Spouse Visa And Employment Outside Uk

I shall soon be compiling all the necessary documents and information in support of my wife's settlement visa application. I am reasonably confident that we satisfy most of the criteria however I have a question in relation to my working pattern which may have a bearing on the outcome of the application.

First of all, I am a British Citizen. I met my wife a little over 4 years ago and we have lived together in China since then. We have been married for 3 and a half years. I have been employed by the same company, a British oil major, for the past ten years. The working pattern I refer to is 3 months on, 3 months off. This has always been the case and will likely continue to be. Work is almost always outside of the UK. I spend my time off - 3 months at a time - exclusively with my wife and our two children.

My wife speaks good English and has visited the UK with me on separate occasions for a total of 4 months. Although this is only limited exposure to living in the UK, she is independently minded and quite self sufficient.

However, my concern is that our application will be weakened by the fact that my work takes me away from the UK for three months at a time.

Can anybody advise us on this. Am I right to be concerned? And short of securing permanent employment within the UK (and a hefty salary chop) is there anything we can do to demonstrate my wife is indeed as self sufficient as I claim?

This will be an issue. We have seen several refusals for people in this situation - usually oil workers who divide their time between on and off shore. In fact, we recently dealt with an identical application that was initially refused but allowed following submission of an appeal.

I would recommend legal assistance with this.

We shall be visiting the UK over Christmas. I think then would be a good time to engage legal assistance as I very much hope to be able to make a successful application at the first attempt.

Can you ellaborate at all on what swung the appeal in favour of an approval?

I think that would be a good idea.

The fact that you have dealt with what sounds like a similar application to ours, and successfully at that, is reassuring.

I note that your location is London - we will be visiting Scotland! Do you have offices around the UK..?
