Hi,

I had my First HSMP valid from 13/12/2007 - 13/12/2009
I entered first time in UK on 3/01/2008 but went Back on 4/01/2008 - reentered on 28/03/2012 and am permanently residing since then.

I was granted Tier 1(General) from 11/11/2009 untill 13/12/2012. This means my Visa validity was overall from 13/12/2007 - 13/12/2012 i.e exactly 5 Year.

I have a query:
Since I entered UK on 3/01/2008 but went back on 4/01/2008 when is my qualifying period considered? Is it 03/01/2008 or 28/03/2012?
On what date would I be elizible to apply for ILR or do I need to apply for extension?
Am I covered under the 28 days rule?

Any help on this would be appreciated?

I would suggest that the qualifying date is 13/12/2012 - you entered within 3 months of the start date of your visa and therefore the start date of your visa can be considered the start date of your qualifying period.

I do not understand what you mean by asking if you are covered by a 28-day rule.

By 28 day rule I meant to ask , can I apply 28 days before the qualifying period. I was not sure if my stay start date would be considered as 3 Jan(when I first entered UK although left immediately on 4th Jan) or 28th March when I started my long term stay in the country.

So when is the earliest I can send in my application? is it after 15th Nov 2012(i.e 28 days before 13/12)  or after 06 Dec 2012(i.e 28 days before 3 Jan)?

You establish the qualification date and then you can apply up to 28 days before the date on which you qualify.
