Whm Switching To Spouse Visa

Hello Everyone,
I m currently on WHM Visa which due to expire on next August 2010 so If I want to switch to Spouse visa, do I need to go back india with my spouse ? or is it allright If I get married here in UK and Switch it to spouse visa.
I really appreciate your help that you all people are doing for everybody.

You can do this from inside the UK.

However, you will have to apply for a Certificate of Approval (COA) from the Home Office for permission to marry unless you are lucky enough to find a Church of England vicar willing to marry you without this.
You're both over 21?

Hi Aneil,

Did you successfully switch your WHM visa into spouse visa?
Do you encounter any problem? I would be appreciated if you could share some of your experience.

I am from Malaysia basically. I am currently holding Tier 1 visa which will be ending in Sept 2012.
I am wondering if my partner could switch her visa from WHM (ending in April 2010) to unmarried partner visa/spouse visa within UK?

Any advice will be very much appreciated.

Yes, that was the original question and the original answer. However (and unfortunately) you are not in a position to sponsor an unmarried partner/spouse visa as you are a PBS migrant. If you want to sponsor a PBS dependant application for someone who is currently in the UK under WHM, then the answer is no, it's not permitted but will, instead, have to seek entry clearance from outside the UK.

If you are intending to hijack any other old threads for the purpose of asking your own question make sure you pick one that matches or is relevant to your situation.

Yes, that was the original question and the original answer. However (and unfortunately) you are not in a position to sponsor an unmarried partner/spouse visa as you are a PBS migrant. First of all, It is very clear that I have no intention of hijacking any of the threat here as I am posting according to the title of the THREAT which is "WHM SWITCHING TO SPOUSE VISA"
Citing from my previous question:

I wish i had made it clearer this time.

As you mentioned that it is imposible for someone who is a PBS migrant to sponsor a PBS dependant application for someone who is currently in the UK under WHM,
do you mean that only the local British/ settled individual could sponsor a dependant application for someone who is currently in the UK under WHM?
The reason I am asking is because if I return back to my country (Malaysia) to seek for the entry clearance for my spouse, it will potentially take up to one month or even longer to obtain the spouse visa.
(It would be almost impossible for me to apply for such a long holiday away from work)
Therefore I would like to seek advice from this forum if anyone had successfully switching their WHM visa to spouse visa within UK or within their own country.

Also, I would be appreciated if you or someone could direct me to related threat or the most relevant threat. Many thanks.

The point is that you are asking about a spouse visa when this is not the category which is relevent to you.

A spouse visa means 'spouse of settled person'. You need to know about dependents of those on temporary categories, and as has been said this application cannot be made from within the UK.

No, you completely misunderstood. It's not you (the sponsor PBS migrant) that has to leave and apply from outside the UK; it's your dependent partner because it's not permitted to switch from WHM into a PBS dependant status from inside the UK. But you don't have to go with her when she leaves!
