Spouce Visa Rejected Post 9Th July

My husbund had applied for spouce visa on the 9th of august. We were unable to apply before july because he didnt recieve his english test results after rule change. He got refused on the finacial requirement. I gave 9 month wage slips from november to july however from november till march i earned 1522 pounds per month before tax from april i got started to do more hours and being paid 1583 pound per month. I wanted to know if i could appeal on the basis of having increased salary from april. Could i attach august september and october wage slips and a letter from employer to explain hours increased from april.

Possibly - if you can show that, at the time of decision, you had been earning the required amount for 6 months.

You should get legal assistance.

Two out of the six months i was paid slightly lower wage of 1522 which needed to be 1550 but if i provide latest wage slips would they be considered.

I dont have the required 16 thousand plus. If i appeal would only prior application wage be seen. I have shortage of 56 pounds but my circumstances have changed from april 2012. so can i appeal on that basis.

You need to get an advisor to look this over. It might be better to reapply.

So if i re apply for spouse visa would i need to submit 6months bank statement or would 3 months be sufficient.

I have read on the uk borders website that new evidence is acpted only if it before the date of refusal. I want to know is the date of refusal clasified by when my sponsor was given his passport back or before?. In this case is new evidence with appeal relevant. The notice of descn which states with documents i can be sucssesful.

It is the date of decision as per the refusal notice.

The date of refusal was in november. It would be possible to overturn decision at ECM review. It states this on the notice of decision that with evidence it's possible for ECM to withdraw decision. All the infomation needed is provided on th border website it helped me a lot.
