My mum is a British citizen and so are my 2 siblings. She was advised by the home office when she applied for me to be a british citizen some years ago before i was 18yrs that she should apply for me to naturalize as a citizen when i am 18yrs. She then waited for me to be 18yrs(she was misled and she misinterpreted) and when she applied for me to naturalise as a british citizen she was then told that she should have applied for a residence visa for me before i was 18yrs, then when i am 18yrs apply for naturalisation because unlike my 2other siblings i was born abroad (outside EU). I have been living abroad (studying) and i have visited the UK for the last 2-3yrs and never overstayed. I still have a current visitors visa and i decided to apply for discretionary leave to remain because i am now classed as an adult and i have just recently finished my 1st degree study abroad and i have no family abroad. I have made this application about 3months ago and i sent my family's british passports to support my application. I am now a bit restless about how long it will take for a decision to be made on my application because i will like to get a decision on the application before my current visitor's visa expires (in 2-3 months). I dont know if anyone has an idea on how long this sort of case can take to be determined. If i am refused a discretionary leave to remain, i can go back abroad and apply to study in the UK. But if the decision comes after my visa has expired and its negative, i may encounter further problems applying for a student's visa abroad as they may think i overstayed on my visitiors visa and i am seriously guarding against this. I am also worried about the fact that they have not sent back my mum and siblings british passports as they may need their passports anytime and someone told me if i request for any of the supporting documents my application may be withdrawn but on the UKBA website they said applications are only withdrawn if the applicant requests for his/her passport to travel abroad. People, please, I need your honest opinion on my chances of getting a discretionary leave to remain, how long it may take, whether or not to request for my family's passport if they need them and general comments pls. <br />

I am wondering if i am eligible of bro's family re-union. What are the main requirements for it?<br />

		<description><![CDATA[Hi, I am a British citizen married to my illegal Boyfriend at Manchester Registry Office after being given my certificate of approval from the home office at the beginning of the year.<br />

I was wondering, How do I go about regulising his stay forever with me in the UK now that we are married?<br />

My solicitor has advised me that my husband would now have to leave and go back to his own country to apply for a UK spouse Visa, but I have heard something about applying in country for discretionary leave to remain or something like that in another forum.<br />
<br />
Can anybody explain????<br />
<br />
We both don't want to have to choose the route of going back to China if we don't have to cos of poverty and crime in his area.<br />
We are not well off but neither are we poor so funds are limited.<br />

Well my story is i came here when i was 10 and now i am 21 turning 22 in september & my mam told me we are overstayers, we came here as visitors. I am originally from zimbabwe and i also washed my passport in a washing machine by accident (drunken night). I studied here got GCSE's and a level 2 NVQ in business. I also took life in the uk test before i washed my passport. I got a child 1 year old & no am not with the mother but we do get on.<br />

I am an aussie citizen with 2 convictions in australia. 1 for domestic violence for which I was given a good behaviour bond and a conviction.Second conviction was for unlicensed driving for which I was given a fine for AUD 600.<br />
Will the UK Immigration check my criminal record incase I dont disclose my convictions.If I do disclose..what are my chances of getting the visa?<br />

I am currently working in the UK under a Tier 1 general visa and just into the second year of the leave to remain.  I have just been offered to work in Germany under a German contract for 6 months to 1 year within the same company but with a different agency. <br />
<br />
The question here is will working outside the UK affect my chances for a Tier 1 Visa extension ?<br />
Will it affect my permanent residency after 4 years from now ?<br />
<br />
Also, does anyone have advice on what sort of contract to sign up with the employer ?<br />

		<description><![CDATA[I came today in Heathrow Airport, and I came through the EU line and gave the officer my Austrian Passport.<br />
He looked at the system, for a few seconds, and then he asked me "Have you had any immigration issue before in the UK?"<br />

I said "YES, but who cares about immigration?? I'm European now!!"<br />
<br />

He was with 2 more people, I think they just supervised it all.<br />
It took them like 15 minutes to come back to me and apologise and say there is a record of your refusal for a Visa in the system, so that's why we had to check it.<br />

I told him this is the second time I'm having this issue - I don't know why this record is still showing in their system???<br />
Previously the officer a few months ago told me the record would be deleted.<br />
Today the officer told me the same.<br />

<strong class='bbc'>What can I do to delete this record off their system so I could get into the UK without any further delays anymore????</strong><br />

Long story cut short my dad brought me to India to finish the last two years of school (strange i Know) .Thus I have a British naturalisation certificate and an ILR stamp in my Indian passport (I dont have a British passport because my moms living in the UK with my brother and sister and Technically I would need hers along with my Dads to show to the British Embassy here in New Delhi for one)<br />

		<description><![CDATA[Hello - new here. I'm in the U.S. but I have a friend in the Military (Fusilier). He is from Fiji...born and raised. Fiji used to be under Brittish control, so he was able to join (I don't know all the ins and outs of how he joined). He has been a Fusilier for almost 6 years. He told me that because he has done so well with his military career that the militar will sponser him to become a resident. <br />

Is that right? That just doesn't sound right to me? <br />
<br />
I don't know anything about residency laws/requirements in the UK, but I was hoping someone could clarify? Can he be eligible thru the military? Or can he be eligible some other way?<br />

It's my first time writing a letter to the UK Border agency. I was trying to make it not very formal, but still not sure if this will work. Could anyone please check it for mistakes and say your opinions on it?<br />
It is very urgent and important matter for us! <br />
English is not native for me and I would really appreciate if someone could kindly correct all possible mistakes here and advise on how to make this letter more stylistacally correct.<br />

 I applied for EEA2 last month and unfortunately my documents were sent back as my passport was expired. A month passed and I really couldn’t find any other solution rather than writing to you again hoping for your understanding and sympathy.<br />

The situation is the following. My passport has expired and I can’t get a new one for the following reasons. Our embassy can change passport only for those who are studying in the UK or have residence. They <strong class='bbc'>don’t</strong> provide passport changing services for tourists and other categories, including those whose UK visa has expired. This means that the only way for me to get a new passport is to go home. But all the delicacy of the situation is in the fact that we are waiting for a baby and I really can’t leave my dear wife alone to go home and change my passport which may take up to 3 months, including getting UK visa in the embassy as my current visa has already expired. <br />
 I considered all possible ways to solve this problem during this month and came to conclusion that there are three of them:<br />
1) Stay in the UK illegally with no visa and no valid passport till at least several months passes after our child’s birth. With no right to work here and no clue of how to pay bills as my wife is self-employed and it is already hard for her to do her job. You can see from the statements that she is not getting much now and I really need to get the visa to start working or I don’t know how we will make our living.<br />
 2) Go home now for 3 month, leaving my wife alone, with no money and no care.<br />
3) Somehow to get a visa on A4 sheet here with the expired passport. This will solve this so upsetting situation, because: a) I will be able to start working and pay bills; <img src='http://www.ukresident.com/forums/public/style_emoticons/default/cool.gif' class='bbc_emoticon' alt='B)' /> I will be able to change my passport through the embassy as a residence permit holder. <br />
 <br />
 I found the following paragraph which allows a visa to be issued to the person with the expired passport. <br />
 ‘Passport and Travel Documents’:<br />

I am fully eligible under this law, as I’ve got ‘restricted returnability’. You can find an ‘exit visa’ on p. 13 of my passport which “is valid for visiting all countries in the world until 12.05.2011”.<br />
Even though this is the British and not European law, I hope that expired passport is not a big problem if the British law allows issuing a visa to the expired passport holders!<br />
 <br />
This situation is so upsetting for our new family that I started worrying if these nervous circumstances could affect our baby. My wife worries about even more than me, which makes me confused. That’s why I decided to apply again describing the situation and hoping for understanding even though my documents were returned once, but the officer wasn’t aware of our situation. <br />
 <br />
I had consultation with an immigration advisor and she told me that there were such precedents when EEA2 were issued to expired passport holders and that the final decision is totally up to the officer. <br />

		<title>Flr(M) Or Flr(O),confused?</title>

I am an overstayer and need to make an application to the H.O based on article 8,(Chikwamba case etc) but my representative from the law centre(legal aid) seems overloaded with work and cannot give me an appointment sooner . When i first registered with the law centre and explained my immigration problem,i was advised to i can make an application under article 8 and quoting the Chikwamba case where the applicant did not have to go back to their country of origin. The rep told me all i need to gather and an application form FLR(O) which i filled in and returned to him . I went to back to the law centre today and the same rep said he does not remember giving me form FLR(O) but FLR(M) which i need for my application and i have to call him back next week to get another appointment so this has left me confused and frustrated as i expected to finish my application today and send before i report to immigration in 2 weeks.<br />

I am desperate to make an application sooner than later because it seems my case worker at the Home Office has been making enquiries with my GP etc to find out if i fit to fly.Last month when i reported at the Immigration Officer at the Police Station,i was once again asked when i plan to return to my home country so it seems the case worker is on my case big time.<br />
<br />
My wife who has indefinate leave to remain applied to transfer her ''NO TIME LIMIT'' stamp into a new passport and she sent her old and new passport and our marriage certificate(she sent marriage certificate coz her new passport has her married name),she got the usual acknowledgement letter from the H.O with a reference in which she's been told to wait and advised not to make any immediate plans to travel etc. I also have a child who was born prematurely,there are still some concerns about his health by his consultants and they continue to monitor his development,my oldest child aged 3 and half is also having developmental & health problems,they were noted by the children's centre he attends as he is preparing to go into school this september so at the moment it's difficult for me to travel to my home country and do an out of country application so i need to do it here.<br />

I know i have a free representative but could someone clarify what form i need to use to make an application,i believe it is discretionary leave i need to be applying for or is it further leave to remain based on marriage? which form do i need?<br />

I am applying a general visiting visa of the UK. <br />
<br />
I had been staying in the UK for a few years in the past. The problem is, during my stay, I had a negligible dispute with my neighbour. They accused me to the police. Then the police informed me that there would be a trial in the court. <br />
<br />
Later, before the trial, we compromised to each other. My neighbour withdrew the accusation.<br />
<br />
Afterwards the police told us that there will be no trail. However there would be some kind of 'record' for me. I have been worring about that 'record' all the time after I have left the UK. I then applied a Basic Disclosure for the CRB. The result was that I didn't have any critical crimial record.<br />
<br />
Here are my questions:<br />
<strong class='bbc'>1. Should I report such a 'record' on my visa application form? <br />
2. To what extend will this affect my application?</strong><br />

		<description><![CDATA[The UKBA appear to have lost my husband's passport.  They kept us waiting more than a year for a decision which has resulted in a 2 year extension. This was issued on a ISD and we received a letter saying the passport was unavailable.  The passport was sent by special delivery when we first made our application.<br />
<br />
As you can imagine my husband is furious!!!!  We have spent nearly 5 years waiting for HO decisions during our 8 years together!!!<br />
<br />
Does anyone have experience of this?  What was the outcome?  <br />
<br />
We are also unhappy with the outcome of our legacy case, naturally we had hoped for ILR, can we ask for a review of the decision???<br />
<br />
My husband has been dealing with UKBA for almost 10 years and we have had just about as much as we can take.  Passports are important documents, how can they just get lost with no explanation?  <br />
<br />
This stuff really can't be made up- yet it's all true!!!!]]></description>

About myself: I am English, born in UK, so full UK citizen.<br />
<br />
About my partner: She is Brazilian, she has been in the UK for approx. four years on a tourist visa. She does housekeeping for families to support herself and to support her children in Brazil.<br />
<br />
We met last year and have been living together since November. I am in the process of buying a house, for us to live in, since I have no property myself and I am not getting any younger (59 and approaching retirement).<br />
<br />
We want to stay together and clearly marriage is the simplest option. But I am not sure how to go about it so as not to create any problems with UKBA.<br />
<br />
We are both very fond of each other and see this as a long term commitment.<br />
<br />
I have no restriction on my travel, I can and would travel to Brazil, if that was the simplest way to achieve the desired result.<br />
<br />
If my partner leaves the UK via say LHR and she is stopped by UKBA, can they make getting married in Brazil and getting both of us back into the UK a real problem?<br />
<br />
To avoid UKBA, is it an option to travel to N Ireland, cross the border in S Ireland and either leave for Brazil from Dublin Intl. or perhaps get married in RoI?<br />

As I know the home office does not giving Indefinate leave to remain to the people who has clamied asylum after 2005. So what is the law/policy does the people covered who clamied asylum after <strong class='bbc'>30 August 2005</strong> and who got 5 years limited leave to remain.]]></description>

My wife and stepdaughter should obtain ILR in a few months time. They have been studying an approved SCOTVEC English course which contains "Elements of Life in the uk". Passing this course at level 3, apparently does away with the need for them to pass the life in the UK test. They will also continue to take ESOL courses at higher level over the next few years.<br />
<br />
I noted on one of the government websites that the Life in the UK Test was introduced firstly to applications for ILR,  and was subsequently applied to Citizenship applications. My question is.....If my wife and daughter are granted ILR, will they be faced with this Test later when they apply for citizenship.<br />

		<description><![CDATA[My partner was refused a uk visit visa last week and we sent a very thorough complaint to the british embassy stating multiple reasons why we thought their refusal was unfair, unjust and inaccurate. it was well backed up. This was not an appeal, just a complaint email. <br />
<br />
We got a quick response stating that our complaint had been sent to the Entry Clearance Manager at the embassy and that the past application and her 'file' was being looked at and reconsidered. <br />
<br />
We were making plans to re-apply next week with more supporting documentation to address the issues she was refused upon. We told this to the embassy in our response and they told us not to re-apply but instead wait for the result from their reconsideration of the last application. <br />
<br />
<br />
Do you think it's possible that they will overturn the decision and grant her a visa? <br />
<br />

I have appealed on my student visa refusal but by the time the hearing is on I have already finished my course lectures- now only waiting to be assessed in June or September- it had to be delayed because I am in 34 weeks pregnancy and I can't be assessed at the end of March as everyone else.<br />

What can I expect at the hearing - will I get at least 6 more months till my baby is 6months old and then leave the country if the answer from the appeal is NO.<br />
I am realy getting stresed- I have applied for this student visa in February 2009- I gotanswer NO at end of August 2009 -I appealed and the hearing is now in March 2010.<br />

I have a few questions I hope can be answered by members. I applied through a lawyer for an unmarried partnership visa( my partner is an EU national with permanent residence here). My lawyer said that it would take a few weeks for the UKBA to send her a letter that says I can work while I wait for a decision. I've read on some forums of people waiting for years to get their passports back and not being able to support themselves either by having a job( and yet others are given permission to work while they wait). SO, I was just wondering why this is. Why can some work and others not? Also, how do you cope without a passport for so long? I'm new to this and would be grateful if anyone can give some advice.<br />

I first came to England in July 2000 under student visa (So I went through middle school, high school and recently graduated with Bsc Hons degree last year). <br />
I am currently on a PSW visa working as a research assistant at Newcastle university. I was told by a solicitor that changing my visa status from student to PSW will not affect my future residency application.<br />

Can anyone tell me<br />
- which form should I be using for my application<br />
- do I need to take an ESOL test if I take Life in the UK test?<br />
- Can I apply for it sooner? as I am hearing stories that people get their residency granted a year or a few months before they fulfil the length of stay required for them to apply for residency through solicitors<br />
- Is there any other websites that give more information about the application?<br />

		<description>Once again for some help please from fellow members here, The name in my own country passport is written in the wrong way my full name is written as my surmane and my fathers name is written as my given name, recently recieved ILR on ISD document and is written the same as my passport, my high commision would change this, but a  long process tough, as they realise the mistake themselves, would that create a problem with the HO  as my corrected name would not match the name on ISD document, or just keep the name as is on the passport as has been for the last 10 years get the ILR endrossed on my passport and do a poll deed or what is now called statutory declaration in the U.K. and change my name  to the correct way and carry on please reply.</description>

		<description><![CDATA[I am a Zimbabwean and came to UK (2002) on a visa. <br />
<br />
A year before my visa expired (2003), all my correspondence (passports, I.D) got stolen and reported matter immediately to the police.<br />
<br />
Zimbabwean embassy couldnt issue me another passport, as I couldnt prove who I was, I last lived in Zimbabwe in 1995. <br />
<br />
I made an application to extend my visa in 2004 before my visa expired, my application was returned 3 times to payment issues, 2 times Home Office asking for further evidence such as police report. I also provided letter from Zim embassy stating I needed some form of I.D to apply for another passport.<br />
<br />
Home Office now claim I am an overstayer and applied outside immigration rules, however, til to date, my application is still waiting further consideration (since 2004).<br />
<br />
In 2005 my ex-partner (British-born citizen) gave birth to our child.<br />
<br />
In 2006 my finace (also British-born citizen) gave birth to our first child together and in 2008 our second child. We have lived together since 2005. <br />
<br />
From early 2005 I made several complaints to the Immigration Complaints Unit that they were taking long and that all my letters to immigration were never replied. <br />
<br />
C.A.B tried to help me around 2006, with no success. I complained to my MP. <br />
<br />
The reason I was desperate to have my application sorted, is because I had a family to take care off and my ex-partner refused for me to see my child if i couldnt afford to support her. <br />
<br />
I couldnt get a job with no I.D. <br />
<br />
In 2008 I was arrested for assisting some people launder money. They offered me a small payment which i found hard to resist with the situation i was in. <br />
<br />
I was sentenced to 3yrs 6months, in a UK, and have completed serving the sentence and am back with my family. <br />
<br />
I am not serial criminal, I regret the decision I took to help people commit a crime, it is the situation i am in that made me make a stupid decision, I was under pressure to support my family. None of the money I received was used for luxury items but to buy my family things.  <br />
<br />
I want to find out how strong my Article 8 is in the above case. And suggestions of what evidence i require to prove my family situation is. <br />
<br />
I can not move to Zimbabwe with my family, especially with Zimbabwe situation, if i left the country i would never see my first child, my ex-partner is in another relationship and have 2 children to her new partner. <br />

I try to contact the home-office through their general enquiry line on 3 different occasions, but told they 'll contact me. <br />
<br />
Now after 8 months with no reply/contact whatsoever, I sought advice from the Citizen Advice B. Their advice is this normally takes time at times some 18months as they know.<br />
The dilemma I faced was even though I wanted to pursue my Masters degree, I couldn't as my prospective school were demanding to see my visa.  So here I was locked up.<br />
<br />
Now I got a solicitor on writing to the home office, they claimed the did try to get to me but to no avail. That I dispute. <br />
Now the home office are refusing on applying saying they thought I had  completed my schooling and gone home, when apply for indefinete stay. <br />
<br />
The reason was I had overstayed?<br />

I am advised that currently the waiting time (to get my British citizenship, if successful) is 9 months. That's fine. What worries me is that one of the documents requested is MY PASSPORT! Surely the Border Agency (the department which will process my application) will not sit on my SA passport for 9 months! There is no provision in the Guide to UKM which indicates that I can send a certified copy -- it simply asks for my passport.<br />

My problem is the following. Both my visa and passport are expired now, and I've applied for EEA2 visa recently but my documents where sent back to me for the reason that I didn't provide vaild passport. The problem is that I can't get a valid one as in order to do that I need to go to my home country. And if I do that, I won't be able to get back as I still haven't got any visa. So the only option for me was to get the visa first and then get back to home and change my passport. And I described everything in detail on a separate sheet when was sending my application. And they still didn't accept my application, giving quite formal reply: 'Please provide valid passport or ID card'.<br />

		<description><![CDATA[I am an Australian citizen (and a student) and have been living in Vienna, Austria for a study abroad program, travelling etc and have been in the Schengen area of Europe since July last year. However I wanted to spend 6 months in the UK working and living with my partner, before I return to Australia to finish my degree. I have applied twice for Tier 5 Youth Mobility Scheme Visas and been denied twice for very minor things regarding incorrect paperwork, i.e. bank statement did not show funds for the previous 3 months, even though the required funds were present.<br />
<br />
I would still like to spend some time in the UK however, as I have friends there and as mentioned my partner is working there for 6 months also. I am really, really worried that when I get to the border they will refuse me entry because they suspect me of trying to work. I would much rather spend even just a month in the UK and have to return home than not get in at all.. Does anyone know what I can do to show this to them so they aren't suspicious of me?? I can understand that with these two failed visa attempts they might be.<br />

Would I need a letter from my university stating that I only have 6 months left of my degree.. I am applying for a loan maybe that would help to show I will have funds.. an email from my parents stating they will assist me financially?? Please help, the Australian government website (DFAT) also issued advice to all travellers that the British Border agency are very strict and that I may have to return home to Australia if they suspect me. I would be completely devastated if this happened.... Any advice or anyone who knows how this might play out??]]></description>

I got my ILR in 2001 and left the UK in June 2002 to come back to South Africa to look after my brother after my parents both died, my husband has been back in the UK for 7 months now and we would like to go back to stay there can I go back as a returning resident and if so what documents do I need.  My daughter and still have my ILR letter and the stamp in our passport.  It is difficult to get information from the Visa Agency in South Africa can someone please help me I am at my wits end and don't want to reapply for a settlement visa if I don't have to as it is very expensive.]]></description>

I apologise if this is the wrong forum to discuss this.  I have looked at several Immigration Solicitors and Advisors in my area and I am even more confused.  I really don't know who I should go for.  I was wondering if anyone has had any experience with either of these in the North East area of England?  Your help would be greatly appreciated as I know how much a Solicitor can differ, even if they have been registered.  I have a big issue to deal with and I don't want to be bouncing around from place to place.  I need to get help once and for all.  I hope someone has had good experience in this area.  <br />

Secondly my husband is 38 years permanent resident in HK with profitable business running well in HK. So can we all move to UK and he continue run his business in HK (while staying in UK most of the time) maybe travel back few times to HK to manage his business . ?<br />

		<description><![CDATA[Hi <img src='http://www.ukresident.com/forums/public/style_emoticons/default/smile.gif' alt='Posted Image' class='bbc_img' /> My question is about my brothers girlfriend, my brother is a biritish citizen by descent, she is an overstayer, only a few weeks ago she decided to close her case, she entered UK as a work permit holder and had lost her job, she then hired a lawyer to appeal her case, and so it went on and on as she was passed on until to the higher court of justice, and then she closed her case for financial reasons, but by the time she closed her case she couldn't travel as she was 36 weeks pregnant, and could not afford to pay for the extension leave that she was enititled to until after the birth., she now has given birth and would like to know what to do next, my brother supports her and the baby but does not want to marry her. As he pays for everthing, including rent, would he be affected if she got caught before they save up enough money for her and the baby to go back from where she came from? Would the baby be entitled to have british citizenship? any advice would be great, thanks.]]></description>
