Ilr Set (M) Form

Hi there,

I am just in the process of completing the SET (M) form for my wife as her 2 year settlement Visa comes to an end at the end of April.

2 questions;

(1) My wife is still yet to take her "life in the uk" test, will this cause any issues with the application, if she does take it and fails, what will the implications be?

(2) Have I left it a bit too late to apply?

Yes....you have left it late for your wife to sit the KOL test! If she doesn't pass in time she will have to apply for an extension on form FLR(M)....but unless her nationality or degree qualifications are shown on the UKBA exempt list she'll need to take the A1 English test first in order to apply for this. Hopefully, she will pass the Life in the UK test to enable her to apply for ILR. Does she have a test date booked?

Thanks Susi. If I apply for an extension, will I need to pay the fee twice and how does the extension work?

A postal application for FLR(M) is currently £550 or £850 for application in person at one of the PEOs. You would have to pay this fee.
Generally your wife would be granted a further 2 years, but once the KOL test is passed she could then apply for ILR...and would have to pay the full fee for SET(M).
Bear in mind that she doesn't have much time left to take the A1 language test needed for FLR if she fails the KOL test!

ESOL is one possible test.
