I applied for ILR under 10 year lawful residency in May 2012 and still waiting for decision. I have PSW visa until Nov 2013. I have a new born baby now.
My question is Can i apply Tier 1 PSW dependent visa for my baby even my ILR application is still pending? I did not applied for my wife with my application so she also has got psw dependent visa untill nov 2013.
My wife and my son needs to travel overseas in March. So in worst case scenario i want to secure visa for my son on same day service. Is this possible?

It would be pointless.

You are better off waiting, or him leaving and applying for leave to enter before he comes back.

Thank you for your response. I am waiting for last 7.5 months and i do not want to take further risk. Is there no chance i can apply for his Visa while my application under process?

I very much dount that they will grant your baby a PSW dependent when you have an outstanding application to switch categories.  I suggest you concentrate on chasing your outstanding ILR application.

I have chased my application via MP as well but HO is saying application is still ''Under Process''. I should better waiting for my decision...
