Eea4 Application When To Apply

Hi guys,

I am 2 months away to apply for the eea4 but reasing the forms i think i can apply asap.
I came in uk with a fiance visa may 2006
We married in august 2006
Residence card received 2007

Am I right in thinking that I am eligible to apply now as i have ben exericisng treaty right from the moment I have entered the country?

i want to get it done as soon as possible as dont want to be spending the summer waiting.
On the other hand my P60 have the first address when I arrived in Uk, as the change of address wasnt communicated to whichever office that issues the document. Will a letter from the employer explain that, or should I ask for duplicates.

I have all the payslips for that period though

thank you in advance for your help as you always have been extremely helpful. Actually I need to mention that in one occasion a barrister who now is working as judge, failed to provide the right solution for a problem long time before. Not to mention the money wasted.
I asked the same question here and the correct solution was provided within the same day. To this day i am very grateful to you guys in this website

Assuming that your spouse has been exercising a treaty right, you qualified on your 5th wedding anniversary.

Thnx Victoria. My husband has been working and I have the supporting documents for all the period. I suppose I should include the supporting documents from the year that We got martied.

I just wanted to make sure, but thanks a lot for your help applying this late.

You need to show your husband's exercise of treaty rights and your presence in the UK for the last five years. It doesn't matter if you and your husband moved within the UK as long his exercise of treaty rights are shown and your presence, that there were no excess absences from the UK.
Also you need your passport, his passport/ID card and your marriage certificate. If all that is shown it should be strightforward. But note the document requirements as per the form and only an advisor who sees them can guarantee that the HO accepts them.

hi guys:
im an no eea national spouse to an eea national which is a self emplyed since we came to this country with no stop .actually i have 5 years residency permit expiring in january 2014

willing to apply for a permanent 1. i asked 1 soilictor he told that i can

apply for it right now ,because we are married for 5 years already and we living in uk from 7/01/2008, got my residency card back on january 2009.

Am i eligible to apply now as he said

You have not been living in the UK as a non-EU partner for five years. You can apply after 7 Jan 2013.

This might help:

I qualified for PR in Nov. '12 but sent off my EEA4 application mid October - 6 weeks before my 5th anniversary.

I cannot know if my husband already having PR confirmation helped but I received my CoA (with a case ID) and the right to continue in employment 9 days after.

In addition to our IDs and husband's PR card I also included 5 years worth of my P60s (to show my active residence in the UK) and our tenancy agreement covering the period before we got married to date.

My PR confirmation is yet to come through but looking smooth so far.
