		<description><![CDATA[God is great even if our lawyer was an idiot!!<br />

We got it finally <img src='http://www.ukresident.com/forums/public/style_emoticons/default/smile.gif' class='bbc_emoticon' alt=':)' /> update and history for all who may be interested.<br />
My husband was in another EEU country when I met him, he had applied as refugee in another name (not clever don't do it) and had been refused, but because of the country was not sent back, so left with no funds and no rights!<br />

Anyway after we got married, in Amman I returned to UK and got a lawyer to go over all the paperwork to make sure it was ok, they completed it all again for me and said it was all in order dont touch it, hand it in as it is. SO I posted it off to my husband he took it to worldbridge who pointed out 3 ERRORS that he corrected at the time. We then sat back and waited, after about 8 weeks (information states answer normally in 12 weeks) he looked at the paperwork in detail and found that the lawyer had omitted all the info on his refused refugee status. At this point I nearly died and was soo soo worried.<br />

I called embassy to be told by automated answer phone they do not answer any questions on visa's please email, so I did, asking them if they had received the paperwork, as Worldbridge website is usless it said and still does "collected" from the day my husband picked up his passport (it is returned after being copied by embassy as Jordan does not allow other authority to hold their passports) So I then got an automated email saying they did not respond to email before 12 weeks!!!<br />

At this point I was so frustrated I emailed my MP who got back to me in 48 hours, in the mean time embassy had replied saying they had paperwork and were processing it. I told my MP that had reply from embassy, but she was happy to chase it for me. 2 weeks later the visa section told her it was still being processed, we agreed to wait till the 12 weeks were over and she would chase again, which she did this time the process had changed and it was with the home office. SO again we waited while equires were made and the answer came back being processed!! <br />

Anyway about 10 days ago she contacted saying I shud have news soon and she could not tell me any more, as had no writen confirmation. SO we hoped and prayed this meant yes. 1 week later my husband got a call at 10.30 to say could he come to embassy and bring his passport between 8-11 on wednesday or sunday .He asked do I have the visa and was told I cant tell you that...............as it was wednesday we had the long till Sunday when he went in at 8.30 they took his passport at main gate then came back 10 minutes later and told him to come back after 3.30, still no answer so he asked again do i have the visa and she said oooh yes <img src='http://www.ukresident.com/forums/public/style_emoticons/default/smile.gif' class='bbc_emoticon' alt=':)' />:) SO he went back at exactly 3.30 and there it is in his passport and as my husband says I own him now as my name is in his passport lol.<br />

applied 23/11/09<br />
biometrics done same day<br />
passport returnded next day<br />
and visa issued 14/3/10<br />

The long wait and stress is all over now all he has to do is say all his goodbyes, buy ticket and presents and get my wedding dress cleaned <img src='http://www.ukresident.com/forums/public/style_emoticons/default/smile.gif' class='bbc_emoticon' alt=':)' /> for the wedding reception here <img src='http://www.ukresident.com/forums/public/style_emoticons/default/smile.gif' class='bbc_emoticon' alt=':)' /><br />

Here is my story.<br />

I am a asylum seeker and I am still waiting for decision to be made on my case. I am now engaged with one of my relatives who lives in Denmark. The problem is that we have not met yet becuase as it was arranged by our elders but we always talk on the phone and we both are happy with this engagement.<br />
<br />
My question is if I apply for COA, wont HO asked for proves??? I dont have any... I can only get photocopy of her ID card and address, pictures and signature on the application but I cannot prove that we lived together or met with each other.<br />
<br />
Will I get COA application approved? is there anything I can do??? Please help me outttttt<br />

		<description><![CDATA[My husband hands in our spouse visa application in cairo tomorrow. I'm sick with worry about it, it looks so amateurish, and I wish we could have afforded a professional to look over it.<br />
I was just wondering if anyone knew much about how it is in Egypt? Are they known for being tough, or lenient? Also has anyone heard about the speed of their decision times?  I'm flying out there next week with our baby, and wont return until he can come back with us. So if he doesn’t get it, it looks like it will be one looooong holiday.<br />

		<title>Spouse Visa Success!</title>

		<description><![CDATA[After much stress, worry and last minute preparations, I submitted my application for a spouse visa in Cape Town at the VAC on 23 February. I made an  appointment for the Monday, March 1, to submit the supporting documents and have my biometrics taken. <br />
<br />
Got a text the Tuesday saying that my application has been dispatched to the British High Commission in Pretoria and had a call from the entry clearance officer the Wednesday. I was out and returned the call the Thursday- she basically asked me about the reasons for my overstay, why we want to settle in the UK and not SA and about my relationship with my husband and told me that her supervisor would need to look my case over and that a decision would be made that day... (overstayed 18months on WHM visa, worked part of it- see previous posts for full details).<br />
I hardly slept that night, as the ECO did not sound very understanding at all and berated me sharply for overstaying!<br />
<br />
The next morning (5 March) the text arrived saying my application is ready for collection. So it was with a heavy heart that I drove to Cape Town, but, lo and behold - the visa was in my passport!! I nearly cried from relief.<br />
<br />
So, a word of encouragement to all - stay positive and be thorough in your application. And above all, be honest!<br />
<br />
Apart from the basics, I also included a letter explaining my overstay, extensive bank statements showing the origins of my savings, job offer letter, letters of support from family and friends, Land Registry extracts for our rented flat, divorce and marriage certificates from my previous marriage, lots of proof of residence and ID for my sponsor and cards and photos from our relationship.<br />

		<description><![CDATA[Sorry to keep mithering with all my questions! We're going to Senegal on Monday and will be submitting a spouse visa..my queries are -<br />

My most recent bank statement is a few weeks old now, the next one is due next week but we will have left by then. I am with Natwest and they will print out my most recent transactions but will not stamp for authenticity. Will this be ok? I will explain in the cover letter the reason for this.<br />

I am withdrawing £700 today for the payment of the visa in Senegal. Should I include the receipt for this in the application?<br />
<br />
On the application form it asks the applicant what his current address is. My husband is an overstayer and so has been living with me. Do we put our address or do we put the address he will be living at in Senegal when we apply for the visa, even though he is only there a couple of weeks prior?<br />
<br />
Our flight tickets are e-tickets. I have only the email confirmation that I have paid for them. Will this be sufficient in the application to show I have funded the whole thing? <br />
<br />
The visa application asks if the applicant will be travelling with anyone. Our son will be with him for a couple of weeks, if the visa is granted they will travel home together. My son is a British citizen and does not require a visa. Do I have to include him? If it weakens our case I can easily go and get him myself instead.<br />

I think that is all. I really appreciate everyones help. Fingers crossed our application will be successful but to be honest I'm preparing for the worst with him being an overstayer. If it is granted I will be so shocked!]]></description>

I hope somebody could help. I have passed my life in the uk test and got my pass notification letter.<br />
When I came back home I reaised that instead of town of birth I have put place of birth - county/district.<br />
I am not sure what to do now as my town of birth is not recorded on a letter - only county/district of birth and a country<br />
What is the best thing to do now as I need to apply for my ILR soon and worry that it could create problem. <br />
Is it better to take the test again to avoid a problem with ILR?<br />
Also if I take the test again  will it effect my application? Will I have to inform home office about first certificate and will my application will still be considered as straightforward - can I apply in person at PEO with second certificate?<br />

<span style='font-family: Comic Sans MS'><span style='font-size: 13px;'><span style='color: #006400'><strong class='bbc'>5 March 2010: Temporary closure of the visa application centres in Pakistan</strong> - the visa application centres in Islamabad, Karachi, Mirpur and Lahore will be <strong class='bbc'>closed from 11 to 15 March</strong>. The closures are to enable the installation of a new IT system at the British High Commission. This is part of a global programme affecting all British High Commissions and Embassies. The last date on which Gerrys will accept new applications in the visa application centres is Wednesday 10 March. The visa application centres will re-open on Tuesday 16 March. Please note that the UK Border Agency office in Islamabad will also be closed from 12 to 15 March, after which the aim is to resume a normal visa service as quickly as possible.<br />

No doubt as ther installing a new software at the pakistan VAC'z the plonkers will probabli mess some records up, and naturalli the system will take some time to getting used to (i.e. ironing software bugs and all) always puts a smile on my face news like this.....pay a CONSIDERABLE over priced application fee + processing times are usualli slow in Pakistan relative to global standards! and then just to pinch tht nerve they throw in system updates! <br />

im sure the last time they did something similar (August 2009) ther was some botch up and avg processing times wer about 3 months!<br />

I've trawled through many posts on this forum and it has been very helpful.  However I have a couple of questions (doubts really) that I hope somebody can settle for me.  And if not for me, then for my girlfriend who is having kittens and has somewhat ripped apart my lovingly prepared support documentation that has finally touched down in Peru.  I dare say  a previously refused visa for a simple holiday in USA is playing heavily on her mind.<br />
<br />
I initially met my girlfriend in Sydney in late 08.  We don't have many photos from this time because it wasn't that serious then.  I've included a photo of us from this time but my girlfriend is concerned because the photo could have theoretically being taken anywhere, because its just us and some buildings.  If we say the photo is from Sydney, surely the ECO must believe us when we say this?<br />
<br />
I since visited her twice in Peru last year anyway and we have loads of photos of this, so really I believe its a moot point, but my girlfriends too has been looking intently through this forum and unfortunately trusts posters on here, more than she does myself.  Oh well..<br />
<br />
And finally, proof of emails.  How comprehensive would this need to be.  Screen grabs of inboxs showing dozens of email exchanges as well as one or two printouts of actual emails.  THis will suffice, no?  Again, she wants to include loads of printouts. I don't think we should get bogged down with that sort of stuff.  Besides, ultiamtely, I don't think it matters so much that we proof how we met back in the day, but instead focus on what we do to stay in touch now.<br />

having lived in Uk for 10 years lawfully and unlawfully for six and a half years, i have worked on occassions but now that i need to regularise my stay i have noticed that my kids birth certificate states my job titles at the time. does this raise suspicion with home office? should i declare i never worked? Ni number used was that of relative. is this a problem? my fiancee is of british origin (same as kids). we have been living together for the past 6 years. been living with her parents and recently got our own place. please advise.<br />

		<description><![CDATA[Hello I will try and tell my problem as quickly as I can but any advice or ideas that anyone could offer would be so very much appreciated.<br />

I came to the UK in 2003 got married the same year to a UK citizen. I am an American citizen.<br />
Found out after we married that the law had changed and I was actually here illegally even after my marriage. (We had been advised by Immigration before our marriage that once we were married we didn't have to do anything further)<br />
<br />
So 2 years later when we found this out we rushed to the States and I got my FLR without any problems.<br />
<br />
Then when it was time to apply for my IRL things in our lives were in total chaos, our relationship had deteriorated but we were still living together not sure what was going to become of our marriage although we had both started seeing other people, my father became terminally ill, and with all the not knowing of what was going to happen we were advised to apply again for FLR as an extension from within the UK and I was given that.<br />
<br />
Not long after everything went downhill we stopped living together and I began a new relationship which now is a long term happy loving relationship.<br />
<br />
My problem now is in 3 weeks my second FLR will end, as I have been separated from my husband for so long I am not sure what I can do? I have been here 8 years. This is my home and I have no connections back in the USA. Is there anything I can do? Anything I can apply for? Anyway I won't have to leave or worse be removed? I am terrified!! This is my home. I support myself and have done since I was first given FLR. My ex and I have never legally declared we are separated and neither has pursued divorce,and we have very limited contact.<br />

I have no intention or desire to marry my current long term partner either. So what now? Please Help.]]></description>

		<description><![CDATA[I recently submitted online VAF4A form for UK Settlement Visa (married &gt;4 yrs). I have a query regarding my surname.<br />

This might be a bit convoluted, so please bear with me. (I am using fictitious names.)<br />
<br />
I am a USC.<br />
My maiden name was DOE.<br />
I then married JONES, but we divorced.<br />
I then married BROWN, but we divorced.<br />
I then married UKC SMITH and we are still married.<br />
<br />
After I married UKC SMITH, I resided with him briefly in the UK. During that period of time, I used his surname. My NI number was in the name of SMITH; my LLR (long since expired) was in the name of SMITH. I never changed anything else of mine (credit cards, driver's license, etc.) to SMITH.<br />
<br />
When we moved to the US, I did not use SMITH because everyone here always knew me as BROWN. I had been Mrs. BROWN for 25+ years. My US passport was still in the name of BROWN. Everything here in the US was - and is - still in the name of BROWN. I just didn’t want to change everything over to SMITH. <br />
<br />
When we return to the UK to live, I wish to be known as BROWN and not SMITH, and there’s no law that says I have to take my husband’s surname.<br />
<br />
I filled out the online VAF4A using the surname BROWN, although it did ask if I had ever been known by other names and I listed them all there.<br />
<br />
<span style='font-size: 15px;'><strong class='bbc'>Think this surname thing is going to create a problem?</strong></span> <br />
<br />
The only issue I can think of (after my move back to the UK) would be that my NI number is in the name of SMITH.<br />

		<description><![CDATA[My brother applied for indefinite Leave last year september 2009.He sent all the required documents including the life in uk test.He paid with a cheque.The home office sent back all his documents today with a letter saying the cheque bounced and he should reapply.The problem is........ his visa expired on 30th september 2009.How does he reapply to the home office.His wife and son are both british citizens.VISA EXPIRED!!!!!<br />

The letter from home office actually says invalid application due to the bounced cheque,the letter also mentioned immigration regualtion fees and advised applicant should pay the fee and follow instructions for application.Considerations will be given to applications on their on merit.<br />

A couple of quick easy questions, that fingers crossed, one of you lovely people can answer for me.   FYI she's in Peru, we are each others first love.<br />

Question 1.5 - Marital status.  What should we technically be putting for this one - single or unmarried partner? (we have never lived together as a couple). Im inclined to think it wants me to enter single.<br />
<br />
And what impact does this have on questions 4.11 - 4.15, where it ask for details about spouse/partner.  Or if single skip to 4.19.  Like I say, i believe its wanting us to enter single, but to then ommit my details from this section would seem absurd.<br />
<br />
I know Im probably looking / sounding like an idiot here, but it's been so long, I don't want to give anybody any excuses for dragging this out any longer than necessary, or heaven forbid, failing altogether.<br />

I had some amazing news this week. My Fiancee's visa was granted having waited about 30 working days for the answer. Processed in New York and application submitted in Ecuador.<br />

When we applied we put an optimistic travel date on the form, with Xmas and new year, this date has long passed. <br />
<br />
If anyone has any experience could you tell me the following... <br />
<br />
1. As the requested travel date has now passed, will the visa start from the date they advised us it was successful (by email) or the date my fiancee collects it? <br />
<br />
2. Is there a time limit when my fiancee has to arrive in the uk? Ive read on another forum that she has to travel within 28 days of the start date of the visa. (I cant verify this anywhere else). The reason this is an issue for us now is my fiancee's brother is getting married sooner than expected and she wont be able to travel for another 5 weeks! I want to be 100% on this before we book flights.<br />
<br />
Over the course of the application we've struggled to get much helpful info from the uk gov websites and embassy staff (often quite rude) <br />
<br />
If anyone has any questions about what we included with our application, i'd be happy to answer... Our successful application was only possible after reading forums like this one and independent websites. <br />
<br />

We applied on the 2nd february and received the answer on the 9th february in algiers, so was a really quick response. was nervous at first with the quick response but they gave it to us. Think because it was my fiancees 3rd visit to the UK plus she had a degree in english teaching , but everyones application is different.<br />

Is their time limit for her to arrive and does anyone know what documents will need when we go to the registery office to get married.<br />

Although I'm a Brit we met and married in Austria where I was working and so decided to come back into the UK under the EEA rules . . . much cheaper. My question now concerns her getting naturalisation as wife of a British Citizen. In theory she should be able to apply after three years but I don't see anything in the legislation regarding someone coming in under EEA law. My friend is planning to bring his son to the uk to join him and do not know how and what to do.<br />

Firstly, my friend his married to a British citizen and have his 2 year spouse visa in his home country b/4 arriving in the uk.<br />
<br />
He has now naturalised as a British citizen with British passport.<br />
<br />
He said the boy's Data and all other informations was included in his spouse visa application b/4 he arrived at the u.k then.<br />
<br />
My question are:<br />
<br />
1. can the boy apply for right of abode to come into the uk.<br />
<br />
2. can the boy be resistered as his depandant abroad.<br />
<br />
3. can be boy apply for visit visa and then apply to check his staus br registeration in the uk.<br />
<br />

I came to the UK back in 2006 and married in 2008. I have a spousal visa and the earliest I can apply for ILR is October. Having just been laid off, I can already see that there's no way we'll be able to afford it. <br />

My family back at home (in Canada) has offered to pay for my tuition to get a degree if I return home. The problem is my husband refuses to move to Canada for any amount of time. I'm tired of living in the poor house so I feel that this opportunity is too good to pass up. The course would be for 4 years and I would come back to visit as often as I could. My aunt has said that I would probably be able to do a semester in the UK. I would really like to go home and get my degree but will this affect my chances of getting back in the UK? I also have a child with my husband, would that help at all? Are the quantity & types of supporting documents for showing our permanent living together, sufficient to satisfy the requirement as stated on the visa form?<br />
<br />
What is the current average processing time for this type of visa? The official line is that 95% are processed within 6 months. This seems quite a considerable amount of time.<br />
<br />
Appreciate if I have missed anything important with respect to documents needed for ILR, obviously also taking into account my wife's Life in The UK certificate, photographs & passports (her's & mine).<br />

I am about to submit my FLR(M) by post.  I came to the UK on a fiancee visa.  I am concerned and confused, because I have read many post where other applicants are submitting many documents with their applications such as proof of residence, bt bills gas bills, wedding pictures, and budgets.  However after filling out the application it appears to me the only documents they are asking for are;<br />
passports<br />
marriage certificates<br />
absolute decree<br />
bank statements<br />
pay slips<br />
and picures<br />
<br />
Why are other aplicants suppling all the other documents? <br />
<br />
Also should I include a cover letter?  I if so what should it say?]]></description>

		<description><![CDATA[Hi all,<br />
We are now preparing to complete the visa form for spouse visa and have a couple of questions I hope some can help with.<br />
On the British embassy website in Senegal it states that we should complete the form online and then take it by hand to the visa section there and pay the fee in local currency. On the Border agency website it states that that dakar doesn't accept payments on line so that is fairly straightforward.<br />
I am wondering however if it would be ok if we print the form before filling it in and handwrite it rather than printing off a completed form. The reason I ask is we are yet to marry and my husband will need a new passport when we get to his country. These details are needed on the form and if we have to complete it online we will have to do the whole thing in an internet cafe in Dakar rather than just being able to add the necessary details by hand once we have them.<br />
Also, the form would be in black and white. I presume this is ok?<br />

<ul class='bbc'><li>I am British, my fiancee is Trinidadian.</li><li>She is currently in the UK on a student visa.</li><li>We are getting married in May (we have the certificate of approval).</li><li>I am currently employed but have handed in my notice, as I wish to relocate and change career.</li><li>We intend to apply for a marriage visa in August, and it is likely that both of us will be unemployed at that time.</li><li>She has substantial savings - enough to cover the cost of living for at least a year while we job hunt.</li></ul>We just want to check that savings will be sufficient evidence of our ability to support ourselves. Do you know what level of savings is required as a minimum?<br />

I would appreciate advice on my spouse visa appeal. The visa was refused for absurd reasons with all the evidence present, however i have provided further evidence in form of property inspection report with my appeal. <br />

I have involved my MP in this matter as I am disgusted with the decision, he has wrote to the Head of visa Customer service, is this the write person to write to and does this person have any authority. <br />
<br />
I have been informed that this will not help and that the MP should gather all the appeal information and fax that together with the letter explaining where the decision was wrong. <br />
<br />
I would like to know if this is common practice for the MP, who specifically to contact at the BHc, how long it will take and do they change there decision in pakistan, I have heard they are reluctant, but this is a genuine miscarriage of justice. <br />
<br />
Please inform me on the best way to proceed. Is there anything I can do to spped up things, contact people at the BHC. <br />

My wife received her FLRM November 2009 and is now on her 2 years probationary period. We are considering a temporary move abroad together (for work) that may last at least 18 months years from July 2010. So that would be 18 months out of 27 spent outside UK.<br />
Are there any guidelines of how much absence is considered to be acceptable. We will be living together during that time but not in the UK. Would owning a house in UK and regular visits back to Uk add any merit to our case?<br />

I mailed out my FLR(m) application to the UK Home Office on 26/01/10.  I received it back today, with a reference and case ID number, stating that my application was invalid because my mouth was slightly open in the passport photos.<br />
<br />
Although very annoyed(!!!), I retook my photos today and had it couriered back to the home office.  My question is, how long would this have significantly delayed my application?  Is my application going to be sent straight to the back to the queue again, once it is received, or will it be directed to the specific caseworker who was looking at it before?<br />

		<description><![CDATA[As daft as it sounds my husband has been granted a spouse visa stamped dec 09, however he has been offered a very good package from his present employer which he is finding difficult to refuse and would require him to stay in his former country for 9- 12 months and they are offering a  guranteed tranfer to the UK offices of his present employer at the end of this year.<br />

I am not aware of the conditions of the spouse visa, is there a condition where if he does choose to come come later this year his entry be refused due to delay ??? we are aware this would delay his residency visa vastly but just need to know at this moment of time...how it would effect him if he was to enter a year late after his spouse visa was issued.<br />

		<description><![CDATA[I had been in UK for last 4 year on Work Permit and recently got my status changed to Tier2 ICT. My current Tier2 ICT Visa is valid till Jan 2011.<br />
My wife & child are in UK for last 2 years on Tier1 General & Tier1 General dependant Visa.<br />
I'll be eligible for ILR in Dec'10 with the current rules. <br />

However, heard that new rules that do not allow Tier2 ICT holders settle in UK will come into play soon. Hence, I plan to change my Visa status from Tier2 ICT to Tier1 General Visa at the earliest.<br />

I learnt that my family to get ILR along with me need to be my dependants.<br />
<br />
Could you please let me know, if my wife and child can change their Visa status to my dependants while being in UK when I apply for my Tier1 (my Tier1 G application & dependants applications sent to home office at the same time).]]></description>

Sorry to be a pain.<br />

Since my husband went back to Jamaica last month and didn't apply for FLR (M) ( - he was here previousely on a fiancee visa. ) We pretty much realised straight away that me moving to JA was going to be much harder than we thought. Hubby also realised quite quickly that he had over-reacted to feeling home sick, and i think it took him going home to realise it really.<br />
<br />
We now plan to apply for a spouse settlement visa very soon, for him to return. We notified Kingston of our intention almost immediately and they have confirmed they have made a note on his file.<br />
<br />
My question is really, can him returning to JA affect our application, will they be able to refuse this new application? would they view him returning before FLR was applied for as a negative.<br />
<br />
We intend to explain our situation and reasoning for his return in the supporting statement honestly and truthfully, but i am worried that they will feel that because he returned last time, he does not want to settle here.<br />
<br />
What is the position they can take on this in terms of the rules, and assessing our application?<br />
<br />
Has anyone else been in a similar situation?<br />
<br />
We would really appreciate advice on this.<br />

		<description><![CDATA[i would like to let everyone know that i got my visa today, i was overstayer since 2004 and applied for my visa November 2009, biometrics 30 december 2009, and got DL 5 march 2010. im so over the moon, i would have never done it without this website, it gave me hope and focus when i needed it, it took me almost a year to get everything ready and went through IAS (Immigration Advisory Service), they wrote a cover letter and handled everything for me, im so glad for their help, this website is the best when it comes to info and help,<br />

I'm not sure if this is the right forum to post this or not ...............however I would like to share this experience and would appreciate some feedback.  <br />

My husband is Albanian, I am British. He has a spouse visa. <br />
We went on holiday to Spain for few days and landed back at Newcastle airport on Friday.<br />
When we arrived at the immigration desk, he was told that they had just installed fingerprint readers to cross-check fingerprints against the immigration database. <br />
His fingerprints were scanned, however there was a problem with the fingerprint reader. <br />
He was kept there for about half an hour and I was moved on, told to "wait somewhere else". <br />
Apparently the problem was the fingerprint reader, the staff told him that "this was the first day we have been using it, you are the first person we have used it on and we don't really know what we're doing". <br />
Eventually they decided that his fingerprints were not in the system, but acknowledged that his identity was genuine based on his documentation, so he cleared immigration. They did however tell him he may encounter problems in the future. <br />
My questions/grievances are as follows:<br />

The embassy in Albania took fingerprints in June 2008 when we first applied for the visa. Therefore if the government decides to implement a fingerprint reader (which I think is a good thing) then why are the fingerprints not pre-loaded into the database before they start using it?<br />
<br />
Who do we need to contact in order to resolve this? It is simply not good enough for them to say "you may encounter problems in the future". Why should he encounter long delays every time he flies because our government is so incompetent that they cannot train staff properly and implement their systems correctly? To make him look "dodgy" in front of all other passengers when he is perfectly legal in this country ? We have suffered enough already  as anyone who has read previous posts will know.<br />
<br />
Please can someone advise the best department to contact to resolve this and has anyone had similar experiences to this?<br />

She didnt disclose this in her application nor did she give the address she lived at during this period of separation. Had she done so then Im sure she would not have got ILR since we didnt keep in touch during this seperation. We reconciled but now she has left again. Can she be prosecuted for obtaining ILR by deception?<br />

it asks right at the end, 'HAVE YOU USED AN AGENT OR A REPREASENTATIVE TO COMPLETE THIS APPLICATION?' = ANSWER WOULD BE NO??????<br />

		<description><![CDATA[Need to make sure this is OK, for sponsorship and accommodation - have a letter from my private landlord confirming property size and saying that when my fiancee arrives, they will "add her name to the tenancy agreement" so we'll be joint tenants. They then say "the tenancy agreement is ..." and give the details and dates of my AST agreement, and that it'll run on after the initial period. Should this be OK?]]></description>

		<title><![CDATA[Mother's Settlement Visa Rejected, When To File Family Visit Visa?]]></title>

My mother is 55 years old and a widow living in India alone. I am a British citizen through naturalisation and well settled here. I decided to apply for settlement visa for my mother so that I can look after her better but her visa was rejected on the grounds that there were no "exceptional compassionate circumstances" shown. I hadn't consulted a solicitor before applying initially. I did have 28 days to appeal but when I consulted a solicitor they strongly suggested against doing it as she didnt have any terminal illness nor is she bed ridden that can prove exceptional compassionate circumstance. I hadn't realised the phrase meant the individual below 65 years had to have this extreme health reasons - and only then they could get settlement visa. Anyway, I took my solicitor's advice and decided not to appeal.<br />

Now I still want my mother to be able to visit the UK on family visit for 6 months at a time and go back. This way atleast she can spend nearly half of the year with me and my wife here. She has visited us twice in the last 2 years on family visit visa of 6 months. But now with her settlement visa reject, I am concerned that UKBA will reject her family visit visa as well. Its been 3 months since we had applied for her settlement visa. For how long should we wait before we can apply for a family visit visa and expect to have some chance of getting it approved at the time of application? Obviously if it gets rejected (which is strong possibility as I am told), I will appeal! Any advice?<br />

We are filling in the online application form on the UK Visa Website for my husbands spouse visa application. He is in Jamaica.<br />
<br />
When he starts he puts that the type of application is 'settlement' and the purpose is 'husband'. <br />
<br />
After he fills in the 'about me' section he is asked;<br />
'what is the main purpose of his visit to the UK?' (was going to put to 'settle with wife'...is that ok)<br />
'How long does he intend to stay' (?)<br />
'When does he intend to travel to the UK?'<br />
'When does he intend to leave the UK?' (?)<br />
<br />
I understand the question about when he intends to travel but the other questions are not relevant for a spouse visa as he intends to settle in the UK...am i filling out the right form?? (i wasn't given an option apart from type of application in which i put settlement)<br />

Any help is really appreciated<br />

I have done quite a lot of research and in terms of accommodation, & money etc. we will be fine. But I am concerned that his previous immigration history might jeopardise his chances of visa success, and would like to speak to someone. However, if I pay legal fees, it will really deplete the money I have saved for our wedding & the visa etc. Does anyone know of a decent and reasonable legal advisory group that can help?<br />

		<description><![CDATA[Hello i wonder someone can advise me, my wife is in process of applying her settlement visa. i live with my counsin family. it is five bed room property. i pay rent for one room which i have exclusive access to. i have tenancy agreeement, letter from council stating no overcrowding will occur due addition of one more person. Also have a letter from cousin stating they have on objection on my wife moving in with me and they will not be increasing my rent. I pay rent by cash and my cousin provides me handwritten receipts. <br />

do you thing above will be enough evidence as for as accomodation is concerned.<br />

Myself and my wife are sitted here thinking of what the best action could be... Here is the scenario. We got an eight months girl and my wife has been on paid (smp) maternity leave for about 7 months. I am a full time student and got made redundant  about 2 months ago from the part time job I had so we are not very financially sound at the moment. We are thinking that Mrs should go back to work ASAP but the question is who is going to look after the baby? I am at school from monday to friday and so can have the baby over the weekends or in the late evenings. My course is very solid and attendance is a must, no two way about it or I wont be offered the a job come September. <br />

So if Mrs goes back to work we shall need someone to look after the baby without spending all the money on child care so we are thinking of inviting my sister from back home to help out for about 4 months untill i finish school atleast. My wife is British and I am also hoping to be naturalised in the next few weeks but I am originally from East Africa.<br />

The problem is that the bank statements we shall provide are the old ones with the statutory maternity pay as Mrs hasnt yet gone back to work but as soon as she does,the payments will sharply rise.  On the positive side though, we own our home and have never signed on or intend to sign on. <br />

<strong class='bbc'>How to we prove that we shall not constitute any financial burden on the state when she gets here? </strong>Do you think attaching the originalemployment contract stating what her real salary is and attach some of the pay slips before she started the martenity (full pay) and those during the maternity (partial pay) will help? <br />

I have a little concern I'm hoping someone can clear up for me.<br />
I was granted spouse visa in July09 and due for ILR in July 11.<br />

My wife is a British citizen born in Humberside and also an Australian citizen by naturalisation.<br />
My wife's brother is getting married in Australia in September this year (2010) and we are planning on going down under to Oz for the wedding.<br />
<br />
To enter Australia, I need some sort of visa and we have been mulling over putting in an application at the Australian High Commission as the spouse of an Australian citizen but I am concerned how this may be viewed by the HO in 2011 when I hand in my passport for ILR.<br />
<br />
If an Australian permanent resident stamp is seen on my passport, will the HO feel unconvinced that I intend to settle here in the UK? or am I better off just applying for a visit visa to enter Australia to prevent any compromise in the future?<br />

		<description><![CDATA[I'm always going through the Home Office's immigration rules and guidance (for spouse visa) on their website and was wondering if you can make references to the guidelines/rules in the sponsor's letter?? i.e. Once you have declared that you are the sponsor you go through all the requirements and guidelines for the spouse visa to explain how the applicant meets the requirements.<br />
<br />
For example, one paragraph would be for Maintenance and Accommodation where you would explain any funds you have (of course with proof), that they are immediately available to you and your spouse etc.., explain as it states on the Home Office website in the Maintenance and Accommodation section that as your/applicant's qualifications/CV show you/the applicant are/is qualified and have X amount of experience in X area proving that you/the applicant are/is most likely to be employed once in the UK quoting, <em class='bbc'>'do the applicant’s / sponsor's educational qualifications and any other skills or qualifications offer a reasonable chance of obtaining employment? If so, that should be viewed as sufficient to meet the maintenance requirement without having to make further enquiries.'</em><br />
<br />
Can the sponsor write his/her letter this way or is it unadvisable? <br />
<br />
<br />
Also I found this interesting as it says that third party support can be allowed if the ECO exercises discretion right? But that almost never happens!<br />

		<description><![CDATA[I'm a citizen of Pakistan but received my Settlement visa from the middle east where a TB screening/certificate is not required in order to apply for a settlement visa.  However, applicants from Pakistan are required to have a TB certificate.<br />

Although my visa was issued from a Middle Eastern country will I still be asked to produce a TB-screening certificate?<br />
<br />
Just a bit confused since the law states that anyone coming on a visa valid for longer than 6 months needs a TB certificate...then why not make this mandatory for all settlement visa applicants at the time of application submission to the embassy regardless of nationality?<br />
<br />
Has anyone here arrived to the UK before without a TB certificate?  I am planning to get screened anyways but would like to hear from others regarding their experiences on this topic.<br />

		<description><![CDATA[Does it matter if on some documents, your address has the village/district name, and on others it does not? I can't imagine it'll be an issue, as the number, street, town and postcode are all the same, but I just wanted to make sure. It's the way some automatic systems work.<br />

Just ought to clarify - the property is right on the border of the village/district, so on the tenancy is has the village/district name, but my bank statements/council tax stuff don't have it. Is this is a problem? Again, the number, street, city and postcode are all the same.<br />

Anyone know if this is something I need to sort out? The suburb never appears on automatic postcode finders, but does on other things.<br />

After checking, I don't think the address is in that suburb accordiing to the post office system, but it's often seen as part of it by people livng here. It shouldn't be a problem, that extra line being on the tenancy, should it?]]></description>

Just wanted to say thanks to all for any information or advice I've picked off this forum. I've never monitored a forum so much but every little bit of info is good info when it comes to such a mysterious subject. It's thanks to such experts as Susi, Victoria and GOL when it comes to straight forward tips and hints that I found it possible to compile all the evidence. I've never felt my heartbeat in my head before but as I was waiting for my wife to come out of the application center I didn't know what I'd do if it was refused.<br />

One tip to any applicant would be to keep it quality over quantity and make it easy for the ECO to flick through your case over a coffee. We put our application in at Cape Town on Thursday morning and got it back on the Monday afterward. 2 working days came as a real shock! <br />

If anyone wants any tips then give me a shout and I'll be happy to give my 2 cents worth. But I would say if you've got any "out of the box" circumstances then you really should use the help of the professionals who are so good at knowing what you need and whether you have a good shout or not. It's not worth waiting until you get refused and going to an appeal which will take months!<br />

		<description><![CDATA[My girlfriend applied for visas in China a couple of times. They ask for original documents but then don't give them back. This means if you are refused the visa or need another visa later, you don't have the original anymore.<br />

Is it possible to ask for the docs back? This recently happened in Shanghai and about 1 year ago in Beijing. I need this stuff back for her girlfriend to apply for a fiance or spouse visa.<br />

I hope someone can help me. I am confused when to apply for ILR for my wife. Does she need to apply 28 days before her visa expires or 28 days before she completes her 2 years in the UK (from the date she entered the UK). Also as we are living with my parents, we don't have much letters addressed to us, only have bank statements, NHS letters. What do we need to do in this case?<br />
Finally, i claim working tax credited. When i claimed working tax credit i was asked following questions. 1) Are you married? Yes , 2) Is your partner subjected to immigration control (no recourse to public fund) ? Yes   <br />
The claim has been put through as a couple. Could this affect our application for ILR.<br />

My spousal visa expires on the 30th of Nov 2010, I will be having a 15 day holiday back home (a friend is getting married) and I will be traveling alone  my husband can't take holidays then;<br />
and i will be back  in the UK on the 2nd of April/10.  By the time I come back I will have 7 and 1/2 months left on my spouse visa. Do you think they will refuse my entry at heathrow when I come back?<br />

Also I wanted to know for when can I make the appointment at Croydon to apply for my ILR? My visa was issued on 30/08/08 and expires on 30/11/10 (Could I apply in September or do I have to do it at the beginning of Nov ?)<br />

Had a problem today - just when I thought everything was going rather lovely!!<br />

We had to go to our local designated office to register my fiancee before we can book the wedding date - told to bring passport etc and that was about it.  We went this morning, and were seperated (which immidiately got my fiancee worried!) - from that the man called me in after about 20 minutes and said he would not authorise us to marry as he didn't know the postcode of where we lived, and didn't know the address of the registry office we want to get married at - or the date.  I got a bit irate and said he had been in the UK for 9 days - and postcodes were not something I expected them to quiz us on.  Also, our local registry office wont let us book a date until we have been to the designated office first for clearance.  The man was really quite rude to me, saying he didn't think we were a 'couple' at which point I burst into tears!! I expected today to be easy !  So we have an appointment again next week, where I have to write a letter to say he lives with me (which is fine!) and he has to recite my postcode and the wedding venue that isn't booked yet.<br />
Has anyone else ever had problems doing this before, or did I just get bad luck!!<br />

		<description><![CDATA[Hi everyone...i am confused with regards to the sponsorship undertaking form<br />

I am applying for spouse settelment visa and i am the sposnor, however my father will be providing the accomodation (home inspection done, and he will write a letter to confirm this)<br />

The question i have is do i fill and sign the sponsor's undertaking section? ( im pretty sure i do since i am the sposnsor) but at the end of the form it says the sponsor should provide evidance that he/she lives at the address<br />
<br />
I only have my bank statements coming to that address, is that enough for them to know that i live at that address?<br />
<br />
Also im getting confused with the accomodation side of things as my father is providing accomodation does he have to fill in this form aswell? since it will be his house we will be staying at does he need to take this undertaking also? or is the home inspection, his letter and also land registry document enough from his part?<br />

Another confusion im trying to get past.....any help and advise will be very much appreciated........especially from some of the experts?<br />

My Thai wife and her 2 daughters have been with me in the UK for a little over a year now and generally things are going quite well.  <br />
<br />
Wife has good English language skills and was actually able to pass the Life in the UK test in August of last year.  Unfortunately, due to her exitement at having passed the test, she failed to notice that her Town of Birth has been recorded incorrectly on the pass letter as "Nondkhai" instead of "Nongkhai" as it shoud be.<br />
<br />
Is this likely to cause us a problem with her ILR application?<br />
<br />
Although I thought not at the time, it has been bothering us lately and we would be greatful to anyone who could put us straight.<br />
