I have been in UK for 4 years on work permit. My biometric residence permit ends next Dec 2013, after which I become eligible to apply for ILR. However I have hit a block now. My company is moving to Belgium. Upon having heard about that, I shared my concern with my Bosses about the importance of me staying in UK in order to get the ILR. My Boss is helpful and said that he will pay me in GBP in UK Bank and that the company will still be registered in UK until the time I apply for ILR. The reason being, because I'm a skilled candidate and its difficult to find my replacement. Now I am not sure about what my employer said. I know he will pay me in GBP in UK bank, but I have serious concerns about my stay outside of UK for 1 entire year. Although my boss said, he would provide letter to the home office that its employment related, i still doubt it will help me. Please can someone help me know if I can get ILR under this scenario. If not, can you advise if I can get around it, by some legal loopholes. Ideally my first priority is getting ILR. I love UK, I have made some amazing friends and since I have no family back home. I have mum, but we dont talk been like that for 2-3 years. If someone was to suggest me, i wont get ILR, I will not go to belgium, but if there is a way that i can work in belgium for 1 year and yet still get ILR for UK, i would love it. Please advice on whether I should take up the job move in Belgium or should I start looking for a new job in UK. It will difficult as I have a PhD and my work concentration area is very very narrow. I forgot to add this. Yes I will be paying taxes in UK for the entire 1 year duration. Also I am aware of 90 day rule. I can afford to visit UK once in 2 months without any problem, so that i dont break the 90 day rule. But i have breaking the 180 days rule anyways. I have heard from some members that if its job related, then absences do not apply. Not sure though! Can someone please help. Thanks!!

I cannot see how you will qualify if you are living and working outside the UK for 1 year, regardless of where you are paid.

I have doubts that you would still qualify for ILR if you are not physically present in the UK.

He wouldn't. You have to stay in the UK.
