Passport Lost

Hi everyone,
Could learned forum members put some light on this? If homeoffice lose your passport while it was held by HO for the consideration of extension of visa on different visa status,they can give you indefinite saty in the UK if claimed----Myth or Facts?
There is a hear say regarding this issue so it would be nice if someone in similar situation can explain or if someone has actually applied for it and the outcomes.
I have not come across the rules or instructions to caseworker to grant indefinite leave solely for losing apllicant's passport due to carelesness or other reasons. However I am wondering if this could actually be granted under outside immigration rules and on descretion of casworker;and how likely or normal sceanario would that be if someone actually calim for it......

hi victoria,
yes homeofiice did lose my passport but it was long back i.e;on 2000.I didnt apply for indefinte leave then because i didnt think i would have been granted even if i had claimed for that.
the reason why i am posting this is there is a myth (facts??) whirling around this particular matter. There is a hear say. So it would be nice if a person like you and andrew could clarify this for once and all.

I cannot see how you would be eligible for ILR. Look at it this way, you could claim the cost of a replacement passport from UKBA, but not ILR because of a lost passport.

What did you apply for in 2000?

What was the result of the application?

When did you come to the UK and what capacity was this?

Summertime, i got my repalcement passport in 2000 after the loss and subsequently extended my visa. Its not for me to claim indefinite stay now after 10 years beacuse of the loss,there is definately the route of long residence and also other routes for different visa categories towards settelment but If you look at the start of thread i am simply putting forward the question...is it myth or fact that a passport lost by homeoffice gives any room for the claim of indefinite stay or not?? surely there is no rules and instruction to caseworker to grant such leave but as a matter of hearsay... can that be excersied under out of immigration rules or at decretion of caseworker?so i am trying to welcome thoughts on this regards from learned scholars in this forum.

HI,
Its a Myth as the Home Office will only pay for the replacement passport and a letter for future refernce that Uk Home office had misplaced your old passport and nothing else.
