Spouses of EEA nationals can only be refused if the marriage is not considered genuine or if they are a danger to public safety or policy. Having been an overstayer before the marriage is not a danger in the sense of those rules. Overstayers marrying EEA nationals normally need to show a genuine marriage, but if it's genuine, it should be granted.
