Tier1 General - Visa Status Change While In Uk

I had been in UK for last 4 year on Work Permit and recently got my status changed to Tier2 ICT. My current Tier2 ICT Visa is valid till Jan 2011.

My wife & child are in UK for last 2 years on Tier1 General & Tier1 General dependant Visa.

I'll be eligible for ILR in Dec'10 with the current rules.

However, heard that new rules that do not allow Tier2 ICT holders settle in UK will come into play soon. Hence, I plan to change my Visa status from Tier2 ICT to Tier1 General Visa at the earliest.

I learnt that my family to get ILR along with me need to be my dependants.

Could you please let me know, if my wife and child can change their Visa status to my dependants while being in UK when I apply for my Tier1 (my Tier1 G application & dependants applications sent to home office at the same time).

Tier 1 Extension - How Long, And Timing Of Future Ilr

Hi all,

I've scoured the forums, but can't find answers to questions.

1. My HSMP visa is due to expire on 25 May 2010. When should I apply for the Tier 1 extension?

- How long does the decision take (approximately)? Note: My case is very standard - one employer since I came to the UK 18 months ago. I have standard payslips, etc. I even opened a Halifax bank account which sends statements covering 3 month periods. My application should be pretty straight forward

- Will my extension be timed from the day my application is received, or from the day they make the decision?

2. I know ILR is calculated as a continuous 5 year period, but how precise are they on this? It seems to me that it is tricky to go the 'usual' Tier 1 / HSMP route to ILR as the Tier 1 / HSMP visa periods are exactly 2 + 3 = 5 years. Given that you probably won't come to the UK on the exact day of the approval of your entry clearance, or that you will not be granted your extension on exactly the last day of your initial visa expiry period, surely this makes it near to impossible to time exactly 5 years in the UK under the Tier 1 / HSMP program?

3. What happens after your 5 year tier 1 visa has expired, if you haven't been in the UK for exactly 5 years? Can you extend the Tier 1 visa again?

To set the context for the above three questions, I am moving to a really good job on the 1st May. However, I would rather start the new position with my visa extended; I don't want to walk in with only 25 days left on my Visa (expires 25 May 2010), or with no passport at all because I have submitted it to the Home Office! Furthermore, if there are any issues with my application and I have to appeal I want to sort them out before I start the new job. But on the other hand I don't want to harm my chances for ILR. Although from what I can tell, it's almost impossible to get ILR on the Tier 1 / HSMP route anyway. Eg my initial HSMP visa was approved on 25 May 2008, but I only came to the UK on 12 June 2008. Does this mean I've already blown my chances at ILR no matter when I extend?

Help! Extension forms are bundled up and ready to go, but not sure on the timing.

Switching From Work Permit To Tier General - Proving Past Earnings

I am currently a work permit holder and want to put in an application for Tier 1 general but I can only get enough points if I add my car and fuel benefit to my earnings. The reasons I want to add them are

1 They are part of my contract and is stated in the contract that I shall have a company car + fuel available for my private use.
2 HMRC in the annual PAYE notices they send me recognise this as income and calculates cash equivalents in arriving at my tax code, that means I pay tax on them.
3 Unfortunately for me this does not appear on my gross pay and is only reflected in my payslip when the tax code is considered. I want to present a letter from my HR unit which states my total annual reward package and will include my gross pay and the cash equivalents of these benefits.
4 I also intend to add my form P11D which shows these amounts.

My question is has anyone come across a similar situation? And what do you think are the chances of this being rejected? Can you recommend any lawyers that can handle this for me?

Tourist Visa To India From Uk

Hi all!! This question is on behalf of my son. He has a job interview in India and needs a tourist visa, but has learned that he must either go to London to the VSF centre and make an appointment, which entails waiting for days (he lives in Cornwall so this is difficult!), or post the application.
Problem is he is worried that if he posts it that he won't get his passport back in time for 1st of June, or not at all.
Has anyone had any experience/knows how efficient and trustworthy the VSF centre is?
Is there some way he could insure that his passport doesn't get lost in the mail (since VFS withhold any responsibility for third part loss/damages)?
If there was too much risk of posting it, and he had to go in person to the centre in London, does anyone know (from experience) how long it takes roughly for it to process?

Mistake On Visa Sticker + Doc. Missing

Hi Seniors

I have recently been granted Tier-1 General Visa (3rd march) but yesterday I found little mistake on my dependent's visa sticker. On right hand side where it mentions DOB, Gender and Nationality. In Gender, they have made mistake and put M rather than F. Same mistake is at the bottom of sticker where Name, DOB, Nationality, Gender and Visa Expiry Date (all are under 2 lines)

Any Idea? what should i do to rectify this???

Also I didn't get back some of my original documents such as my Accountant Letter, my employer letter, bachelor degree award confirmation letter and my professional qualification result history. Although I can request for additional original copies of above but still want to know if they keep these documents???

Self Employment Income/earning

There has been bit of confusion about self employment income. My recent contact at Home General enquiry line about this issue....... According to them they look for Gross income. Same I spoke with one lawyer he said the same thing..

But I have seen different views on this forum and with different immigration lawyers.

Now there are two things:

1) Revenue / turnover / sale - direct cost = GROSS PROFIT
2) Revenue / turnover / sale - direct cost = Gross profit - overheads = NET PROFIT

Which one home office look for??????? GROSS PROFIT - 1 OR NET PROFIT - 2

GROSS PROFIT seems to be reasonable. suppose if one needs 30 point for earning (above 29k)....... so 29K NET PROFIT is unjustifiable. Imagine how much turn over / sales he/she needs to make specially for newly qualified person. (assuming most of Tier 1 applicants are on PSW)

Other side of story...... for employed person it's his GROSS SALARY = Personal Allowance + Gross Taxable income
from this point of view it, for self employed person it should be NET PROFIT becoz after direct cost and over heads whatever is left its for self employed person means NET PROFIT which taxable

so its Sales - direct cost - overhead = NET PROFIT (taxable) = GROSS INCOME ( taxable from individual point of view)

Any idea???? which one they are looking for????????

Thanks

Finally Applying

Hello,

After a long wait, I am finally applying for Tier 1 General switching from PSW expiring in Aug'2010.

Going through the procedure, I came across a few things which I would really appreciate if someone could help with please:

Salary Receipt Dates

My salary arrives in my account every 25th or 26th varyingly depending on the nearest working weekdays. My official salary receipts are always with me on the 28th dated as 28th. Will there be an issue as my bank statement shows salary on couple days before my salary receipt arrives? There is no other date on the receipt except the 28th of every month.

Salary Receipts - Employer
Our company is a sub company run by a master company and 10 out of the 12 salaries I have received are from the sub company except the last two as shown on my bank account. However, the salary receipts are all headed as the sub-company name. So for e.g.; Company ABC is run by company XYZ. On bank statement, I have 10 ABC salaries, and 2 recent ones as coming from XYZ. All salary receipts are from ABC.
Shall I get a letter from XYZ (the master employer) as the third proof of salary?

Salary Receipts - Allowance

I have had a wrong amount added to one of my salaries as allowance because of some accounts issue. This was taken away with the same allowance name / amount deducted on the next salary. Cause of worry ?

I do have some more questions though, a few basic ones but will keep you posted as I go, and will try to keep my questions relevant.

Thank You,

Hi:

My PSW visa runs out in March 2011. I am currently working for a company. My earnings are 18,000....
I know that my earnings must be at least 20,000 for the last 12 months before the moment I make my application.
I'll be 26 when I apply.

Any ideas?

I'm thinking about getting a weekend job to make up for those 2000 pounds that I need.

would that be ok?
If I have 2 jobs for one year, and then I apply for Tier one?

Thanks,

A Query Regarding Tier-1 Earnings

Hi,

My friend has already opened his account on this website with the appropriate payment but he was told that its going to be a while before he could use his account. Hence he requested me to post his query.

Here he goes.....

"I have earned approx 8000 pounds in the last 12 months, as I was repairing laptop, a company made a contract with me that I will be paid 50 pounds per laptop (a fixed rate). The amount I was paid was in cash, and I used that amount for my general living. I never deposited that amount in the bank. Can I use that amount towards my earnings? Although I have maintained record of invoices for over 150 laptops I repaired, the invoice contains the laptop number, model, customer details, and most of them have a contact phone number as well.

What do you suggest; would that be acceptable by the home office?

Note that 8000 pounds I gained from this contract was paid to me per laptop basis that is 50 pounds per laptop fixed, so I just used to spent them rather then putting in bank. And that money was a total profit as there were no expenses; all the tools were provided to him by the company."

Cheers
A cousin of mine arrived in UK last year on a highly skilled migrant visa (from pakistan), he then called his wife over about a year later (from pakistan) which I think may be on some sort of visa (dependent visa??)... Correct me if I am wrong.
They now have a child born here in UK. Would that child be of british nationality since it was born in UK?

Tier-1 (General) Dependent- Not Allowed To Work As A Doctor In Training

Dear All,

Wonder if you will be able to help me here... I was granted HSMP Visa in May 2006 on old rules and received subsequent extension in sept 2008 for three year. Got married in 2009 and applied for Visa for my spouse as dependent and the visa was granted with observations "not allowed to work as Doctor in training" & "no recourse to public funds". However on my visa the only observation is "no recourse to public funds". She entered the UK on the same visa in Dec 2009 and has not yet started work

Both of us are doctors and I am already working in the NHS and she applied for the foundation programme and has been offered a a training post. We spoke to the home office and was told that she needs to go back and apply for a Tier-2 Visa.

What my understanding is that under judicial review dependents are entitled to the same benefits as that of the principal applicant and i was told by the home office this is not the case for new dependent application which is not easy for my mind to digest.

Can anyone shed light on this please.....

Thanks very much....

Tier 1: Qualification Confirmation (Masters)

Hi All,

I am finishing my MBA in March 2010, but the Official Transcripts would be available in July only as the university's official board meeting takes place in july only. The Home Office site (http://www.ukba.homeoffice.gov.uk/workingintheuk/tier1/general/supportingevidence/qualifications/) says that if I am awaiting for graduation, then I have to provide the "original academic reference and original transcript".

My university hoverer says that in March they can provide me with a letter saying "Student X completed MBA course, and list of his marks and blah blah" on a headed paper with signature etc, BUT - the kind of Official Certificate and Transcripts would be only in July.

Question 1: What does "Original academic reference and original transcript" as at HO's site means?
Question 2: I plan to apply in March-April for Tier 1 (dont want to wait untill August) and can I use the letter and transcript from university saying that official would be in July when University Board Meeting will approve them.
Question 3: can you guys please recommend some good london immigration consultants who have HO registration.

thank you

P.S. all other TIER 1 requirements are fine: age, earnings, good character, UK experience, etc. on a HO TIER 1 calculator i make 95 point from 75.

thanks once again for any help of advice

Hi,

As I was about to submit my application.
I got little confuse, I have a fulltime job plus some self employeed work.

for self employed i am attaching accountant letter, profit lose statementbalance sheet, income summary and invoices etc.

Actuall situation is I earned 7000 as self employeed. Which reflect in my bank statement in 3 transactions.
But while preparing accounts, my accountant deduct some amount around 500 as I told him that was expense.
So Goss taxable profit/income is 6500. My question is in T1 application what I have to mention as income 7000 or 6500.
Keep in mind account mentioned in his letter that I recived 7000 in my bank account from which only 6500 is taxable gross profit.

I am totally confused on it. Please some one help me what to put in T1 application :S.

Also another thing, I always paid in my bank account as cheque. When I confirmed payment I issued invoices.
Means I was paid in advance for consultancy services I provided. So all of my 3 invoices of 7000 are of same date as transactions in my bank account.

Is this a normal pratice for invoices or i am just over thinking now just before submitting my application.
I was going to submit my application when all this came into my mind.
I am so confused, please advise me:S
the problem is From sept 11th - sept 23rd my balance went below 800 GB|P.
I have asked them to consider from 24th Sept onwards.
2. While applying for NIN?
3. Registering with a GP in UK?

List Of Documents Submitting (Suggestions/commments Required)

Hi All,

From a long time I am following this forum. From my studies to PSW and now I am in next phase Tier1 General.

I have completed my points as far as I am quite sure

I am sending my application next week some time.
I read guidance notes page by page to fill my application.

I know without looking original documents its hard to say anything. But I want to make sure nothing major or critical missing.

Please give valuable suggestions and comments on my supporting documents.

My case is as following:

I was required to hit 26K for earning.
Which I managed during Jan 2009 to Dec 2009.
I have a full time job with 20K, moreover earned 7K from some consultancy work (Sole Trader)

Documents I am submitting are:

For full-time job:
1. Bank statement from Jan 2009 to Dec 2009(Highlighted transactions).
2. Payslips Jan 2009 to Dec 2009.
3. Employer letter confirming gross salary(full-time job)
4. P60 April 2009

For self employed consultancy work:
1. Bank statement from Jan 2009 to Dec2009(Highlighted transactions).
2. Accountant Letter (Confirming 20K+7K=27K)
3. Balance Sheet
4. Profit Lose Account
5. Income Summary
6. Invoices

For maintenance funds:
1. Bank statement (Last 3 months with no less balance than £800 everyday)

For English language requirement:
1. Masters degree (British university)

UK experience requirement:
1. Employer letter confirming gross salary(full-time job)
2. Invoices

Proof of age:
1. Valid passport

AND

Tier1(General) Application and fresh pictures (plus a special delivery bag for safer and quicker return).

I did also receive some expense claim time to time from my full time employment.
Do I need to send remittance advice from employer and highlight those transactions in my bank statement(in any case)
I am not sure about this .

Another last thing as I earned 7K as self employed in June 2009 to Dec 2009(registered self employed in June 2009), so my accountant says I dont need to pay tax on 7K right now, I still have enough time. He says I can pay before Feburary 2011.
Is it recommended to pay tax and then apply for Tier1 or I can apply even right now? I am confused about this .

Also on average what is processing time for applications.

If someone feels something is missing please do point out.

Thanks very much for patience and reading .
Will appreciate valuable suggestions and comments.

Hello Guys,

I am applying visa extension for me and my wife in mid November from HSMP to Tier 1 General.

Now, my wife travelled on my travel card about 3 years ago and was caught and got Summons from Magistrate Court. She was asked to describe or confirm what happened which she did and then she was fined £105 from court.

Now while trying to fillup her visa application form, I was confused about whether to declare this. She has had two visa extensions after being fined in which she didn't declare this and got her visa extensions. But I am still confused that if I need to declare this now as I have heard that they refuse for deception if you don't but I don't know whether this actually comes under Criminal Conviction.

Anyone who may have faced this?

Please let me know.

General Requirements For An Application For An Extension Of A Hsmp Visa

Hi,

I am a holder of a HSMP visa which was issued in May 2008 and will expire in May 2010. Now then, I am not very informed as to how is the process for applying for an extension of that visa. Initially I thought all that I needed was bank statements showing a minimum balance over a 3-month period, an application form and the fees. However, I am not so sure as to whether that is all that I need. could someone under the same circumnstances share the information or give some links as to where is a list of the requirements? That would be very much appreciated.

Thanks,

Hello everyone . Iam applying for my tier 1 general . I will be getting the 20000 pay which I think is enough for claiming 15 points. The period of earning is my last 12 months. But during this period I even got my holiday pay paid along with my normal monthly pay as I didnot go for holiday . Tax was deducted on my holiday pay ad well. Now is that alright for claiming points for that 1500 pounds which I got as holiday pay in a particular month along with my normal monthly pay . So it's sone thing like 2400 -my wage for that month and 1500 my holiday pay paid in the same month . So please can any senior members give me the reply that would be much appreciated .

After some feeback from clients I am now aware that Non-OISC registered advisors are operating on this forum (esp in the Tier 1 general section).

So I assume that some questions are being posted by these advisors for them to make applications.

One client came to my office today and instead of a normal consultation he was more interested in how an application is made in the UK. When I asked him if he had a Masters he said 'I'm not sure, I may have done one in April but not sure I may know in October'. He also was unsure of what visa he was currently on, he stated 'well PSW or student but maybe a Work Permit'. That is where the consultation ended.

Now these advisors may also be OISC registered so I think it's very important when hiring one to know what experience they actually have.

I searched but couldnt really find a definitive answer for this.

My current employer (in pakistan) provides 'printed' payslips (just computer-printed documents listing the specifics). They do stamp and sign them. my question is whether this is sufficient for proof (for earnings)?. In one post I found, someone suggested providing a separate letter from the accounts/admin officer/incharge person which gives a breakup of the salary , essentialy the same thing on the payslip. I supposed this would constitute another form of evidence for the same source of earnings. is this the right way to go about?.

Hi

Following my Masters degree, I have studied at 2 different colleges in 2005 - 2006 whilst on a student visa for a diploma where the set of subjects taught were different and were of my choice.
Back in 2006, I have got student extension on first college which was submitted at that time.
In 2007, I have got Initial Hsmp permit with second college, as I have not used the first college due to its closure.
I have applied for tier 1 extension recently and i have got a query asking for the degree from first college.
I have no problem in sending the requested, though I am puzzled regarding the query as both the degrees for that period were submitted whilst applying.

Hi All,

As we all know that we should not stay outside UK for more that 90 days in any year during the five year period before getting the ILR, my question is in my case the passport was delivered after 50 days of stamping visa and it took about 30 days for me to wind up my stuff and travel to United Kingdom. This seems to be a sum of 80 days, but the 50 days delay was due to the service so.
In such case, how the 90 days will be calculated? it will start from the day I got the passport back or it will start the count down from the date of stamping visa?
It might be a very childish question, but I need to know this as I am planning for holidays and want to know my threshold of living outside UK this year.
Hope to hear from all senior members including Skill Clear.

Tier 1 (General) Extension

Hi

I came to UK as a work permit holder in march 2007(got visa in feb. 2007) and got Tier 1 (General) visa on december 2008 which is due to expire in december 2011. At the end of my Tier 1 visa expiration, I would be 1-2 months short of 5 years time to be eligible for ILR application so I know I will need to apply for Tier 1 extension.

For some unavoidable reasons, I have to go back to my home country for 1 year and in the meantime I will be employeed by my current employer but would be working from my home country and would be making frequent visits to UK ( probably for 1 week in every 6 weeks). Also, after having spend 1 year outside UK I would be back to UK with my current employer (most likeyly) so I am pretty sure that I would have reasonable points for Tier 1 extension eligibility.

My question is that is this 1 year tenure outside UK going to invalidate my current visa ? and/or is it going to effect my Tier 1 extension application (which I would apply for in dec. 2011)

I am looking forward to get help and advice on this.
Best Regards & many thanks in advance

Hi fellows
I have a Tier-1 general visa with validity starting from 23-APR-2009. Since then, I have been planning to move to UK but have not done so untill now because of lack of good job opportunities. I have following questions in this regard.

Is there a time limit to utilize the Tier-1 Visa? e.g. Do I have to enter the UK before a certain date?

Once I enter the UK, what steps do I have to take in order to establish my residency? Do I have to go to a govt. office to register my presence or do I have to apply for residency at local Council's office?

I have to attend a job interview in London on 02-NOV. Can I enter the UK on my Tier-1 visa for the purpose of attending this interview?

If the interview goes well and I move to the UK and stay for a period long enough to enable me to apply for extension of Tier-1 visa, how will the Home Office decide if I have remained in the UK for the required time?

Waiting for your replies

Tier 1 Dependant From For Child

I have some query about some of these questions on dependant form and I hope you can shed some light on it.

I am going to apply a dependant visa for my son as he is born here in May08 and I didn’t apply for any visa…

I’m not sure what should I fill here…

Section 2 – D. Immigration History

D6. Are either the dependant’s current and/or any one of his/her previous passport(s) or travel document(s) that he/she has used to travel to, and remain in, the United Kingdom which shows his/her current leave unavailable?
Yes or No

D12. What is the dependant’s current immigration status in the United Kingdom?

D13. Has the dependant ever stayed in the United Kingdom beyond the end of his/her period of leave?

D25. Was this application submitted before the dependant’s leave expired?
D26. Has the date of the dependant’s leave, as stated in his/her passport, now passed?

Section F – I think I don’t have to fill this.

Section 3 – Main Applicant’s Details

G5 – Home office reference no -
G6. PBS migrant reference number

Section 4 – Main applicants details

J4. Has the main applicant applied to have his/her application assessed in accordance with paragraphs 39-42 of the HSMP Forum Ltd. Judicial Review Policy Document?

I am not sure what to say – I was on a dependant visa and had to go back to India to switch my visa…

K – Maintenance –

I think we just need to fill K1 and don’t need to fill K2 to K17.

I will also attach covering letter….Hope my son will get visa and HO won’t ask that why I didn’t apply early.

Please advise me if you know how much will be the visa fee

Earnings Query

Hello,

I need some help regarding earnings, im hoping to apply for Tier 1 in Jan 2010.

I wanted to claim points for the best 12 months in my previous 15 months (From October 2008 - December 2009)

I had a break of one month when i lost my job in the UK and subsequently have had to go to pakistan for a temporary contract for the next two months. The month where i didn't earn was October 2009 as i was looking for a new job. I will have earned November and December in Pak rupees.

The GBP equivalent of these last two months comes out to be better than the UK pounds earnings.

So my question is will the home office consider these in my best 12 months?. Will this work?

I can supply a detailed breakup of the earnings if required.

Maintenance Funds - Tier 1 (General)

Hi

A quick question:

It is said that-

You must have £2,800 available funds for yourself plus £1,600 for each dependant accompanying you in the UK This money must be held in your personal bank account for at least 3 months before the date of your application and not fall below the required amount at any time during that period.

Is it necessary that the 3 months period should start from 1st of every month or it can start from any day in the middle of any given month.

For example:

Can a 1st month for maintaining the balance start from 16 Dec- 16 Jan
2nd month from 16 Jan - 16 Feb
3rd month 16 feb to 19 March

OR should it be the first day of every month??

Thanks in Advance.

Hi there,

I am currently residing in the UK under Tier 1 General Migrant as from Nov 2008 valid until Nov 2011. I arrived in UK in Jan 2001 under student visa. I then got work permit on Oct 2006. Then changed to Tier 1 General in Nov 2008. I recently got married in UK in 21 Nov 2009. My wife is currently in the UK in the student visa valid until April 2011. She entered in UK in Sept 2007.

I want to transfer my wife's student status to be my dependent. We have got the marriage certificate issued in UK. Can you please advice which form do we need to fill up in order for my wife to change from student status to my dependent. Also kindly let us know what documentations are required and please provide the website links.

I heard from a friend that change of status cannot be done within UK. I am not sure if this is right. We are both from Nepal. If the rule changed where in the Home Office website can we see this?

Please advice and thank you in advance for your help.

Best regards.

Working Holiday Maker Transition - If Any!?

I applied for Working Holiday Makers visa from India back in January 2006 and I was refused and I appealed twice and later won the case after two years and came to the UK sometime in August 2008. Since the day I arrived here, I have an year and a half until my visa expires - in Feb 2010. I have worked for almost an year and have spent time on holidays for about 4 months. Now, is there any other option I have to apply for another visa an work in this country; as I have been in touch with some prospective employers who are willing to employ me on a good pay scale on condition that I should be make myself eligible to work in this country - fair enough.

I could remember something that I have read at that time whilst I was applying for WHM back in 2006, that, on completion of 2 years of visa as WHM, I will be automatically eligible for HSMP- which now is scraped with the Tier 1.

When my appeal was allowed, it said that there was a material error in the law that was applied whilst the decision was made to refuse my visa.

Could I request the HO to retrospectively apply the HSMP rules and request them to issue me a visa(either HSMP or Tier 1 General)

Would be very helpful if someone could shed some light on it.

Thank you.
I applied for my T-1 in February 2009, a month before the Masters requirement was introduced on the 31st of March. I am confused by several recent additions to the guidance.... It seems that now a Masters is required for anyone wishing to extend their T1 if it was originally granted after the 31st of March.

This contradicts the riginal guidance in place at the time of my application last year.

I submitted my application and it was considered under the old rules - is it possible that I would now need a Masters to extend my T1?

Many thanks..

Hsmp Extension As A Dcotor Advice Please

Dear all

I was on HSMP from Nov 2007 till Nov 2009 which didn't have any restrictions. I have just had my extension as Tier 1 back with my passport stamped as ( no employment as Doctor in Training)!. I thought that doctors who were granted HSMP before Feb 2008 are allowed to seek jobs as doctor in training when they extend their visas as Tier 1, is that right?
I have just checked the Immigration rules on UKBA website and I quote from paragraph 245T "no Employment as a Doctor in Training, unless the applicant has, or has last been granted, entry clearance, leave to enter or leave to remain that was not subject to a condition restricting their employment, whether that is employment as a Doctor in Training or otherwise, and has been employed during that leave on an NHS Foundation Programme or as a Doctor in Training."

This came to me as a surprise as I am in training job and was hoping to make an application for training job within the period for national applications within the next three weeks, would an appeal help ? What is the best way of getting this sorted before Christmas? Calling them would not be of any help (If I am lucky to get through) I don’t think. Has anyone been in similar position?

Your advice is much appreciated

Thanks

Dear All

Hi I am going to apply for the extension soon.
I obtained my HSMP in JAN 2008.

During the first stage to claim english requirement points I showed a letter from my college stating that I have completed my course in English language and I was granted point at that time.

Now I have to claim these points again I am not sure do i have to send the same letter again (dated jan-2008) or do I have to provide the new evidence.

And same for my bech. degree.
Some people says that i should send the degree docs again and some says I don`t have to as no need to send the docs which I already have send first time to obtain HSMP.

What should i do??

Please help me.

Hi,

I am self employed and planning to apply for tier 1. Since the required documents for the self employed is pretty confusing, I could use some help from you guys.

If I apply in December, then I am required to show earnings for the period Nov08 to Nov09. My tax return papers will only cover till March09. So thats not very relevant. Also, since I am the sole owner of the company and all the company profits are my earnings, I don't really have any monthly drawings and therefore no personal accounts. What I do have are audited balances sheet for the said period, business bank statements, letter from the auditor saying the whole profits belong to me and copies of purchase orders from my clients. Will these suffice as proof of earnings??

Thanks.

Tier 1 (Hsmp) Extension Approved

After a very stressful couple of months I received my visa today. My case was actually very straight forward as I met all requirements however I just had such a hard time receiving my documents for evidence due to the postal strike and getting the run around from my bank in America saying they would send a letter/with signed stamped statements (because I have online banking them) and me chasing them for over 3 months to actually receive them which by then I needed updated documents...

On top of the craziness I went thru with the bank, postal strike and payroll admin from my company when I finally received everything at the very last minute the courier van broke down and even though I'd paid for overnight delivery it was delivered not on Oct 30 but Nov 2 which put my maintenance funds out of date.

It took another 2 weeks to receive updated statements with a letter from my bank in america but I went ahead and sent them with a letter from the courier explaining their mistake.
And asked them to please consider the updated information.

Thankfully they did. I know I got really lucky as it's up to the caseworker but I'm writing this message just in case anyone is in the same situation that there is hope.

Good luck to everyone who is in the process of applying now!

Hsmp Slots+Dependants Funds ..help Needed..urgent

hi all,
i have alot to ask pls be patient with me:

i want to book a slot in jan 2010 for highly skilled (general) initial application how and where can i do that .. which number to call and do i need to pay any money online or by phone if i want to book the slot for jan2010. what details to keep handy when i call them.

one other query: my wife has no bank account and she does not work either. so is it fine if i have 1333 pounds in my bank account for the last 3 months before application and can i use my bank statements as a dependant funds proof for her as well.

i was very confused by the following statement from the home office website:
The evidence provided can relate specifically to the dependant or it can also include evidence for the main applicant which has not been used as evidence of funds on the main applicant's own application or that of other dependants.
(this is from the dependants section)

what i could understand is that i cant use my same bank statements for dependant manitenance funds then if that is the case will i need to apply for the dependant later if my application is sucessfull.

but when i applied for psw i submitted only my bank statements for my dependant and myself with 1333 pounds in bank for the last 3 months. will it not work like that in hskilled.

pls suggest and guide me.

thanks and awaiting your replys .... david

Is Full Time Study Allowed In Tier 1 General? What Should I Do?

Hello, I sent in an application for the Tier 1 General since September 2009 and it was refused on the grounds of maintenance. It is presently under administrative review as the information required - length of time of funds were held - had been provided but was overlooked. I am hopeful that this decision would be overturned.

A question has now arisen, in that during this time (11/2009) I was accepted for phd with full funding at a uk university - I am now uncertain as to what to do?

1. Should I withdraw the request for admin review - original refusal remains on passport - and then apply for a student visa? (would my chances then be slimmer to get the student visa with the refusal? - especially as I was originally applying to work)
2. Should I allow the original decision to be overturned and then give notice that I wish to apply for the student visa instead? How do I do that?
3. Or is it possible to study full time with the Tier 1 General (assuming the original decision is overturned)? In that case - if my studies go beyond 3 years - can I switch to the student visa from a T1G then without problems? Guidance (http://www.ukba.homeoffice.gov.uk/sitecontent/documents/studying/t4-qanda-students) says this is not possible.

Thanks in advance for your advice.

Kind regards

Hi all,
For an initial application on Tier 1 general, would the HO accept a duely completed P11D Inland Revenue form from an employer for a particular financial year, detailing value of company car and fuel benefits ( benefits in kind as always called) as part of the earnings?
