped my passport after about 10-15 minutes ending with .. "well you SHOULDN'T be doing what you're doing now".<br />
<br />
Does anyone know if I will be flagged for this?<br />

		<description><![CDATA[My cousin is here in the UK from Japan on Volunteer's visa until end of June 2009. <br />

In January 2009 this visa changed to Charity worker's visa ( not 100% sure)<br />
<br />
With the volunteer's visa, she was allowed to go to an English School.<br />
<br />
My question is , Can she still attend the English school for 2weeks with the new change in visa categories? <br />
Her passport still has the initial volunteer visa stamp.<br />
<br />
she will not be overstaying as her return ticket is booked well before the visa expiry date.<br />
She doesn't want to apply for any change in visa like a student's visa or something. I doubt<br />
whether they will allow any in country application for such changes.<br />
<br />
Any advice is very much appreciated .<br />

My partner is currently a South African Citizen and has applied for New Zealand Citizenship. Once she has got it we are going to apply for a YMS visa, which will allow her to work in the UK. The problem is that we do not expect to get citizenship until August and we are meant to be flying out then for the UK. <br />
<br />
Does anyone know if it is possible for her to apply for a visitors visa to the UK on her South African passport and submit her NZ passport, once its been gained, for the YMS. Basically allowing her to enter the UK to visit, while the British High Commission process her YMS application. <br />
<br />
We don't want to break any laws or be dishonest in anyway and just want to know, so that if it is illegal we steer clear of this option.<br />

		<description><![CDATA[You probably don't care but I will feel better writing this since I have spent another couple of hours crying behind my desk at work. Brilliant.<br />

I just feel so hopeless. I am a UK citizen. I have an Australian boyfriend. He is currently in Australia. He does not have a skilled occupation. I want to be with him. Should be simple, right?<br />

Fair enough, he can come here on the YMS. Brilliant. Thankyou, UK Borders Agency, btw, for extending the time one is allowed to work on it to two years. Have you any idea how hard it was to budget to live with someone full time for two years and only have them work for one? I'm 25, I'm a professional, but I don't have an enormous amount of money to burn to caretake an adult for an entire year. <br />
<br />
I am grateful that we at least have this option. Believe me. I spent a lot of time at an IAC office sat in their reception surrounded by awful, depressing stories of people who don't even have these options, who are being sent back to their respective countries, ripping apart families with children and histories and relationships and god knows what else. I am so glad he is Australian and not, I don't know, American or Cuban or from whatever countries cannot take part in the YMS. So grateful.<br />
<br />
But what to do after those two years? Switch to an unmarried partner scheme? Right. Countless of threads have been made here about how hard this is. Nigh on impossible. We would have to have proof of living together for the full two years he would be in the UK on his YMS. To the DAY. I understand you can only apply out of country for this visa, too. So he would have to go home. Sucking from our already limited pot of money to apply for an extremely expensive visa that is notoriously difficult to get. He's not a brain surgeon or a fancy engineer. He is just a regular guy doing a normal job who wants to have a normal relationship.<br />
<br />
I want a normal relationship. I want to be able to enjoy small things that other couples who get to live together enjoy. I want to make him breakfast and go to the cinema and make plans for a FUTURE, a real future, and get a hug when I want it. We have no real chance for a future. And now it will probably end before we've even been given a chance. My heart is breaking.<br />

any advice you could give me would be great. <br />

5 years ago I visited the US and overstayed my visa by 3 weeks, actually it was my visa waiver... I didn't know that I had overstayed it as I thought we (my ex and I who was American) had extended it. They took down my details and passport number and said I would be fine for another 30 days to stay in the US so the first I heard of overstaying it was when I returned to the US 2 months later.<br />

On my return for a wedding I was denied entry and sent back home... I never made it through customs. The two reasons given were that I had overstayed my visa last time I was there, I believed I did not as I had extended it through immigration but they told me that I "should not have been allowed to do this" and that they thought that my ex partner and I were planning on marrying, we were not, it was for a friends wedding.<br />

I know it has been more than 5 years but now I wanted to apply for the working visa in the UK, youth mobility scheme and questions 6.3 and 6.7 have got me very worried. Have I ever been deinied a visa and have I ever been asked to leave a country. Neither has happened technically as I didn't apply for the visa and as I never made it through customs I never legally entered the US but<br />

Do you think that this previous problem with immigration will be held against me? I can prove that I can take care of myself financially for several months even if I don't find work and I have a spotless record otherwise...<br />

I am just so nervous as I have always wanted this experience!<br />

		<description><![CDATA[Hello, I have applied for a Tier 5 YMS visa and after 29 working days from submitting my application I recieved a call from a man in the Brisish High Commission clarifying my address as he was sending my documents to me but would not tell me if my visa had been approved. I checked my email for the confirmation / approval email and there was none. I called the BHC back to confirm that if my visa would be approved I should receive the email, and she said that if it hadn't it is likely to not have been approved. I can see no reason why I would not be elidgible for a tier 5 visa and I believe i had all of the right documentation etc. Does anyone have any up to date information on why my visa might have been denied?? Have they ceased allowing visa's due to the uk economy and/or lack of jobs for residents? Also if it is not approved what are my options then? Can I apply again while in the UK? or can I go to europe for a time and apply from there?<br />
Any information you can give me would be greatly appreciated as I am supposed to fly out in 10 days.<br />

The rule states 'The restriction of engaging in business does not rule out all self-employed activity, where it is temporary in nature, and does not involve recruiting staff, investment in premises, etc' I have scope of getting some moeny paid to me by doing pc-repairs and mobile repairs, on a small scale. Can I register this as a business, without commiting any offence with my visa restrictions?<br />

		<description><![CDATA[When you arrive in the UK as a working holiday maker how are customs? Do they properly interrogate you and ask for all sorts of information (why are you here, how much money do you have, where are you staying, who are your friends here etc)?<br />

 I've got a British passport through ancestory, so I'm fine, its my girlfriend I'm asking for. Dunno whether she should admit that she's travelling with a British passport holder or not seeing as customs may see it as "False Intentions". What do you reckon?<br />

She has a return ticket, about 4000 pounds in her account, plus she'll have 200 pounds with her in cash in her hand luggage.<br />
 <br />
 My only real worry is that we are planning travelling straight up north to stay with family of mine. If immigration grill her about who these people are and why she is heading straight out of London (which is probably unusual for an Aussie) they might get arsey. Perhaps she should book accomadation in London for a couple of nights and use that as her intended address? Argh, I'm worrying about this too much. I'm sure a wink and a smile would smooth things out though.]]></description>

  First of all, we would like to say this is a great forum for folks looking for much needed information about the complicated  process of immigration and thanks to those responsible for creating and maintaining  this site.  My wife and I have just moved to the UK  (December 2008), from Canada, on my wife's Ancestry visa.  We have a 21 year old  daughter who has been here in the UK  since December 2007 on a WHM visa.  We are currently looking at any and  all options to have her remain here in the UK  with us even though we recognize the challenge with that goal based on recent  changes to the WHM scheme. Right now we are entertaining three options and  would greatly appreciate feedback from the experts here as to the realistic  chances on each and helping us with any other possible avenues:<br />
  <br />
   1) She is currently living with her UK resident boyfriend and although they have been  together for two years they have only been living together for about 14  months.  Can a case be made for UP visa at all (knowing this visa clearly states they must have lived together 2 years)?<br />
  <br />
  2)  She has a good job she has been at for a while but we cannot see  anywhere on the "occupation shortage list" where this occupation  might fit.   However here employer is probably willing to do whatever it  takes to sponsor her if he can.  Her work potion of the WHM runs out very soon however.  Any chance here at all?<br />
  <br />
  3)  As noted, we, her parents, are here and plan on staying here and achieving  permanent residency after the five year Ancestry visa expires. We see that  under "exceptional/unique circumstances" that she may be able to apply under a family settlement visa with us as her sponsors. However we are  unclear if we have to be "settled" here (no time limit on stay?) and  how difficult this visa might be to argue seeing as she is 21 years old.   We would argue on the basis on her having being estranged from all other family  in her home country (which is true) and sponsor her fully in whatever way is necessary.<br />
  <br />

I am an Australian citizen and I am deciding whether to apply for a Youth Mobility Scheme Visa or a Highly Skilled Migrant Program visa as I may want to work in the UK for more than 2 years.<br />

If I decide to apply for the YM visa, can I subsequently apply for the HSMP visa after it has expired, if i wish to extend my stay in the UK?  Do i need to 'leave to enter' to do this?<br />
<br />
What other options would I have if i took the YM visa and wanted to continue working in the UK when it expires?<br />

This is my first post on this forum, which I found whilst searching for WHM appeal information. I have a few questions. My cousin in India applied for a WHM (before it was closed) in Sept, he received his refusal and then lodged his appeal in October. I'd just like to ask, regarding the appeal, are they first lodged with the Entry Clearance office (ECO) which in this case is the Delhi Embassy? From what I've come to understand, after many hours trawling the internet, the ECO review their decision and if they decide to change their mind they issue the visa. But if they decide their original decision was correct, the case is forwarded to the AIT (Asylum & Immigration Tribunal) in the UK, where it is given a full court hearing.<br />
<br />
Could someone just explain this process to me, is my understanding of the procedure correct? So far, it's been 4 months since the appeal was lodged and currently the cases in India are severely delayed due to the high number of applications being received. I understand it will take a little longer than expected, but will the case be dealt with completely in India first?<br />

As with a lot of other Aussies, I want to stay longer than the 2 years because I haven’t finished my travels and 1 years wages doesn’t get you far. <br />

Anyway, I looked in to sponsorship, which my work was willing too, but I didn’t earn enough to make enough points. Where as if I were in London I would have earned enough. They don’t take in to consideration the different rates of pay in different cities.<br />

My partner and I have spoken about marriage and Im not sure he is willing to commit to that, but he may.<br />

My question is, if I overwork and try and re enter on a spouse visa, will they reject my application? Seeing as though they have changed the rules for the new visa so you can work the whole 2 years, are they really going to look that closely at applications who have overworked? Even if its only by about 2 months? <br />

She has told me that she has asked the Home Office if she can renew or extend the visa as she dont really want to go home as she was told they dont do the working hoilday visa for there no more (she is from south africa) She has submitted all her papers and passport to the Home office in december 2008, How long will it take to sort out things for her and will they extend the visa ?<br />

Its just she has not had nothing from them and the way she is thinking is April is only round the corner and she dont want to be here without a visa and become a overstayer <br />

Hope someone can give me some advice or point me a direction to get some on this subject. I'm on a Working Holidaymaker Permit which allows me 12 months of work out of the 24. I've been working since April last year and am still employed, but I was only working part-time in a bar up to September. Does it matter that I only worked part-time, or will my 12 months be finished by March this year? I'm not sure how they government calculates it, eg. 12 months work allowance on a 40-hour week, or simply 12 months from the day you started working in any form. If I only worked for 3 out of the the 5 days of a work week, I guess it could mean that I can work a bit longer, but I'm not sure.<br />

I have 3 questions regarding applying for the Visa,<br />

1) I have had 2 court appearances and charges that are quite old, one is for a traffic misdemeanour and another was for assault... 10yrs ago (stupid offence).  I'm fine with advising this, but will this affect my Visa application in any way?  Was anybody in a similar circumstance and did they still get approved for the Visa?<br />

2) I'm just wondering when the actual time for the Visa starts? Does it start from when they issue it to you, or does it start from when you enter the UK?<br />

3) I'm turning 30 in November, but I'm not sure whether I have to have my Visa approved before I'm 30 or whether I have to actually enter the UK before I'm 30.  What's the go with this?  Anybody know the answer?<br />

I'm a New Zealand cititzen living in Australia. I recently applyed for the Youth Mobility Visa to the Uk, but was denided, as I didn't send in enough proof of funds (I sent in a print out of an electronic statement). I had already booked my flight over to the uk, and other flights to egypt etc so I don't have enough time to reapply. <br />

I was wanting to know if I could still travel over to the UK for a week on a tourist visa. I have a flight out of England booked to Egypt and a tour booked there so there is proof that I'm going to leave England when I say I am. I'm also traveling with my boyfriend as well, he is also going on a tourist visa (he never applyed for the youth mobility visa).<br />

I've been checking everywhere on the internet but can not find out any revelant information for my situation. On the uk visa web site to get a tourist visa, you need to be of a certian nationality that qualifys (New Zealand does), able to support yourself while you are in the uk (im only there for a week, so thats no problem, I was going to take some bank statements as well to prove I had the money) and leave before the six months is up (I have an outgoing flight booked).<br />

Has anyone been in this situation where they were denided a uk holiday visa, but when over as a tourist soon afterwards? Did they have any trouble getting into the country?<br />
<br />
I was going to try and ring the english embasy but they are closed for the next three days.<br />
<br />

It seems that I might not be able to make the final submission, in Canberra, of my supporting documents (if I submit them WHILE making my application AND biometrics all at once) by February 2nd. That is 28 days. 28 days is a month, in some regards. <br />

This is getting frustrating grrr lol so is that a month, is it too late, will they put it on their desk for four days and then go hmmm this is overdue big red cross on my passport or not? Should I wait until (HOPEFULLY) the 12th of February until my next statement comes out? (which will be for February the 5th, and this is at best, leaving me three weeks before its overdue).<br />

I ve been working full time more than 12 months now. I dont really care about applying for UK visa again for a long time. I just want to exhaust this two years working and then leave the country. I broke the rules...couldn't help it. <br />

		<description><![CDATA[When applying for a YMS visa, and assuming that I am obliged to declare I have a British girlfriend, what is the strength of my case?<br />

The secondary issue is that it seems with the new YMS visa that they do not want you to send any supporting documents other than what you need to show you meet the points requirements. I don't mean that this is all they ask of you; more that they actually discourage the idea of sending in any other form of supporting documents for any other reason. They also seem to want to approve and/or process the applications as quickly as possible, and don't critique it very much at all. However, they ALSO seem to want to avoid conducting interviews. Quick to dish out either approvals or rejections.<br />
<br />
so, am I more likely to get a quickly dished out approval or a quickly dished out rejection?<br />
<br />
Of all the cases I have read online of people applying for the YMS:<br />
<br />
1 ) ALL have been approved; I have not read of even one rejection.<br />
2 ) Some people have been considering applying for the YMS while they have a British girlfriend/boyfriend, but none that I know of that have actually gone through with it, so I have no idea what the ECO's response will be.<br />
3 ) They have all been approved fairly quickly, within the space of one month, and EVERYONE who I know of who has applied has pretty much just given the absolute required supporting documents. I have seen about 10 cases of approvals.<br />

Any answers will be most appreciated. I am also willing to pay for proffessional advice, if necessary.]]></description>

		<description><![CDATA[Hi there, my whv expires on the 25th jan 09.  But i booked my return ticket home for the 25th of feb 09. I have a british boyfriend. I am hoping to be able to leave the uk and go to ireland before my visa expires and return after on a visitor status, he will sponser me.  I have no intentions to work in the uk on the visitor status ( i have document for my end of contract for the job i have finished ) and he will include a letter from his employer, and a sponsership letter for me. He will also be with me coming back from ireland.<br />

		<description><![CDATA[I hope someone can help me. My boyfriend is Japanese and is applying for the Youth Mobility Scheme.  It says on the UK Border Agency website that any documents not in English must be translated by a certified translator. His bank book and bank statements are in Japanese.  What do they mean by a certified translator?? We have contacted some professional translating services in Japan and they don't have a certificate or anything that we can copy, just the company paper with their stamp and signature. Do you think this will be enough? Originally VFS (the organisation processing the applications) said that he could translate bank details himself, but today they said the rules have changed. We don't want to risk not doing it properly. Thank you in advance for any help and advice I might get!]]></description>

		<description><![CDATA[Just a quick question, on the VAF9 form (I am assuming this is the correct form for the YMS visa) it states that you must show how many points you scored on sections for Attributes, English and Maintenance. However, in the Appendix section (Appendix 7, YMS) it has sections for Nationality, Age and Maintenance. So, which is which?<br />

I'm a New Zealander on a WHM visa - I arrived here in Nov 07 and work wise I have been temping as well as undetaking a 7 month fixed term contract which just came to an end on 28th Nov 08. I am finding it really hard to get any temp work as the agencies are questioning my 12 month work limit. <br />
<br />
I guess I have two questions:<br />
<br />
 1) I know I can only work for 12 months but how is this defined? 12 actual months or 52 weeks or 365 days? When I was temping I was registered with the agencies from Dec 07 to April 08 but didn't work all of that period (only 72 days in total.)<br />
<br />
 2) How do I prove this to the agencies? One agency told me that they needed a letter from the home office - who I call and they said they (0f course) can't do this and I should provide them with evidence such as writtern references, employment contracts, payslips etc.)<br />

Any help would be greatly appreciated!! As I really want to get some work before I go travelling for a month in Europe. :-)]]></description>

I have recently been looking into the new visa rules and am looking to apply very soon for my visa as I actually have flights already booked (which is now starting to look like that was a bad idea) for Early - Mid February from Australia. I guess my first question is should this be enough time if I get the application in ASAP (50 - 60 days)?<br />

Also I have been getting a lot of mixed information about the funs proof. The guide says you have to have a letter from your bank stating the amount of funds you have access to and also lists of 3 other possible documents one of them being a bank statement dated no longer then 1 month ago which has to also be accompanied by an official letter from your bank anyway and stamped by a staff member there. I have read in some earlier documents and also my travel agent thought it was the case that the last 3 months worth of transactions had to be shown and your balance have to have not fallen below 1600 pounds throughout this period. I find that a little strange when some people (like myself) will be assisted by parents and also saving a lot of there money in the 2 - 3 months leading up to heading off. Is it purely as the form states 1600 pounds (3600 - 3700 AUD) at the time of application or should I be concerned about this. Is it wise to state on a cover letter the reason for any large deposits on a bank statement also as I have heard you need to explain these?<br />
<br />
Also there is nothing which asks you to state your travel plans, does this mean to say that there is no longer a restriction on your travel/working plans like there used to be. I know the WHM visa was issued stating that participants of the program would only work in coincidence to there travel plans and for only 1 year.<br />

Hopefully I can get some better advice then what the websites have given!<br />

I'm from Canada and made an application under the YMS on Nov. 28/08. The process went smoothly and I was certain there would be no issues. Today, I got an email stating that they have deemed my application to be "non straightforward" and require a further 15 days to decide whether to approve it. I am in shock and confused as to why this happened, and am unsure of whether this is common or not.<br />
<br />
The only thing I can think of is that my bank statements are still in my previous home address (I moved out of my parent's place about 5 months ago) while my visa application has my new postal address - which could have perhaps flagged my application. To rectify this, I can get a letter from the bank saying that I am one in the same person. But if this is the case, do they even give you a chance to provide additional documents, or is it likely that I will be just plain refused and have to repay to do this all over again? <br />
<br />
Sorry for the rant... but I'm kind of freaking out over this! I've never heard of this happening to what would otherwise be a "straightforward" Canadian YMS/WHM visa application.<br />
