I need some urgent expert advice.

Background: I have applied ILR using SET(O) after 5 years of stay in UK in last week of Sep 2012. I have received acknowledgement letter from Home Office on 01-Oct-2012 and payment was deducted on 01-Oct-2012. I had applied for me and my wife. Our Tier 1 visa expires in last week of Feb-2013.

I have not applied ILR for our daughter (born in UK and has visa expiry in last week of Feb 2013) and son (born this year but has no passport or visa - just birth certificate). We are from Asian background.


I understand now that it takes 4-6 months to get ILR processed. Does this mean that our kids will get in trouble due to this delay by UKBA.

a. Is it advisable to ask UKBA to return my documents, get a solicitor to help us get through ILR and then get our kids British passport registration (I understand that kids who are born in UK will get British passport once parents have ILR).


b. Is it worth waiting for application to be processed - which will mean any delays will be due to UKBA.

I am unsure where to go from here - we had applied almost 2 months ago and nothing has happened. We did not look around back then to check if the application takes so long.
