Whm To Unmarried Partner Visa

I'm an Australian in the UK on a WHM Visa, which is due to expire in September 2010. I have been with my partner (who is British) for 4 years, living both here and in Australia. We wish to stay together permanantly but would like to spend more time in the UK. I know it's too late for me to apply for a Spouse Visa if I wish to stay.

Am I able to apply for a UP visa from within the UK before my WHM visa expires? If not, can I go back to Australia in July and apply from there. I have recently began teaching and would like to continue that work when school goes back in September (and I want to do it legally)!

Any help will be immensly appreciated as I'm struggling to find coinsistant advice Posted Image

Yes, you can apply for leave to remain as an unmarried partner from inside the UK if you have the evidence of a two-year relationship akin to a marriage.

I just stumbled across some information that worried me a bit.......

I had NO IDEA that if I leave the UK now I won't be allowed back in!

It also states that I CANNOT apply to stay longer, now that they have the new system/rules/YMS.

I was so happy when I read Gentleman of Leisures' reply, but reading the above link has thrown a spaner in the works again Posted Image

You are not applying to stay longer, you are leaving and applying to return in a different category. And WHM were never extendable beyond two years in any case.

Ah, yes, thanks for pointing that out, what I meant was.........Gentleman of Leisure said I could apply for the UPV from within the UK - thus moving onto a different Visa and staying longer. I'm well aware that you cannot extend a WHM visa.

My question was.....Do I need to be offshore to do this, or can I apply from within the uk. I'm getting conflicting answers from left, right and centre!

You CAN apply for the Unmarried partner visa fromw ithin the UK.

Also, what makes you think that you can't apply as a spouse if you wish? If your visa expires in September, this leaves plenty of time to get the COA and marry.

It was an option, but I have less than 6 months remaining on my WHM. I can only apply for the Spouse Visa if I have at least 6 month remaining on my Visa. Am I right about this?

I have less than 4 months remaining on my WHM visa in the UK and am exploring the option of changing to a Spouse Visa.

I know there are time limits, and that I need a COA (I've been with my UK partner for 4 years so the actual marriage part is no problem)!

I'm very unclear about time limits, or if I have enough time at all to get the applications/mariage done in time. I'm hearing 6 months from some and 3 months from others!

Any help would be much appreciated!!!
