		<description><![CDATA[Hi everyone...I applied for tier 1 general (switching category from tier 1 PSW) last month...It was a premium (same day) application but they kept my documents and issued me with a letter that they needed to make some further enquiries...now today i got my application result and unfortunately they refused my application...<br />
<br />
They awarded me all the point I claimed<br />
<br />
Qualification---35 points awarded for my masters which i did in india<br />
<br />
Earnings---35 points awarded<br />
<br />
UK experience---5 points awarded<br />
<br />
Age---10 points awarded<br />
<br />
English language---10 points awarded<br />
<br />
Maintenance---10 points awarded<br />
<br />
105 points in Total<br />
<br />
Now the reason that they gave me was----FAILURE TO DISCLOSE MATERIAL FACT<br />

"IN YOUR APPLICATION YOU FAILED TO DISCLOSE THE FOLLOWING FACTS. YOU PREVIOUSLY SUBMITTED A POST GRADUATE DIPLOMA FROM WESTMINSTER COLLEGE OF COMPUTING TO OBTAIN LEAVE UNDER INTERNATIONAL GRADUATE SCHEME AND THEN ONTO TIER 1 POST STUDY WORK VIA THE TRANSITIONAL.<br />
I AM SATISFIED THAT THESE FACTS WERE MATERIAL TO THE APPLICATION BECAUSE IN VIEW OF THE FACT THAT YOU WERE AWARDED A POST GRADUATE DIPLOMA IN BUSINESS ADMINISTRATION BY WESTMINSTER COLLEGE OF COMPUTING THE SECRETARY OF STATE IS NOT SATISFIED THAT YOU HAVE OBTAINED A DEGREE QUALIFICATION ON A RECOGNISED DEGREE COURSE AT A UK PUBLICLY FUNDED OR HIGHER EDUCATION INSTITUTION OR A BONA FIDE UK PRIVATE EDUCATION INSTITUTION WHICH MAINTAINS SATISFACTORY RECORDS OF ENROLMENT AND ATTENDANCE..<br />
FOR THE ABOVE REASONS, I AM ALSO SATISFIED THAT YOU HAVE USED DECEPTION IN THIS APPLICATION."<br />
<br />
No right to appeal as I still have around 1 month visa validity (PSW visa validity)<br />
<br />
The college was bona fide when I was studying there and I genuinely completed my PG Diploma in that college later on I heard the news that the same college was closed on the basis of scam of fake certificate issuances for money.<br />
<br />
Please guide me what shall I do now as it is really annoying and hurting as I did study genuinely. I got IGS visa for 1 year and later on IGS TO TIER 1 PSW extension for another year so how can they tell me now that they are not satisfied?<br />

i am on psw.i have enough points to quilify for tier 1 on the basis of bachelor degree before 31.03.2009.when i changed my status from student to psw after completing my degree from greenwich university,i calculated my points on hsmp calculator in september 2008.i am under 27 yrs 4 months now..i thought i will be ok and easily qualify for tier 1 general.but after home office changed rule in march 2009.now if i do master,i can not earn enough money to claim earning points.and i may be lose points for age during this time.<br />

i checked tier 2 points calculator.there is option switiching from psw still available.i am requesting to hsmp forum ltd.<br />
would u pls ask to home office to include psw option in tier 1 points calculator.i mean whoever is on psw visa can claim 30 points automatically.all members and moderators of hsmp forum ltd. and ukresident.com are doing excellent job to help the skilled migrant workers.<br />

i request to all and uk border agency,pls thing about the future of the people who has already changed their status from student to psw after the introduction of scheme.all the psw holders who got their visas from uk border agency on the basis of bachelor or pgd are really in mess and very disappointed.they do not know what they should do.<br />

this rule is ok for newcomers .they can plan everything.but think about people who are on psw on the basis of bachelor or pgd.can hsmp forum ltd. or ukresident.com members (skillclear,visa direct john victoria susi)help them to get out of this difficult situatuion?<br />
<br />
it is not hard for uk border agency to include option of switiching from psw to tier 1 general in terms of claiming points like it is in tier 2.<br />
<br />
i hope everybody will give atention on this issue and will do some positive work.<br />

		<title>Tier 1 Extension - How Long, And Timing Of Future Ilr</title>

I've scoured the forums, but can't find answers to questions.<br />
<br />
1. My HSMP visa is due to expire on 25 May 2010. When should I apply for the Tier 1 extension? <br />
<br />
- How long does the decision take (approximately)? Note: My case is very standard - one employer since I came to the UK 18 months ago. I have standard payslips, etc. I even opened a Halifax bank account which sends statements covering 3 month periods. My application should be pretty straight forward<br />
<br />
- Will my extension be timed from the day my application is received, or from the day they make the decision?<br />
<br />
2. I know ILR is calculated as a continuous 5 year period, but how precise are they on this? It seems to me that it is tricky to go the 'usual' Tier 1 / HSMP route to ILR as the Tier 1 / HSMP visa periods are exactly 2 + 3 = 5 years. Given that you probably won't come to the UK on the exact day of the approval of your entry clearance, or that you will not be granted your extension on exactly the last day of your initial visa expiry period, surely this makes it near to impossible to time exactly 5 years in the UK under the Tier 1 / HSMP program?<br />
<br />
3. What happens after your 5 year tier 1 visa has expired, if you haven't been in the UK for exactly 5 years? Can you extend the Tier 1 visa again?<br />
<br />
To set the context for the above three questions, I am moving to a really good job on the 1st May. However, I would rather start the new position with my visa extended; I don't want to walk in with only 25 days left on my Visa (expires 25 May 2010), or with no passport at all because I have submitted it to the Home Office! Furthermore, if there are any issues with my application and I have to appeal I want to sort them out before I start the new job. But on the other hand I don't want to harm my chances for ILR. Although from what I can tell, it's almost impossible to get ILR on the Tier 1 / HSMP route anyway. Eg my initial HSMP visa was approved on 25 May 2008, but I only came to the UK on 12 June 2008. Does this mean I've already blown my chances at ILR no matter when I extend?<br />

Help! Extension forms are bundled up and ready to go, but not sure on the timing.]]></description>

I have a Tier 1 visa which was issued in March 2009 and will expire in March 2012. Since visa issue my plans and circumstances have changed dramatically and I have not yet come to the UK to look for work etc. <br />
I have been accepted onto an excellent MSc degree which begins in Oct 2010. The course will finish in Sept 2011. I intend to pursue this course.<br />
I know that I can study on the Tier 1 but if I decide to pursue some work in the UK after the MSc then I will have issues when it comes to extending the Tier 1 because I may not have enough time to reach the requires level of earnings.<br />

QUESTION<br />
Can I apply for a student visa (given that I have a Tier 1)?<br />

The story is My tier1 got refused.<br />
actually what happend that when i was on fresh talent visa i started my own business and got the job with one of the IT copmay as Business Acccount Manager and after 8 months my compnay has decided to promote me as a Buisness development manager and the are agreed to apply a wp as well for me so they had to apply a wp as a Business development manager.Wp been issued and i got redudant as account manager so technicaaly i didnt take new position within the company bust Ho refused without look into th situation properly so i decided to challenge that case in the High court as i didnt have right of appeal when my barristers asked hingh court weather if this case is arguable or not judge decided that yes thsi case is arguable in the court and then high court sent the litigation to the Ho and asked them to represnt in the court and now just two days ago Ho asked my barrister to withdraw the case as they are agreed to look into the matter again.So finger crossed<br />

Could you please take a look at my history and help to find out what my chances are?!<br />
<br />
I'm currently under HSMP Tier 1 (General) visa. The visa was granted on 23 April 2008 for 2 years.<br />
As my visa expires on 24th April 2010, I have started to prepare all the paperwork the extension application for 3 more years.<br />
<br />
I meet successfully all the requirements, <span class='bbc_underline'>however </span>my bank account went below £800 for a short period of time in Jan 2010.<br />
So if I use the bank statements from Jan-Fev-Mar 2010 for the 3 months period maintenance funds requirement, it will show that I had some days where the balance was under £800.<br />
<br />
The balance of this account was over £1000 for the whole 2009 year - and I have bank statements to prove it.<br />
It went below £800 just on mid Jan 2010 and and now it's back over £1000.<br />
<br />
So the problem is this short period of time in Jan 2010.<br />

What my chances are in this case?!?</strong><br />

Here it is some of my background:<br />
<br />
- I've being living in UK for 4 years [2006-2010] (2 years Work Permit Visa + 2 years HSMP)<br />
- I've being working for the same company for all 4 years period<br />
- I've being paying my taxes regurlarly for all 4 years period<br />
- I have built my career and life here over these 4 years, I still have the same job and have established myself here.<br />
- I never needed to make use of UK public funds whilst in the United Kingdom <br />
- I had the balance over £800 for over a year - it went below £800 just for one month.<br />
<br />
The clock is ticking and I really don't know what to do.<br />
It doesn't make any sense to leave my carreer, my job and life ukbehind , especially if I have being following all the rules here.<br />
<br />
Any help/advice would be much appreciated!!!<br />

I am just getting ready to send my application for Tier 1, switching from a work permit (that is valid until Sept 11). I would really appreciate if someone could help me with the queries I have below. <br />
<br />
1. I have a Masters in Engineering (Electronics Engineering) from the University of Sheffield. The points based calculator only allows me to select 'Masters Degree' and 'Engineering' . Do I need to get a NARIC letter to be sure that my qualification is valid?<br />
<br />
2. I have printed out 12 months of eonline payslips, which&nbsp;automatically prints&nbsp;the company's logo (therefore didn't use letterhead)&nbsp;and someone in HR had stamped it. However, the stamp does not have the company's logo, and only states 'This is a certified true copy' and is signed. However, she didn't even have a business card I could attach.<br />
<br />
3. The bank had stamped my online statement printouts with a stamp that only shows the branch name and sort code (no signature confirming authenticity&nbsp;or logo). Also, it has been printed on non-letterhead, but with the bank logo at the printed at the top of the page. <br />
<br />
I am slightly concerned that my payslips and statements don't look like it has been actually stamped and signed by HR and the bank (the stamps look like something I could have bought off a stationery store and signed myself). HR had provided a letter confirming I have been in employment from 2006 and my current salary (this is slightly higher than the amount I am claiming for as I got a slight raise this year) - but from the guidance, it looks like it's no good if it doesnt match the amount I'm claiming and is not broken down into gross and net. Is this right? <br />
<br />
4. If I am claiming points for English Language, then would my degree certificate be sufficient evidence (assuming that its valid and I dont need a NARIC letter)? <br />

I have done Masters and got my psw visa on that basis in 2009.I am applying for tier1 general now but I just read on few websites if my qualification is not on the self assessment calculator I need to get UK naric certificate or for professional qualifications a letter from university. My degree title is MA in banking, finance and management (Area: Finance). My understanding is that it has been varified by Home office when I they gave me PSW in 2009. Also it is from Birmingham University so I don't see any problem. What is the best thing to do now. Do I need to get a letter from University confirming all my details or a UK Narik Certificate? UK Narik certificate does not make sense to me as it is already a UK qualification awarded by a UK University. Any advice will be appreciated!]]></description>

I bank with HSBC and when i deposit the cheque's it shows up as " CR ---Paidinat400621---£xxxxxx ( 400621 is the branch sort code where i deposited the cheque)<br />
the figure matches with my payslip exactly but this paidin credit? will that be ok?<br />

It recommends that UKBA consults UK NARIC and stakeholders to add to the list of recognised courses. At present these individuals are unable to apply under Tier 1 (General) as they do not hold a professional qualification which is recognised as equal to a Master's degree which is a bone of contention for many disgruntled US lawyers in particular! </span></li><li><span style='font-size: 9px;'>Bachelor's degrees are to be recognised as academic qualifications as currently an individual must be educated to at least Master's degree level </span></li><li><span style='font-size: 9px;'>Points awarded for age up to 39 (currently an individual will only score points up to age 31) </span></li><li><span style='font-size: 9px;'>Points for earnings are recalculated (please see table below). There should be a new route of entry for high earners with no formal academic qualifications. As such 75 points will be awarded for those earning over &#163;150,000. The minimum earnings threshold should be are raised to &#163;25,000 from &#163;20,000 </span></li><li><span style='font-size: 9px;'>UKBA considers whether an employer can guarantee an individual's maintenance. i hv sent my application for tier 1 g last tues day via recorded delivery and it has reached HO by wednesday (accroding to royal mail track)..but i see that fee hass not been deduccted yet.....<br />

any particular reason? has this happened to anyone else? frm my past exp.. HO normally takes the money the very next day and I find it bizzaere they hv not taken it yet even after 3 days.....(Im pretty sure my card details were right...i checked it 10 times !!!!!).<br />

and also now I am begining to worry abt the proof of eng. language req.I ddint sent a letter frm the uni saying it was "TAUGHT IN ENGLISH" and simply sent my original UK TAUGHT degree certificate thinikin that wud be sufficient.....<br />

is there any way to sent this doc..given my application has not been even processed for payment?<br />

I read the following response from the Home Office in another thread: <br />

"<strong class='bbc'>For further clarification, if you applied on the 29 January 2009 then the largest gap we could allow before the assessment period would be one month and thus we could go back to 29 December for the start of the 3 month assessment period.</strong> " <br />

<span style='font-size: 13px;'>Is that right?!? Does it means go back to 29 December 2009 and count from that date backwards (ie 29 Dec/29 Nov/29Oct)?!?</span><br />

I'm having a problem with the maintenance funds requirement for my HSMP extension application.<br />
<br />
My visa expires on 24th April 2010. And I WAS thinking to apply for the extension closer to this date.<br />
<br />
HOWEVER my account balance went <strong class='bbc'>down £ 800</strong> from <strong class='bbc'>21 Jan 2010 to 19 Feb 2010 (28 days)</strong>.<br />
<br />
SO I couldn't use anymore these bank statements (Jan/Fev 2010) for the maintenance funds if I would make the application on April 2010.<br />
<br />
Trying to find another solution, I've started to search the internet and I just found out , minutes ago, about the about the "<span style='color: #000080'><em class='bbc'><strong class='bbc'>The letter must be dated no more than one calendar month before the date of application</strong></em></span>" rule!!<br />
<br />
Before I thought that the statements should cover the period <strong class='bbc'>exactly prior</strong> the date of the application <strong class='bbc'>only</strong>. I didn't know it could be one calendar month!!!<br />
<br />
THEN I realized that I can still apply and send the statements from Nov 2009/Dec 2009/Jan 2010, where my account has been over £1000 pounds at all times.<br />
<br />
My question is : Today, Sunday, 21 Feb 2010 is exactly one calendar month!<br />

<span class='bbc_underline'>If I apply this tomorrow Monday 22 Feb 2010 (Special Delivery Royal Post) I will be only 1 day over the one month calendar rule.</span><br />

is that ok or not. if not what can i do. pls suggest me.<br />

I worked in my second job only for 4 months and i left it. all i have is the payslips and contract letter. do i need anything else from them like p60 etc ... pls let me know.<br />

had an email 11 days after the 400 GBP debited from credit card a/c, stating that my application had been processed and requesting that I arrange my courier collection<br />
rang and spoke with case worker re collection<br />
asked very nicely if they could give an indication re. the outcome<br />
reponse "Oh, yes, it's been approved"<br />

 1) I have payslips and bank statement confirming the earnings but the bank statement issued by HSBC shows my cheque deposit as " paid into 400621" and as credit- is that ok? As it doesn't say cheque deposit or anything which shows its my earnings?<br />

 2) Do I need a letter from my employer B, confirming my work was additional to the work I was issued a WP for and it was part time?<br />
<br />
 3) Do I need a confirmation from employer B that he is paying my taxes as per the deductions on my payslip? I queried this to him and his reply was, he pays taxes at the end of financial year around april/may every year and he will do the same for me <br />

I am finishing my MBA in March 2010, but the Official Transcripts would be available in July only as the university's official board meeting takes place in july only. The Home Office site (http://www.ukba.homeoffice.gov.uk/workingintheuk/tier1/general/supportingevidence/qualifications/) says that if I am awaiting for graduation, then I have to provide the "original academic reference and original transcript". <br />
<br />
My university hoverer says that in March they can provide me with a letter saying "Student X completed MBA course, and list of his marks and blah blah" on a headed paper with signature etc, BUT - the kind of Official Certificate and Transcripts would be only in July. <br />
<br />
Question 1: What does "Original academic reference and original transcript" as at HO's site means? <br />
Question 2: I plan to apply in March-April for Tier 1 (dont want to wait untill August) and can I use the letter and transcript from university saying that official would be in July when University Board Meeting will approve them. <br />
Question 3: can you guys please recommend some good london immigration consultants who have HO registration.<br />

		<description><![CDATA[We came to the UK nearly 2 years ago on a HSMP visa (Wife on a HSMP visa and husband as a spouse related to that visa). In another month we will have to re-apply to continue our stay in the UK. I have a few questions that I couldn't quite sort out.<br />

1. For the wife's application do we select the "Initial grant of Leave to Remain (switching)" in the Tier 1 (General) application form? Will this give a 3 year extension?<br />
<br />
2. Does the wife need to provide any of the previous documentation (degree, etc) that was previously used to get the HSMP visa. None of this information has changed since the original HSMP application. <br />
<br />
3. How does the husband apply? We are planning on sending both applications in simultaneously 30 days before visa expiration. But does the husband need to apply as a dependent (on the previous HSMP it was as a spouse). If so does he need to provide proof of funds or can he use the wife's account balance to demonstrate sufficient funds.]]></description>

The mail went for delivery on saturday but could not be deliverd because it s a post box and saturday and need some one to sign. so it came back to durham delivery office for pick up by UKBA. When i called royal mail ,they said that the mail will wait there for 7 days and will come back if no one picked. 2 days (Mon,Tue) passed but still H.O did not collect the mail.. <br />

if i go for studies my wages wil be valid for only 3 months (12 months not working and studying only). In that case i wont be able to get an extension. <br />

Is there a possibility that i can apply for extension in 2011 before  taking admission and get an extension.... if yes how many years extension will i get?<br />

My husband's HSMP Tier 1 visa was due to expire on the 23rd of November 2009 and he submitted his application at the end of October 2009.<br />
<br />
He submitted all required information including bank statements from July to 5th October 2009. For this period the balance on the statement was never below £800.<br />
In December, we had a request from the HO to send in additional one month bank statement from 6th October to 4th November - and we sent one in up to Mid December which had a balance of more than £800. However during October and mid Nov, we had drawn down funds for other expenses.<br />
<br />
The HO rejected the application due to insufficient funds however the representing solicitor has asked them to reconsider the case as his explanation was they should have considered the previous months statements as they were still within a month of submission rather than take the bit in the middle that didnt have the required balance.<br />
<br />
In addition to the reconsideration letter, we've submitted an appeal to go to tribunal based on the same argument.<br />
<br />
Have we done the right thing or is the HO right in its decision?<br />
<br />
ITs a nightmare having to go tribunal cos of costs etc...]]></description>

December 2007 to 18 January 2008 : CURTAILED WORK PERMIT FLR<br />
<br />
18 January to 25 February 2008 : NO RESIDENCY STATUS (but had applied for FLR therefore passport was with HO)<br />
<br />
25 February to 15 March 2008: Packed up and left UK to facilitate out-country work permit.<br />
<br />
1 JULY 2008: New Visa based on new work permit<br />
<br />
1 JULY to date: continuous residency based on work permit and from 25 JULY 2009 tier 1<br />
<br />
I have a continuous gap of<span class='bbc_underline'> 5 month</span> due to failure of company to advertise the job and this is strengthened by a letter by new work permit (that also state harshness of HO while dealing with my application) arranger.<br />
<br />
I would like to give ILR application a go but would like to ask how realistic it would be to assume it is an intelligent go.<br />

2.My wife and minor kids joined me in UK during Nov 2006 so they would have completed 3 years 7 months  by the time when I am going to apply for ILR during may 2010.So can they apply along with me or they need to wait till they complete 3 years 9 months and apply separately?<br />

3.Since the judment for HSMP candidates says OLD RULES should be applicable(i.e the rules when we entered in to the country), am I eligible for Citizenship immediately after 1 year of ILR?i.e 4+1 years???<br />

I know that a few similar questions have been asked a few times on this forum , however due to a few conflicting answers, I am asking this question again.<br />

I have received my Tier 1 (G) visa with a date of 1st Feb 2010 , my question was that if I enter the UK on say 10th March 2010 , I will fall short by 10 days when I apply for ILR , after 4 years and 11 months, and then I would have to apply for a Tier 1 (G) extension for the second time.<br />
<br />
Hence I believe I would have to enter the UK before 28th Feb 2010 , so that I can complete my 4 years and 11 months, by only applying for 1 single extension.<br />
Please let me know if my thinking in correct , or if I have misunderstood the rules completely.<br />
<br />

I also know that rules might change multiple times before I reach the 4 year 11 month stage, however assuming things do not change drastically do you think that my line of thinking is correct ?<br />
<br />
Please let me know in case my question is unclear.<br />

I had my application declined because of the fact that I submitted the internet banking statements without a bank seal or supporting evidence.<br />

Anyways, after these many days the decision has come out in my favour. And I've sent my passport for a stamping.<br />
<br />
As of now I am eligible to go for a Tier I under the point based system. My only question is: Do they consider my earnings during this period.<br />
<br />
Precisely it is from Mar'09 till the end of Feb'10. I've checked with my solicitor and confirmed that I am allowed to show these earnings to<br />
<br />
gain points. I am just looking for a double confirmation so that I can go ahead and do it.<br />
<br />
And I don't want to waste my time and I would like to file my application before these new rules come out.<br />

		<description><![CDATA[I made an application for an extention of my leave from HSMP to Tier 1 General. The HSMP leave expired on 18th January whereas I had already applied an 07 January, received on 09 January and HO acknowledged my application on 11 January that it will be passed to caseworker.<br />

My employer asked for evidence of application so that they can be sure I can keep on working based on an outstanding application on 22 Jan. I gave them HO letter and they processed the Employment check based on an existing application by fax, yesterday the HO fax back they cannot confirm my eligibility to work, my employer was quite sure it was an error as they knew I applied on time so statutorily I am allowed to work, but couldnt do anything as UKBA has spoken, so they suspended me from work from until an envidence of right to keep working is on my file. <br />
<br />
I called the HO but the duty officer said no application is currently registered on my name. I paid with Banker's Draft so I am pretty sure I dont have payment problem and no letter is written to me to that respect. Its been about 18 days since I applied.<br />

I am a tier 1 holder. can i study full time MBA programme in UK. I called HO and these people were saying only part time is allowed not full time. But Tier 1 doesn't say anything about study restriction.<br />

Any help will be much appreciated.<br />

Not much worried about ILR but will Tier 1 be easily extended if i get a job after MBA and can show earnings.<br />

		<description><![CDATA[I read the back page of my work permit letter granted to me in Oct 2006. One of the points mentioned there confuses me. It is clearly written that after 5 years of continous employement the wp holder can apply for removal of restriction by applying for SET(O). <br />

I remained on this work permit till March 2009 when switched to Tier 1 General. Now My confusion is If the court and now the government is saying that HSMP holders have the legitimate expectation of getting an ILR after 4 in previous judgement of court or 5 years (govt stand in case of transitional arrangement) based on the approval letter they have got, then why not the workpermit holders?]]></description>

 is that ok? i hv refered guidelines several times like a holy book but<br />
would be very grateful if someone can check and point out any mistakes<br />

i just hv a solid case if not many complications (worked for one employer,uni degree and hv all docs + money)<br />
and wanna get it right first time as I cant afford a second chance and time delay....<br />

        my husband is on an hsmp visa,whose approval was given in august 2007.i want to apply as his dependant.i had been to the vfs yesterday and was told that my application would be decided by the old rules.i was advised to show the maintenance funds(which i think applies only to the tier-1 lot).my husband has been maintaining his bank account since 3 months which sums up to almost 4000 pound roughly.will this amount suffice my application?<br />
       i was also give the vaf-2 form to be filled.i would really be thankful to the advisers and i have spent a lot of time browsing the tier-1/hsmp forum and seriously havent found answers related to my topic.<br />

I am presently on HSMP valid until 01-Feb-2010. I am looking to apply for an extension to Tier 1 (General) visa. My age at present is 26 years. <br />

For the past twelve months I have been working with a bank and my gross pay is £16500. Tax and NI have been deducted and thereafter net payments have been made to my bank account. <br />
<br />
The issue is that I am also working with a second employer (part time) since April 2009. My gross pay with the second employer from April 2009 to date is £3700. The employer has not deducted any tax or NI and has made a payment of the entire gross amounts as mentioned on the payslips. <br />
<br />
I request views on any tier 1 (general) visa application complications arising due to tax and NI not having been deducted by my second employer.<br />

Today I have succesfuly got my Tier 1 visa. Thus I have got my extension for 3 years. I would like to thank everyone on this forum. There advise has been priceless. I have a question regarding ILR. My visa was issued on the 11 Feb 08 but I entered the UK on the 20 Mar 08. Now my Tier 1 goes upto 11 Feb 2013. I am wondering do I need to make another application for visa because ultimately I will be short by 9 days before applying for ILR as you can apply only 28 days before the visa expires. <br />

If that is the case then can I apply for another Tier 1 visa by the end of March 2010 so that this time my visa goes upto 20 march 2013. The reason why I want to apply now and not wait is that the rules keep on changing. Can I do that. I have asked the UKBA about this and they werent certain.]]></description>

I applied for initial HSMP Tier 1 (General) on 7th December 2009 and am stiall awaiting the 'result' so to speak. <br />

My concern (which has been troubling me for the past month) is that in order to make up my salary (my permanent job unfortunately pays very little) I took on a freelance job as of April 2009. In my application, I included a letter from the employer for whom I have been doing this work and banks statements, which show the monthly income. I have not yet submitted a Tax Return and did not obtain a letter from my accountant. Is this going to be a major problem. I really thought that letter from employer and bank statements would be sufficient. As mentioned - this only applies to my freelance job, for my permanent job I have also included payslips. <br />

As per my age and qualification he needs to show 23k to claim 15 points.<br />
<br />
I am employed by a company on full time basis where his gross income for last 12 months is £18,264<br />
<br />
I am also registered self employed IT Technicain.<br />
<br />
By doing some IT/hardware support to few companies and he got paid exactly £5265 for 12 months period from 2-3 companies.<br />
<br />
I have got invoices, bank statemnets for this self employment work.<br />
<br />
I also has an accountant and he has given his letter and Profit/Loss statement for which he says 2200 as his expenses and remaining 3k as his net profit.<br />
<br />
Now my argument is:<br />

Would the home office take my net income of 3k (profit)+18,264, or would they consider my gross income from self employment work before expenses deducted??<br />

		<title>Urgent: Because Cash Transaction Self-Employed Rejected</title>

I would greatly appreciate if anyone could help me out here. I have like 2 weeks to prepare an appeal. Deadline 20th January 2010.<br />

I am a Self-empolyed person and have had 3 businesses run simultaneously.<br />
1) Giants Professional Success Mentor<br />
2) Sales at Celica Marketing<br />
3) Sales at Mozaic Marketing<br />
<br />
I submitted my application with the necessary invoices and receipts for all the three.<br />
<br />
Now some of these transactions were paid to me in cash and some in the Bank(most). What the H/O has done is said that they cannot verify my cash transactions in the bank and therefore are rejecting my application. (£16730-BACS; ~£5000-Cash; £20000 needed for 15 points)<br />
the only proof i have for these transactions is the invoices for each of the sales and a letter from my contractor (Celica and Mozaic) stating I have been paid the necessary amounts in cash on the exact dates. I was under the impression that these would stand as 2 proofs as the home office has stated that for earning atleast 2 proofs must be provided in each earning summary.<br />
<br />
What annoyed me is that from my contractor I submitted 2 pages stapled together. the first stating on company letter head (with signatures) that the page behind had the earning summaries of mine on those particular dates. What the officer has done is seperated both the pages so now you cannot connect the two and the second page looks like a fake document as it is not on company letter head.<br />
<br />
Another mistake the Officer made is in my report they have typed the dates wrongly saying "they could not corroborate my earning from 02Nov08- 15Feb08" instead of 02Nov08-15Feb09"<br />
Can i use this as a point against my appeal or is it not significant.<br />
<br />
I would really appreciate if anyone could answer this question of mine cause i am quite uncertain of how to go about doing things...<br />

My accountant made a little mistake on one supporting document, I think its computer ommission on one item when calculating my expenses on the Income and expenture account. I notice this mistake on the photocopies of the documents sent. I submitted my application today 07 January, it will reach them on sat January 09, I  payed with banker's draft. He has corrected the mistake and a new account printed, just one &#100;ocument. My question is as my application is due to reach them and owing that I am paying by cheque that will clear in 5 working days, Should I send this corrected account and a cover note so that they update the document? If YES, which address should I sent it to and how?<br />

I have a question. Actually I applied to switch of from student visa to Tier 1 General (formerly HSMP) which was refused then I filed an appeal which was accepted. I was waiting for the letter from the Appeal Implementation Unit but I had an emergency and I returned back to my Home Country. <br />
Some days ago my Solicitor recevied letter from the Appeal Implementation unit and they are asking my Passport and Pictures. <br />
My Question is this that was it necessary for me to live there in the UK for the completion for this whole process or it would be fine if will send my Passport to my Solicitor and he will further send to Home Office.<br />

I searched this forum and found that it usually takes 4 weeks.  I am planning to take him to my home country in Feb so just a bit concerned about it.  I don’t know if they will contact me to take biometrics or  it’s not required to take biometrics in Tier 1 dependant visa as a child.  Could anyone please shed a light on this?</span></span><br />

<span style='font-family: Calibri'><span style='font-size: 15px;'>My name is Ala Al-Badri, originally from Jordan and currently working as a Research Scientist in the UK. On 21 December 2007 I was granted leave to remain in the UK as a Highly Skilled Migrant until 21 December 2009. I have applied on the 21 November 2009 for leave to remain as a Tier 1 (General) Migrant. However, UK border agency has refused my application on the 30 December 2009 on the basis that I have provided two forms of evidence from the same source; although I have claimed 25 points under Previous Earnings, the Secretary of State has awarded me 0 points under Previous Earnings because the reason mentioned above. If truth be told it’s my mistake and I have not noticed this on the guidance notes.</span></span><br />

<span style='font-family: Calibri'><span style='font-size: 15px;'>I have spoken to a solicitor today and he advised me to go for the option of making new application and include full supporting evidence i.e. both bank statements covering 12 months and payslips under Previous Earnings section. </span></span><br />

God forbidden, if my Visa gets declines then can we both come back to UK, will his student visa still be valid.<br />

Currency, I am having this predicament.<br />
<br />
I sent my application for tier 1 extension ( my HSMP is expiring) on the 2nd of Dec 2009 and HO confirmed received on the 3rd of Dec. My Visa actually expires on the 6th of Dec. I just received a letter to day (2nd of Jan 2010) from HO rejecting my application stating that it is invalid. The reason they claimed was that I did not accompanied the photographs as specified mandatory in the application form. I did, it must have slipped or misplaced. <br />
<br />
As you would have guest, my visa is now expired. It the letter from the HO, they suggest I make another application with a new fee.<br />
<br />
If I submit another application, do I need to use the latest bank statements? If this the case, then if the bank statement date exceeded my visa expired date, is this allowed?<br />
Can I claim back the fee if the application is invalid? (There is no mention about refund of the previous fee).<br />
In the new application, I would need to fill in D16 and D17, is this correct?<br />
It is illegal for me to work now, is this correct?<br />

I have a little problem. I work for employment Agencies and I am being paid by Umbrella company. I want to know what earning HO will Consider, is it my contracted salary or the gross income after offsetting expenses.<br />
<br />
For instance,<br />
<br />
My agreed pay with the agency per week is £600.00, the Umbrella company deducts receives this and deducts £20 admin charges, employee NI £56, Allowable expenses £180 from the Salary, so my taxable gross is £600-(20+56=160) = 364. Tax on £364= NI 23 PAYE = 56,  then my net earnings or "Payment Received" is 285 + 180 expenses = £465.<br />
<br />
You will notice that my net earnings, which the Umbrella Company calls "Payment Received" = £465 is more than taxable gross=£365.<br />
<br />
I am aware that the HO considers the gross pay due for tax and not net income.<br />
<br />
Which pay will the HO consider? <br />
<br />
<br />
<br />
Total Contractual Salary from my agency? £600<br />
<br />
            OR<br />
<br />
Taxable Gross Pay after the reductions (Admin fees, Employee NI and Expenses)? £364<br />
<br />
            OR<br />
<br />
Payment Received? £465<br />

Please I need your advise. Very many might fall victim.<br />

		<description><![CDATA[hi, my accountant delivered company accounts today with lots of mistakes..he is certified acca and pracitising under a firm name <br />
1.He declared net profit  as profit before tax.but as per my understanding<br />
net profit is profit after every thing paid(expenses and tax) ie profit after tax.. so from netprofit we can take dividends... <br />
2. in the index of company accounts , he just wrote the his firm name and address. i asked him to write his name,phone number etc .. he said when he give the accountants letter, every thing will be covered in the letter.. is it o.k?<br />
3. when i submitted annual returns , i did a small mistake in filling share capital information few days ago//<br />
so in the company house web site my company info will be like this , Currency gbp<br />

Is it right to assume that the first 2 years under Tier-1 isn't really important in regards with what the applicant does in the country, as long as he remains in the country within the ILR allowance threshold?? So can one actually stay in the country and have irregular jobs or even take time off to study, but still qualify for the extension after year 3 if he/she possesses sufficient points?<br />
<br />
In effect.... can someone come into the country, not work for 1st 2 years and only work in the 3rd year to gain sufficient points for the extension?<br />

I have got a big problem here. Today Yorkshire building Society closed my savings account because I am changing address and on providing my passport as ID, they discovered that my HSMP visa expires in 3 weeks, then told me they will close my account because its against their terms and condition. They said any customer must be permanent residence or have at least 12 months to stay. They didnt tell me this when I opened the account on 6th october with my Driver's licence and deposited the required £800 in there, I have been running the account puting £10 weekly since 6th October, and today 18th Dec, they closed the account and returned my £920 to me. I explained my predicament to the bank manager, she said all they couldnt anything but all could do is return my Passbook to me showing that the account was in prefered credit up till 18 Dec, I have the passbook with me. I have now put the money in another savings immediately today. My 3 months would be due by 6th Dec. Meanwhile I have my other current account with ballance of over £2000 as of today but this account is not reliable because I had gone below £800 twice within the last 3 months but have a ballance of over £2000 since the last 1 month.<br />

i have 2 types of earnings 1. salaried<br />
2. self employment ....i am operating through own limited company...i am the sale shareholder and sole director <br />
i never took salary from my limited company..all the earnings are dividends... so the documents, i am submitting are... <br />
1.personal bank statement <br />
2.dividend vouchers signed by company secretary on company letterhaed<br />
3. unaudited business accounts..(p/l , balance sheet) ..on a4 sheet signed by director... <br />
4. accountants letter just confirming my dividends from my company <br />
5. business bank statement.. <br />
6. certificate of incorporation <br />

Question1: do i need a letter from my accountant confirm the figs like net profit , sales, tax etc, from unaudited business account? (since i took the earnings in the form of dividends and claiming points for dividends only, so i took the accountant letter to confirm dividend earnings ) <br />
<br />
Question2:while signing the balance sheet by director , there must be statement saying accounts prepared according to companies act 1985... but yesterday i got my unaudited accounts from accountant..they are prepared according to new companies act 2006 which replaces 1985 act.. <br />
so which statement to include? <br />
