i am new to forum <br />
pls help me as i am in big dilemma<br />
i applied initial hsmp application on 1st april 2006(no proof of posting i have now)so i asked for sar from ukba to know what info they hold about my application. they send me letter detailing that my application was recieved on 4th april 2006 and they dint retain proof of posting so they have no record for my application date. i used form version 04/05 and which was valid before 3rd of april 2006. now accaording to HSMP JR if i applied before 3rd april i can apply for ILR but as there is no proof how can i proceed further?<br />

		<description><![CDATA[I am starting this topic for  all of us who are on the route of applying ILR under 10 years long residency. As we all know 10 years in the UK specially as university life and working and living here during our 20s and 30s is creating an attachment to the lifestyle of the uk and we may regard UK as our home. However HO doesnot seem to take this in account as strong human rights ground so as to grant ILR.<br />
Professionals do believe that  people staying here for 10 years do have human rights ground and even if ILR is refused on gaps or break issue,it worthed to try on human rights basis but examples of cases are not discussed on this forum.<br />
Although,each indvidual case has its own merits but as 10 years rules are generally excersied by students;we all have many things in common e.g age ( average mid 20s to mid 30s), single and even if married not to the british citizens,qualified with British degrees and probably contributiong to the economy by working part time. Have travelled back home during this 10 years few times and therfore no significant risk of life if have to go back .<br />
<br />
Could we all please share our thoughts on what  may constitute strong human rights ground for 10 year ILR ,obviously its different from those of asylum seekers. May be right to private life has to be excercised.<br />
Its always best to know and prepare our case handy under Human Rights grounds as well Just incase we were refused ilr beacuse of not meeting the rules (gaps,breaks etc.)<br />
Lets put our thoughts forward.]]></description>

		<description><![CDATA[I applied for ILR under 5 year rule following on a work permit and was granted the same last week<br />
<br />
My case had not other complications except for the fact that I had about 225 business absences abroad out of which about 120 odd were for business visits.<br />
<br />
I went for same day service through a solicitor. The reason I went through solicitor was because I wasn't sure how the absences would be treated by home office. I had read at a number of places that business absences won't be counted toward 180 day limit but wasn't sure. I got more nervous when one of the solicitors said to me that same day service wouldn't work in my case. <br />

I then went to a different solicitor who was quite experienced. He assured me that there were no issues in my application and was quite happy to apply on my behalf and he got the ILR through same day service.]]></description>

		<description><![CDATA[At the moment there is a provision in the UK immigration system that, if you stay in the UK for 10 years legally then you can get ILR. It is said that this is  old law based on EU human rigths law(Is this true?)<br />
After the general  elections next year... in the present scenario where Labour is creating Path to Citizenship, Conservatives  scrapping some Human Rights law ; Will this 10 years legal stay leading to ILR is going to stay here or will be scrapped? <br />
There is lots of rumors in the air that it is going to be abolished.If it is going to be abolished how long does it take to actually come into force assuming this is based on EU human rights law(?).<br />

In 2005 my visa was expiring on 31 January. However, whenapplying for the course I have not being advised of changes in immigrationregulations that do not permit spending more then 2 years on short coursesbelow degree level (I was doing such courses for quite a while). I applied bypost 4 weeks before the visa expiry date and got a refusal dated Friday 4February, as course was not eligible for my visa extension. In refusal letter Iwas given a opportunity to notify &#1053;&#1054; of any reasons why I should be allowed to stayin the UK. I bought a new course and on 10 February sent a letter to theHome Officer explaining my situation and reasons to stay in the UK.The extension visa was granted on 30th March 2005.&#160;<br />
<br />
Could you please advice, what is the legal status of thenotification I sent to HO after my visa was refused. Is it appeal, newapplication, variation application, admin review or something else? References to the Immigration Acts, Rules or Instructions will be very useful.<br />

Woner if someone can help me <br />
I will apply for Ilr in june under HSMP judicial review. <br />
<br />
I get paid through an umbrella company who does my payroll, Payslips and P-60. However i get work from differnt agencies and all my agencies pay me through my umbrella company. <br />
<br />
I'm confused as to who is my employer. Is it the Umbrealla company or the agencies who find me work. Also i get paid during term time only(when schools are open, 9 months in a year) as i work in education sector. Will this be a problem for my ILR. <br />
<br />
Are there anyone whith similar situation. <br />
Plz help Im starting to organise all my paperwork and am really confused. <br />

My husband has got his HSMP Visa in  July 2006 but he entered the UK only in July 2007.<br />
and after that he has only about 50 days of absence in total till now.<br />
<br />
I know its too early to ask, but when his HSMP is about to expire in july 2011 will he be eligible to apply for ILR beacuse he was not in the country for the 1st one year of is visa.<br />
And if he is not eligible, then should he re-apply for Tier 1(G) visa?<br />
Will his qualification period start from the begining or will is previous 4 years in HSMP be considered as part of continuos stay for 5 years.<br />
<br />
What I would like to ask is if the need arises that he has to apply for Tier 1 Visa again then will he be able to apply for ILR after about 1year considering he stayed in the UK under HSMP previusly for 4 Years?<br />

I have completed 5 years in uk in feb 10. I was on work permit sponsored by Company One till 10 Jan 2007. I went to India on 8th Jan 2007. Company Two (job appointment letter dated 14 dec 06 stated date of joining as 13 feb 07) processed my visa on 19 Jan 2007 and posted documents to india. Entry Clearance obtained by Me from India on 7 Feb 2007 and i returned to UK on 11 Feb 2007.Currently on HSMP since April 08. All other documents are complete.<br />

Questions : IS IT POSSIBLE TO GET ILR NOW ?? HAS ANYBODY YOU KNOW BEEN THROUGH SUCH A CASE?? WHAT WAS THE RESULT?? <br />

however from reading other people's posts they are still being accepted in Liverpool..<br />

Can anyone tell me which form I need to complete for ILR application?<br />
I was on the student visa for 9 years until last october, after that I have been on PSW visa. This commencing July would be the 10th year of my stay in the UK.<br />
I contacted the home office and they said I have to use SET(0) form but that category excludes people on PSW visa. <br />
<br />
If anyone is in the same situation as I am or have applied for ILR, please let me know if this is the wright form.<br />
<br />
Also, I have a sister who's been on the student visa for 10 years. Can she use SET(o) as well?<br />
<br />
Any help would be greatly appreciated!!!<br />

First of all our sincere thanks to each one of the members who are here to help each other with which we got lot of queries which came to our mind cleared. All 3 of us -myself, my wife and son got the ILR approved and stamped. We got the family group appointment booked in Solihull PEO for 9th of March 2010. The appointment time was at 11:15. But we reached there by around 9:45 and got the security check done and got the token issued. Waited for 5 minutes and was called in to a counter where i was initially asked to submit all our passports, application form. Then the following documents were asked.<br />
<br />
1. Present employer letter stating start date and certifying its a continuing job<br />
2. Life in the UK test certificates <br />
3. All the WP/HSMP/Tier1 approval documents<br />
4. Marriage Certificate<br />
5. Birth Certificate of our son.<br />
6. last 3 months payslip (should be signed and sealed by your payroll department if you are taking printouts of soft copy salary slips)<br />
7. last 3 months bank statements for your salary account. Here when you take it try to highlight the salary credit for the salary slips you are giving so that they can easily get it verified.<br />
8. All 4 yrs P60s and P45s.<br />
<br />
After 5 minutes they gave all the documents back and said its approved and asked me to make the payment by card. But due to Industrial strike they did not have enough staff to get the stamping done. So once again verified our address and contact nos and promptly gave a call yesterday afternoon to update they are dispatching the same by special delivery which we received it today morning. The staff were very helpful to give right direction on what has to be done and was very friendly. <br />
<br />
Hope the following details will be helpful for others. Pls do note that the PEO office in Solihull is not that big and hence you need to really know the post code very well. People who are driving can put your car in the M& S parking or the town centre parking. It will be easier for asking where is the John Lewis showroom and its a red brick building just 100 yards away from the showroom door. The earlier you go the earlier you can complete the process and come back.<br />

I''m posting this question on behalf of my Brother.<br />
He is a Sri Lankan and Came to UK on September 1995 to claim refugee status. But his case was rejected and he had been granted work permit and also since then he was given visa or what ever the permission to stay every 6 months. He has never taken any social help and had been working legally and paying his taxes. <br />
<br />
Ok so lst year november 2009, after completiong of his 14 year stay he applied for the  ILR along with the Fee 800 Pounds, along with all the supporting documents to shown he had been living in UK for the past 14 years, but he didn't include any cover letter and he didn't go throuhg his lawyer.<br />
<br />
A week back he got a reply from the Home office(Uk border Agency - Croydon), stating his application was rejected and giving him the option to leave to Sri lanka. and also he cannot appeal on this decision.<br />
Also, they have asked him to contact the home office before 13th of march.<br />
<br />
Mean while, he got another letter from the UK border agency(liver pool) stating that they have taken his case again(from the back loged cases) and has been assigned to a team in lever pool and requesting him to send some documents(Birth certificate/passport or some id along with some photos of him and any dependents).To which he replied with his photos in few days.<br />
<br />
So we are confused now, how can this 2 process be separate? Doesn't the 2 UK border Agency has any co-ordination. Is there any other way he can appeal based on his 14 year stay? We have heard people saying," We jsut sent them a lettet explaining why we can't go back to sri lanka and any other convincing reasons", Is that something that he can try through his lawyer?<br />

Please  any adivce would be greatly  appreciated. <br />

I came to the Uk in Jan 2007 on a 2 year working holiday visa and then got married to a british citizen  2 years later and got a spouse visa... I will be be applying for ILR in a few months and was wondering .....<br />

1) If our application will be affected by the fact that my wife has not changed the surname on her british passport since we were married, but all her other documents are updated i.e driving licence, bank details etc...<br />

2) If i will be able to apply for naturalization after  getting ILR as I will have been in the country for over 3 years....<br />

Firstly, am I ok to include payslips & current account bank statements from only a 4-5 month period? Do I also need to include any savings accounts statements or is it sufficient just to show current if it is clearly apparent that we can maintain ourselves financially with the funds that come into this account?<br />

Are the quantity & types of supporting documents for showing our permanent living together, sufficient to satisfy the requirement as stated on the visa form?<br />
<br />
What is the current average processing time for this type of visa? The official line is that 95% are processed within 6 months. This seems quite a considerable amount of time.<br />
<br />
Appreciate if I have missed anything important with respect to documents needed for ILR, obviously also taking into account my wife's Life in The UK certificate, photographs & passports (her's & mine).<br />

		<description><![CDATA[My husband is from Burkina Faso (west Africa) and came to the UK on a spouse visa nearly 3 years ago. We have a 6-year-old child together. Our marriage started deteriorating the minute he set foot in this country, for various reasons, personal and cultural, and after 15 months i asked him to move out - before the 2-year co-habitation requirement, and therefore jeopardising his stay here. <br />
 <br />
He moved in with a friend, where he lived for free for nearly a year and a half. Despite the situation, I supported his application for a discretionary extension of his visa, which he was granted. I did not want to separate father and child, despite the fact that his level of involvement was always less than satisfactory. Since his arrival in April 2007 he has been unable to to find any regular work, not even in the most menial jobs. He has been teaching drumming here and there for peanuts. <br />
 <br />
He finally had to move out of his friend's, when reality hit him, and he had to get money somehow. Needless to say, he is struggling badly, and it is clear now that he blames me for the state he is in. That was the straw for me that broke the camel's back and I have now filed for divorce. I myself am on benefits and am only slowly recovering from what has happened in the last 3 years. <br />
 <br />
He is due to apply for ILR in October, and my question to you is: what are his chances of succeeding? I have no intention of supporting his application, and will not speak favourably of him if asked. I am also thinking about ringing the home office and inform them of my filing for divorce, as I want to encourage his return to Africa. Our child has become a pawn in this conflict, and there needs to be a clear end to this. I do not think he came here with any intention of facing the reality of life here or becoming independent. The man is 47 years old. <br />

Any thoughts, anybody else in a similar position? <br />

		<description><![CDATA[I sent my Set(o) application in Feb 2010, based on 10 years long resident ILR.<br />
<br />
it is a bit concern about the criminal recorde in these 10 years.<br />
<br />
I had a couple of parking tickets, wich I paid all of them.<br />
and, one speeding ticket, I forget then I moved house a couple of times after. <br />
but, after 2 years of the event takes please, I received, a court fine of 175 GBP issued long time ago. I paid that in the next day.<br />
<br />
My driving licence is clear, nothing on it. and no point deduction ect.<br />
<br />
when I filled the set(o), I said NO on criminal recorde.<br />
<br />
Could someone please tell me. is it important? will this be a big problem for my ILR application?]]></description>

		<description><![CDATA[As a evidence to continuous stay under workpermit, what does HO needs to see. Is it the actual workpermit approval letter adressed to employer or Limited leave to Remaim (LLR) apporval letter.<br />

If workpermit letter, as this is addressed to employer they keep the original and I have a copy. Is this OK with explanation in cover letter for HO or should I try to get the original copy from the employer.<br />

		<title>Long Residence (14 Yrs) Rejected No Appeal</title>

		<description><![CDATA[I am devasted, I have just found out my Long Residence Concession (14 yrs) has been rejected<br />
with reasons that are perplexing.<br />
<br />
The letter states that there is no appeal on this decision, and that my passport has been forwarded to the nearest local enforcement, and I should make arrangements to collect my passport from the local enforcement within a week.<br />
<br />
i) I am told that an appeal can be lodged, but I am a little perplexed when the letter from the UKBA states there is no appeal.<br />
<br />
ii)  How much time do I have before the police come knocking on my door to take me to a detention centre?<br />
Will a notice of removal be issued before this occurs?  I am assuming this will be sent to me directly?<br />
Or will be this be sent to my lawyer or both of us? <br />
<br />
iii) In the event that I go to the local enforcement agency to collect my passport, while my lawyer launches an appeal, is this a good idea?  Or will I be arrested if I turn up at the local enforcement agency (and sent to a detention centre), without my lawyer contacting them first that an appeal has been launched?  Or will this not make the slightest bit of difference (my lawyer contacting them that an appeal has been launched)<br />
<br />
Basically I am trying to find out my options when a Long Residence Concession is rejected ( I am desperately in need of finding out the answers to these questions as soon as, before meeting my lawyer).<br />
<br />
The reasons given for my rejection were: <br />
<br />
i) I do not have a comprehensible grasp of the English language.  Since I made my initial application prior to the KOL test being made mandatory, my application was lost and I had to resend it, the application was sent back stipulating it be resent with the KOL test result, however my passport is of when I was a child, and the KOL test centre refused to accept it as suitable ID, and I was told in such a scenario the UKBA should let them know in advance I should be allowed to take the test, needless to say I had a short window of opportunity to resend my application, along with the statement from the KOL test centre as to why I was not allowed to take the test.<br />
<br />
ii) That there is no evidence I was in the country for a one year period! Which still doesn't affect the 14 yrs Long Residence Concession even if that were taken into account (even though I was in the country within that one year period).<br />
<br />
iii) That my passport expired when I made my application (which beats the whole purpose of the 14 year Long Residence Concession).<br />
<br />
If anyone has had any similar experience, I need to know:<br />
i)  If the local enforcement are the organisation charged with coming to arrest me?<br />
a)  What is the process involved?  How soon do they come to my front door after being issued with such a disheartening letter?<br />

		<description><![CDATA[I have sent a letter to HO back in 2002 using royal mail recorded service.I have the proof of postage slip with unique tracking number in it.However,when i enquire about that letter with HO recently,HO said they have no records of the letter in their system. I tried tracking on royail mail website but couldnot succeed and  upon calling them  i was told since it has been many years they cannot confirm the delivery now over phone and advise me to try cryodon postoffice if they hold the record ,the chances of which are slim.<br />
My question is even my letter is lost in the system,can my proof of postage is enough for HO to accept the loss of letter lies on their part.<br />
Is there any other way to  find out if my letter was actually delivered or not?]]></description>

		<description><![CDATA[Hello all. I am posting in hopes of getting some reassurances. <br />
I am a USC and I am on FLR(M). I have been married for 17 months to a UKC who was disabled and housebound for many years. I have been a stay at home full time care giver to my husband. He passed away on 3 March. I all of a sudden find myself completely unsure of what will happen to me next. I do know that as a widow of a UK spouse I can apply straightaway for my ILR. I am very concerned though about finances. Since I have been a carer, I have not earned much money of my own ( I have done some part time video editing at home) and now I am hearing that since my husband left no will, I may not have access to his bank account even though I am a signer on it. This home is the only place I have memories of my beloved husband. I never saw him any where else, never went any where with him other than the ambulance ride to the hospital just before his death. I can not leave our home, I would be devastated. We've filled it full of so many memories and it's all I have left of him. I have no idea what the requirements will be in order to qualify for the ILR as a bereaved spouse. I can't say I have ties to the community as I could never leave home except for short visits to the shop for supplies. I have my husbands family here who I have grown quite close to and a newborn step grand daughter. I do have the funds to pay for the visa, just not sure about being able to get it. Can someone help to put my mind at ease?]]></description>

Just a quick question. we are waiting for ILR under 14 years rules. My 2 kids are British Citizens. However, we still have no sign about our application. Recession hit us very hard as my partner lost his job and self employed business made nothing last few months. Money had ran out for solicitor fees and HO applications. We are now struggling to pay out rent and council tax, nevermind other bills.<br />
Do we able to get any help from government but without negative impact from our application? Borrowing more money is completely out of question now.<br />

My partner is here on WP (on deputation from an Indian company) and is paid both here and India.<br />

His UK payslips dont show the tax and NI components. We have the P60's though for the previous 2 yrs.<br />
<br />
We have spoken to a solicitor and he says it is going to be a difficult case. We have a letter from the employer confirming his gross pay.<br />
<br />
Has anyone been in a similar situation? What other document can support our application? <br />

		<description><![CDATA[I am helping some friends who are applying for <strong class='bbc'>ilr</strong> after five years  as work permit holder and his wife. This part is straight forward. The problem revolves around their two sons who arrived 4 and half years ago , the first was 16 and the second 14. They are now 18 and 20. There dependant visa gives them leave to remain until 2011. <br />
Plainly they are over 18 and so cannot be added to the SET(O) of their father. The question is, do they apply separately when they have competed 5 years on their own SET(O) . Do they apply on a SET(F) as family members . Do they apply on separate SET(O) forms at the same time as their parents. The boys still live with their parents are dependant upon their parents although work parttime , are unmarried and want to remain in the UK . <br />
It seems to me that if the Homeoffice intended that these boys would not be allowed to remain after reaching 18, it would not have given them leave to remain until they would be 22 and 20, and have completed more than five years in the UK.<br />
I am sure that this is a common problem with a simple answer, but then nothing is ever that simple when the UKBA is involved.]]></description>

Firstly a big thanks again to everyone who had responded to my previous query couple months back.<br />
<br />
Now back to the topic - my dad has his 'Visa Settlement Spouse/CP(KOL REQ) <em class='bbc'>mum's name</em>' (presumably same as spouse visa) valid from 04/03/08 - 04/03/10. He arrived in the UK on 15/03/08. This means that his visas will expire 11 days before he hits his 2nd anniversary of being in the UK to be eligible to apply for ILR. The question is - since the application can be made 28 days before his 2nd anniversary of being here - does it matter that his visa expires 11 days before he reaches 2yrs or will he have to apply for extension (extra cost and hassle!) first to cover the 11 days then be eligible to apply for ILR?<br />

i am a student and living in uk for 10 years. all my applications were on time for extension. there were never any objection but last time my application was returned back with all documents as invalid because i send wrong photographs. my visa was going to expire on 28/02/2009. i send my application on 20/02/2009 and than received it back on 05/03/2009 with a letter stating that application is invalid and if they did not receive my application with in 28 days , than they will refund my fee.they also send a label for return address. i send that application on same day back and they received it on 06/03/2009. <br />

I applied for HSMP in 2006, and the stamp date was 16th June 2006. Was not sure if i applied before 3rd April 2006 until i found a credit card statement which has a debit of £315 pounds for work permits uk on the 3rd April 2006 ( which means i applied before 3rd April)  and another debit for £335 in june 2006. I Dont have the approval or the acknowledgement letter UKBA sent me. <br />

Also the last extension i got leading me to 10 years was from a college which is taken off from tier 4 but when i registed and got visa there was no tier system and that college would have been registered thats why i got three years visa. do i have to worry about this or you think it is okey as at that time there was no tier 4 system . PLEASE advice<br />

i would first like to thank all who have guided me for the last one year through this forum.<br />
<br />
my case in brief, i was given a 5 year work permit on 31 december 2004, so in december 2009 i applied for my ILR through a solicitor. my case went for the same day review (PEO) but was held back as a 'refferal case'. The complication in my case was that i had spent a straight period of 204 days out of the UK in 2008 COMPLETElY UNPAID. plus another 190 days FULLY PAID as holidays (none of these was more than 90 days at one time) so a total of 394 days excluding the days of travel.<br />

i have today (after 7 weeks almost) got a reply from Home Office stating that my application has been refused by the 'secretary of state' however they have exercised discretion to aggregate the days i was out of UK and i can apply and get my ILR in June 2010 <img src='http://www.ukresident.com/forums/public/style_emoticons/default/smile.gif' class='bbc_emoticon' alt=':)' /> yipeeeeeee! but i have to still stay with the same employer and can not travel and stuff. <br />

My wife has a UK spouse visa (she got an extension after 2 years as her english wasn't good enough).  Do you know if she can apply for citenship even though she doesn't have residency (as far as i know if you are married to a UK national you can apply for residency after 2 years and citizenshipn after 3 years as long as you pass an esol course or life in the uk test).<br />

		<description><![CDATA[Im a newbie here. my friend is a british citizen and bought his family 3 kids and wife september 2008. his daughters now aged 20, 20 and 17. they got the visa on july but came here September 2008. now they will complete 2nd anniversary on  september then they can apply for ILR / PR? now problem is their visa is expiring befire 2months of the 2nd anniversary which is on july. now what he has to do? apply for an extention then re- apply for ILT? what will happen to the 2 doughters aged over 18? will it be any problem? some one said his wife and 17 years old girl can apply for ILT on july. but 2 other girls gave to apply for extension and apply for ILT? ( double expences) is it tru? any advice on this matter would be much appriciated.<br />

Adil Applied for settlement spouse visa and was issued see attached, Indefinite leave to enter, we did not think he Would be entitled to this as he has never been outside of Morocco before, he has not passed the Life in England test and we have only lived together for 22 weeks on occasions when i visited him in Morocco.<br />

He arrived in UK 16 Dec 09 and we called the home office in Croydon who told us to send photocopy's of his visa and passport to them. They called today and told us that this visa is correct!<br />

Just a couple of quick questions for a friend who is having marital issues at the moment.<br />

He got married in pakistan in 2002 to a woman, who then came to UK via a spouse visa, then after one year in UK on spouse visa she received ILR and is now settled in UK. I did try to correct him that its after two years of spouse visa that ILR can be applied for but according to him, in 2002, the rules were different, it was only after one year of spouse visa that you could apply for ILR- is that true ? <br />

He said that they never had a Uk registry in UK, since the pakistani nikah was already recognised in UK and that the spouse visa was obtained as a result of the recognition of the pakistani nikah.<br />
<br />
Anyway, the marriage broke down in 2008 and he obtained a pakistani divorce from pakistan in June 2008 via judical proceeding i.e the union council, and the divorce was granted. He says that since the divorce was obtained via the union council in pakistan it is also valid in UK as his (now ex-wife) still holds a pakistani passport to date therefore she is still in UK under ILR. Can anyone shed any light on this, I did say to him that he must obtain a UK divorce as no pakistani divorce is recognised in UK, I may be wrong - can anyone shed light on this ?<br />

Question is that now that she is divorced via pakistani divorce, does that mean that her ILR is automatically cancelled and she has to apply for some sort of new visa to remain in UK ?<br />
<br />
My friend has re-married in pakistan last month, he is now going through the spouse visa process for his new wife, do the UK visa authorities hold a record in their database of his previous marriage in 2002 and the application  for spouse visa and ILR for his first marriage ? or does he need to explain that to them all over again ?<br />

I have recently received my ILR based on a continuous 14 years overstay in the UK. I received my old passport back with the ILR sticker (passport expired Feb 1993).<br />
I am in the process of making a new passport and hoping to travel and see my parents soon hopefully. But to avoid any hassle and problems at airports, I believe it's better to transfer the ILR sticker to the new passport, hence the request for the NTL form.<br />
I read about this very well and i know it's not mandatory but the fees are a joke: £165 by post. £515 in person. To be honest, i am leaning towards sending both passports by recorded mail but someone told me that you might wait for months. I have already suffered in excessive waiting time in dealing with my case (3 years an half since i sent my case to the HO), and don't want to experience anything similar. If anyone knows or heard anything about the time expectancy in dealing with NFL, i would like to know please.<br />
Maybe it's better for me to make an appointment and go to the HO even if the fee is way more expensive?<br />

Until today, I have been under the impression that I will be able to apply for ILR under the 14 year rule on the 6th of March (I first came into the country on the 6th March 1996).<br />
However, reading a particular document attached - Long Residence IDI final...it states that I am not eligible under this rule because I was issued with the IS15B on the 27th of December 2007.<br />

Is that right? Or have I misunderstood this?<br />
<br />
Does this mean I have no further right to apply under the Long term residence rule?<br />
<br />
Much help appreciated.<br />
<br />
(This is quite scary as my current immigration lawyer has been advocating this ILR application for 15months now, it worries me that he didnt know anything about 'stopped clock' rule!)<br />

I got my spouse visa back home for 2 years and 3 months. Some people in forum write that if somebody have spouse settlemet visa doesnt need to apply for ILR. I remember that i applied for spouse settlement visa back home. But on visa in passport <strong class='bbc'>not</strong> written spouse settlement. Written <strong class='bbc'>Entry Clearance. Multiple. Spouse of...</strong> <strong class='bbc'>And No resourse of public funds</strong>. Is it just spouse visa? Or spouse settlement visa? When i applied for spouse visa i filled in form Vaf4. <br />
I am a little bit confused.  Can anyone tell me what type of visa i have( just spouse visa or spouse settlement visa)?<br />

My wife has got her indefinite leave to remain in the UK. Since then she has been registered as severely sight impaired (blind) with the local council. My wife will be applying for her nationality at the end of this year. Is my wife eligible to apply for benefits, i.e. Disability Living Allowance (DLA).<br />

There is no restrictions on her indefinite leave to remain in UK (it does not say no recourse to public funds), however would applying for Benefits have an affect on her Nationality application. <br />

I have a quick question I hope someone here can help me with. <br />

My wife is applying for ILR next Friday in Croydon. We booked the appointment online. Now, I obviously want to go with her but do I need to tell them I'm coming to the appointment too? When booking online, there was the option to add people to the appointment, but these would be people part of the "family group", dependents that are also applying on the same application form. I'm not appling for ILR as I'm a British Citizen myself. My concern is that, there is something on the UKBA site that say that "only people who have made the booking can attend", or something like that. <br />
<br />
So will it be ok for me to attend the appointment with my wife? A lot of my information is on the form and they'll need to see my passport, for example. I'm her husband so I'm guessing I do need to be there. Grateful for your advice.<br />

Since we have a baby due in August we would like to get the KOL out of the way prior to that rather than having to deal with both post baby but this has raised a few questions which I'm hoping someone may be able to assist with. &lt;BR&gt;&lt;BR&gt;1.&nbsp; The latest study book seems to be dated March 2007.&nbsp; Does anyone know if a new one is planned?&lt;BR&gt;&lt;BR&gt;2.&nbsp; Given how old the latest study materials are, how do the test centres deal with out of date information.&nbsp; For example with regard to the legal age for buying cigarettes would the test ignore this topic, expect you to enter the obsolete information from the study guide or expect you to know the correct/updated answer?&lt;BR&gt;&lt;BR&gt;3.&nbsp; There was a suggestion some time ago that it might be necessary to complete the KOL within 1 month of applying for ILR which would clearly ruin our plans to get this out of the way prior to the arrival of the baby.&nbsp; Has this progressed at all?&nbsp; If the HO did introduce such a restriction is it likely that those who had already taken their tests would be exempt from such a requirement?&lt;BR&gt;&lt;BR&gt;Thanks for any help&lt;BR&gt;&lt;BR&gt;Sara&lt;BR&gt;]]></description>

I know this question as been thrown out here a couple of times, but I still need help. The Policy Document of the HSMP Forum Judicial Review does cover a lot of ground, but when you are thinking of applying for the ILR, it is best to be certain.<br />
<br />
Background:<br />
I applied for the HSMP in 2004, and got my approval letter in September 2005<br />
I came to the UK in November 2005<br />
The initial visa was for a year and this was renewed in November 2006, extended for another 4 years to expire in October 2010.<br />
<br />
Do I qualify for the 4 years (total rule), in other words, can I apply for my ILR now? Or do I have to wait until September 2010 thereby completing a total of 5 years?<br />
<br />
Sahirzz asked a similar question on the 8th of February which Ms S Riaz answered sufficiently based on the dates Sahirzz provided. However, as I applied before 3rd April 2006 for my first application, and even before the 6th November 2006 for my renewal (actual date was 4th November 2006 for the renewal - when my passport was stamped with a 4 year extension to expire October 2010), do I qualify for the 4 year ILR?<br />

I would like to ask you a question on the same subject, I have applied for asylum in 2000, I was refused in 2003, apeal refused in 2006, applied fresh claim 2006, and this year 2010 I was granted ILR under legacy case (not because of my asylum application, but out of immigration rules,I believe it is article 8 due to long residency in the UK), now my question is, could I visit my own country for few days or weeks? my soliciter told me that there would be no problem as this ILR is not a refugee status (in which case I would not be allowed to travel to my own country), but this ILR is due to legacy case out of immigration rules,so there should be no problem for me to visit my country, is this true ?I will really apperciate your reply.Thank you.<br />

Its stated on Worldbridge you can start an application 3 months before you plan to travel, this is what I did.<br />

My wife recently did an "ESOL course Entry 1 with Citizenship Context" at the London College of Economics.<br />
<br />
They have written a very clear letter to her on official headed paper saying that she has sucessfully passed the course.  However due to an administration error the Certificate will be a short while longer (possibly a few weeks). <br />
<br />
My wifes FLR(M) 2 year Visa expires in a few days and she wants to apply for ILR(M) but the application form asks for the Certficate to prove that the course is passed.<br />
<br />
Will the home office accept the letter from the College?    I worry that if we send the letter and the application form they will reject it and keep the £900.   I am happy to send the certificate as soon as we get it but we don't want to apply late.<br />
<br />
I really don't know whats best to do in this instance.   I called the home office help line and even they seemed a bit unsure but went on the safe side and suggested we pay £460 for another FLR(M) extension then apply for the full ILR(M) after the extra FLR is granted and the certificate finally arrives.<br />
<br />
Does anybody have any idea how sensible/flexible the immigration office is about things like this?       <br />

 My situation is rather complicated, but I would need some advice as at the moment I really don't know what to do. I'll try to describe the situation briefly. I'm an EU citizen  married to  an Ecuadorian citizen. We got married in Uk and applied for a coa which was granted. After the marriage we notifed the HO about the marriage, but received no reply. My husband is on a spouse visa from his ex wife who was an EU citizen as well. They divorced after 3 and a half years but he retained the right to remain in this country under the European law of 2006. His visa expires in september 2010 and he has been working in this country and paying taxes since 2005.  <br />
<br />
My questions are:<br />
1) Can we apply for ILR? If so, what form should we use and when can we apply?<br />
2)Can he travel with me to my home country? We need to sort out some paperwork there as well, but I feel that because he has the visa in his ex-wife's name, we would have problems travelling with me.<br />
3)If ILR is not possible, what other options would we have?<br />

		<description><![CDATA[I came to the UK in July 2005 on 2 year working holiday visa. Married in 2007 and got a spousal visa in 2007. I applied for ILR in May 2009 and was refused because my husband did not go to marriage interview with me following the request from HO. Things are really bad between us. I lodged an appeal and the date is next week, but my husband has left me and the marriage is completely broken down. His family has tried to convince him to at least support my appeal, but he is adamant. he has moved out of the house and has changed his number. had i known about domestic abuse rule, i would have used that route because what he has subjected me to was emotional and psychological. i am currently seeking advice on divorce.<br />

my only problem here is i am due to finish my a course in October. is there a way i can apply for a student visa? Or at least a six month extention just to complete my course? I am really in very dire situation and i need all the advice i can get.<br />

i came to the UK in february 2000 as a student and had IGS which expired in april 2009, i applied for the tier 1 general which was refused due to maintenance requirement<br />
as my account went below £800 for a period of 9 days (my account reduced in that time because funds where withdrawn to pay for my wedding costs) although i am married to a british citizen i decided to apply on my own merit as i was seeing some signs of marital problems. he relocated abroad and convinced me to join him. i resigned from my job and left the country in june 2009 to join my husband.<br />
when his violence towards me became unbearable i returned to the country on a visitors visa last month, to try to get my life together again. we are now seperated although he is saying he is sorry, but i know that if i go back to him he will keep violently abusing me.<br />
i attended the appeal and got a letter that it was dismissed based on the strict criteria for maintenance funds, the judge however said if he was the decision maker he will grant the visa.  the letter also mentioned that i can appeal the decision.<br />

i understand that i can no longer reapply for tier 1 because its now a minimum of a masters degree which i do not have, <br />
will i be able to apply ILR or are there any category i can go for?<br />

Our daughter was born in Sep 2008 in the UK and all my family travelled back to India on a family emergency. My daughter hasn't got any visa stamped in her passport as I had to withdraw her dependant visa application.<br />

Finally, if they get ILR, will they qualify for citizenship after 1 year given their absences?<br />

		<description><![CDATA[i am hoping for some help... i have applied for ILR and still awaiting my responce from the home office, i am married and was issued a 2 year spouse visa. i have completely followed the rules within the stipulations of the visa so i should not have any problems gaining ILR. my question is, i have 2 children in jamaica and want to send for them as soon as i can, there is alot of information out there but i want to know the process, do i apply for settlement visa for them both, or can i send for them on a visitors visa and then apply whilst there are over here, i have looked into this and it seems very expensive. my husband and i are still living at his perants and are looking to find a place to live asap, do the UK BA check your accommadation status, as in come to the place u live. i ask this last question as we have 2 spare rooms in the property so there is enough room for them. <br />

will we need biometrics for the visa? as far as I understand I don't think it is needed for ILR but would like to get a comfirmation.<br />

Do my dependents need to go to the PEO? I have seen the FAQs on the website. Probably they do not need to go, but then do I need to book an appointment for them when I book it on line, even though they will not be going. This issue is not very clear from the FAQ. <br />
It is actually very difficult to book an appointment for 3 people on line. Appointments are available for 1 person , but when I try including my dependents no dates are available. Trying over the phone is a big problem as they never seem to pick it up.<br />

I have no problem showing my dad's passport but my dad is not staying in this country for long and I can't be bothered to show my dad's passport each time I register for employment or apply for course. My sister who is older than me has similar visa like mine but she's never been asked to show dad's passport by the employers.<br />

That "six months each year" sounds very vague. It could mean that in any 12 month period you are not allowed to be abroad for more than six months cumulatively. <br />

I have a family friend who I expect to have got her ILR as she came to the UK in May 2004 on a Student Nurse Visa valid for six months, during which time she did her adaptation course, applied for a visa extension in which case a Work Permit for six months was issued, valid till April 2005 after which she applied for another Work Permit which was granted for five years expiring in April 2010. She has been with the same employer (NHS) and has not left the country at any time within this time. Could she have been due for ILR as the initial six months Work Permit may have counted towards her five years residency requirements?. Thanks for a prompt response.</description>

I went shopping today and I used my Ostyer card when I got in the bus. I tried to swipe in twice on the bus machine, but it was not working and the bus driver told me to go on. <br />
A few minutes later, a ticket inspector got on the bus and checked my Ostyer card. He saw I did not touch in my card for this travel. My husband then said we tried to touch in on the bus machines but it was not working. My husband told the ticket inspector to ask the bus driver. The bus driver told the inspector the machine was not working. Then, the ticket inspector informed me to press the Ostyer card again.<br />

I am a British Citizen and my wife is on FLR (M) visa issued in July 2008 which expires on 08 July 2010. She has been in the UK since Feb 2001 on a dependants visa. We have to go abroad for 12 months from the middle of April 2010. <br />
<br />
From what I understand my wife can apply for Settlement visa after 08 June 2010. I just want to know if it would be possible to make an early application, so that we have her ILR before leaving the UK. Otherwise I understand she has to apply for spouse visa again from abroad.<br />
<br />
The only possible argument that I can see for an early application is this;<br />
<br />
I came to the UK on 20 May 1998. Based on 10 yr long residence I went to the PEO on 16 May 2008 for ILR application but the officer asked me to make my application by post. This was because there was an immigration entry stamp missing in my passport and he suggested a few documents to be collected to prove my physical presence in the UK for that time. He said there should not be any problem but he could not process the application that same day. <br />
Sure enough, with a few additional documents I made my ILR application by post. I got the approval in the end of June 2008. Subsequently my wife applied for the FLR (M) visa on July 2008 and got it approved.<br />
Now, had my original ILR application on 16 May 2008 was considered and approved, she would have had her FLR (M) visa done the same day (on 16 May 2008) as we had made the PEO apointments for her as well on the same day but a bit later. The officer who asked me to post my application knew that my wife was waiting to make FLR(M) application after my ILR. But he appologised to her.<br />
She got the FLR (M) visa on 08 July 2008.<br />
<br />
So any chance of making the application early? Anybody has any experience with early ILR application? Please share your thoughts.<br />

ok first question... I have to apply for settlement soon to stay with my husband. Our daughter's visa says she has indefinite leave to remain and it doesn't expire for another 2 years. (yes we haven't gotten around to getting her british passport yet). Do I need to put her on my application form if she is already considered a British citizen? Even when her visa doesn't expire for another 2 years?<br />

When I was applying for my visa back home I put on the application that I would be arriving on April 1st. But my visa was issued for March 13th. I still have more than a week to send my application form in when I work out the 28 days. I was wondering if this was ok or am I pushing it ??<br />

		<description><![CDATA[Hi, My wife's spouse visa is due for renewal in a few months and as required we are now preparing to apply for ILR for her. <br />

I have a couple of questions and would appreciate suggestions/replies/input. <br />

I understand she has to do the Life in UK Test before she applies. What other preparation and documents are required for ILR? For example I had to do my income and expense detail when applying for the spouse visa and than a sponsorship letter etc...what would i need to prepare to submit alongside the application for the ILR??<br />

Second question is that my wife's passport expires a few months after the point when hopefully we would have had the ILR. So I would need to renew her passport and than again have the ILR transferred to the new passport. Now this will result in further hassle and costs so I am considering renewing her passport and than applying for the ILR. However I will apply for the ILR on the new passport but the current spouse visa is on the old passport, would that cause any issues or would i need to transfer the spouse visa to the new passport and than apply?? anyone had a similar experience and id be thankful if somebody could shed some light on this. <br />

I know my question probably is confusing but please feel free to ask and i will try my level best to clarify it as much as possible. <br />

I have an interview for my settlement visa next week, and have just realised that I do not have a full 3 months worth of statements. Thanks to Lloyds, I only receive my statements every 3 months - I called them today and they have advised that sending the statements could take 7 working days (which would be too late).<br />

I have bankstatements for October - December, as well as 3 months worth of payslips. Would this be sufficient?<br />
<br />
I'm calling the bank tomorrow to find out whether they'd be able to print off my statements on headed paper and sign it to verify that it is "authentic", but would I need to do anything else? Would this be sufficient?<br />
<br />
I also have a letter from my current employer advising that I've been in full time employment and will continue to be employed by the company... but my concern is obviously the 1 month worth of information on the statements. <img src='http://www.ukresident.com/forums/public/style_emoticons/default/sad.gif' class='bbc_emoticon' alt=':(' /> <br />

From the internet, it always mentions about the HSMP to the ILR but not many about the pervious Work Permit.  I am sure I am not eligible for the application of the Tier 1 (General) permit at my current status.<br />

I would like to know, if I keep my present status until Aug 2011 (I worked for my current employer since Sep 2006), Would I be eligble to apply for the ILR in Aug 2011?<br />
