Ilr For Dependant Son Turned 18 - Eligible? Which Form?

Our family arrived in UK on 14 Aug 2004 - UK Ancestry entry for me, Dependent entry for my wife and son (then 13) We all have Australian passports

We obtained LLR in August 2008, and when our 5 years comes around on 14 Aug 2009 we all hope to apply for ILR (just waiting to do the "Life in the UK" test before making an appointment). After 12 months with ILR we then hope to apply for British citizenship in 2010. There are no known issues with time spent overseas, offences, finances etc.

My reading of the BIA website seems clear I should apply for ILR using Form SET(O) and include my wife's application on the same form.

Unfortunately my son turned 18 on 22 May 2009 so cannot be included on the same form. He has been in full time secondary education until approximately 1 month ago (so was and is currently still a dependant). He has begun job hunting and hopes to work his gap-year before starting further education next year. Whether or not he gets a job he plans to continue living at home (no "independant family unit" issues).

I have a few questions...
  • Is my son eligible for ILR, and which form should he use to apply for ILR? I can't see an obvious match.
  • Can someone confirm my sons current LLR (and future ILR if all goes well) entitles him to work. The right to work in the original dependant visa was clear for my spouse, but unstated one way or the other for my son as he was, at the time, a child.
  • Any other points, warnings or issues you may spot in our situation.

We appreciate any assistance you may be able to give
